A. Bobde, J.)\n\n\n\n\n                                                                                        \n<\/pre>\n<p id=\"p_1\">    1.               The   petitioners   have   questioned   applicability   of <\/p>\n<p>    Maharashtra Employees of Private Schools (Conditions of Service) Act,  <\/p>\n<p>    1977  (hereinafter   referred   to   as   the  &#8220;Act&#8221;)   and,   therefore,   the <\/p>\n<p>    tenability   of   the   appeal   filed   against   them   by   a   teacher,   whose <\/p>\n<p>    services are terminated.   The petitioner is a School affiliated to the <\/p>\n<p>    Central Board of Secondary Education, Delhi and runs three schools <\/p>\n<p>    in   Nagpur.     The   petitioner-Management   terminated   the   services   of <\/p>\n<p>    respondent no.2, who, thereafter, has approached the School Tribunal <\/p>\n<p>    under   Section   9   of   the   Act.     The   Tribunal   took   cognizance   of   the <\/p>\n<p>    appeal and issued notice to the petitioner.  The petitioner approached <\/p>\n<p>    this Court questioning the applicability of the Act and tenability of the <\/p>\n<p>    appeal.  There is no dispute that the petitioner no.2 is a School, which <\/p>\n<p>    is affiliated to the Central Board of Secondary Education, Delhi.  It is, <\/p>\n<p>    thus, not a School recognized by the Director, Divisional Board or any <\/p>\n<p>    such Board or by any Officer recognized by State Government or by <\/p>\n<p>    the Boards, which alone qualifies for being treated as a private school <\/p>\n<p>    governed by the provision of this Act.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                                ::: Downloaded on &#8211; 09\/06\/2013 16:11:44 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                              3<\/span><\/p>\n<p id=\"p_1\">    2.            To decide the controversy in question, it is necessary to <\/p>\n<p>    look into the relevant provisions of the Act.  Section 3 (1) of the Act, <\/p>\n<p>    which defines the application of this Act reads as follows:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>               &#8220;3. <a href=\"\/doc\/518001\/\" id=\"a_1\">Application of Act<\/a>: (1) The provisions of this Act<br \/>\n               shall   apply   to   all   private   schools   in   the   State   of  <\/p>\n<p>               Maharashtra, whether receiving any grant-in-aid from  <\/p>\n<p>               the State Government or not.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">                  This   Section   makes   the   Act   applicable   to   all   private <\/p>\n<p>    schools.   Obviously, the term  &#8220;private schools&#8221;  also needs to be gone <\/p>\n<p>    into, which is defined by <a href=\"\/doc\/834434\/\" id=\"a_1\">Section 2<\/a> (20) of the Act is as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                &#8220;2(20) &#8220;private school&#8221;  means a recognised school<br \/>\n                established or administered by a Management, other<br \/>\n                than the Government or a local authority.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">                  The   term   &#8220;recognised&#8221;,   is  defined  in   <a href=\"\/doc\/834434\/\" id=\"a_2\">Section   2(21)<\/a>   of <\/p>\n<p>    the Act, which reads thus:-\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                                               ::: Downloaded on &#8211; 09\/06\/2013 16:11:44 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_5\">                                             4<\/span><\/p>\n<blockquote id=\"blockquote_2\"><p>                 &#8220;2(21)   &#8220;recognised&#8221;  means   recognised   by   the  <\/p>\n<p>                 Director, the Divisional Board or the State Board, or<br \/>\n                 by  any  officer   authorised   by  him  or  by  any  of  such  <\/p>\n<p>                 Boards&#8221;<\/p><\/blockquote>\n<p id=\"p_4\">                    The   terms   &#8220;Director&#8221;,   &#8220;Divisional   Board&#8221;   and   &#8220;State <\/p>\n<p>    Board&#8221;   are   defined   by   <a href=\"\/doc\/834434\/\" id=\"a_3\">Section   2(6)<\/a>,   (6A)   and   2(25)   respectively.\n<\/p>\n<p id=\"p_5\">    They are reproduced below:-\n<\/p>\n<blockquote id=\"blockquote_3\"><p>                 &#8220;2(6) &#8220;Director&#8221; means the Director of Education or  <\/p>\n<p>                 the Director of Technical Education [or the Director of<br \/>\n                 Vocational Education and Training] [or the Director  <\/p>\n<p>                 of Art] as the case may be, appointed as such by the  <\/p>\n<p>                 State Government;&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                 &#8220;2(6A)   &#8220;Divisional   Board&#8221;  means   the   Divisional  <\/p>\n<p>                 Board established under the Maharashtra Secondary<br \/>\n                 and Higher Secondary Education Baords Act, 1965&#8243;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>                 &#8220;2(25) &#8220;State Board&#8221; means-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>                    (a) the   Maharashtra   State   Board   of   Secondary<br \/>\n                    and Higher Secondary Education established under  <\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                                             ::: Downloaded on &#8211; 09\/06\/2013 16:11:44 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_7\">                                               5<\/span><\/p>\n<p>                     the Maharashtra Secondary and Higher Secondary  <\/p>\n<p>                     Education Boards Act, 1965;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>                     (b) the   Board   of   Technical   Examinations,  <\/p>\n<p>                     Maharashtra State;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>                     (c) the   Maharashtra   State   Board   of   Vocational  <\/p>\n<p>                     Examinations; or\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>                     (d) the Art Examinations Committee&#8221;\n<\/p><\/blockquote>\n<p id=\"p_6\">    3.               A   bare   reading   of   the   aforesaid   provisions   leaves   no <\/p>\n<p>    manner   of   doubt   that   the   Act   applies   only   to   private   schools   and <\/p>\n<p>    private schools are Schools, which are recognized by the Director of <\/p>\n<p>    Education appointed by the Government of Maharashtra or Divisional <\/p>\n<p>    Boards   established   under   the   Maharashtra   Secondary   and   Higher <\/p>\n<p>    Secondary Education Boards Act, 1965.\n<\/p>\n<p id=\"p_7\">    4.               This   being   the   case,   the   petitioners-schools   which   are <\/p>\n<p>    recognized by the Central Board of Secondary Education, Delhi are <\/p>\n<p>    schools to which the Act has no application.  In such circumstance, the <\/p>\n<p>    writ petition succeeds.  Appeal No. STN\/NGP\/147 of 1992 instituted <\/p>\n<p>    by respondent no.2 before Presiding Officer, School Tribunal, Nagpur, <\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                                               ::: Downloaded on &#8211; 09\/06\/2013 16:11:44 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_9\">                                         6<\/span><\/p>\n<p>    challenging   the   notice   of   termination   dated   04.06.1992   and <\/p>\n<p>    18.06.1992   and   18.06.1992   is   hereby   dismissed   for   want   of <\/p>\n<p>    jurisdiction.   Respondent no.2 may resort to such remedy as may be <\/p>\n<p>    advised in law.\n<\/p>\n<p id=\"p_8\">                  Rule made absolute in the above terms.
