Justice M.SASIDHARAN NAMBIAR\n\n Dated :29\/06\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n            CRL.M.C.No. 1924      OF 2009\n            ===========================\n\n       Dated this the 29th day of June,2009\n\n                        ORDER\n<\/pre>\n<p id=\"p_1\">    Petitioner   is   the  fourth   accused  in   Crime<\/p>\n<p>No103\/2009 of Mavoor Police Station    Prosecution case<\/p>\n<p>is that the accused committed offences under sections<\/p>\n<p>143,144,147,148,323,324, 506(ii), 308 read with <a href=\"\/doc\/999134\/\" id=\"a_1\">section<\/p>\n<p>149<\/a> of Indian Penal Code.  Under Annexure A order dated<\/p>\n<p>28.5.2009in Crl.M.C.708\/2009, learned Sessions Judge,<\/p>\n<p>Kozhikode  granted  bail  to  the  petitioner.    While<\/p>\n<p>granting bail, learned Sessions Judge on going through<\/p>\n<p>the Case Diary found that though an offence under<\/p>\n<p><a href=\"\/doc\/4266\/\" id=\"a_1\">section 308<\/a> of Indian Penal Code is also alleged  it is<\/p>\n<p>not attracted.  One of the conditions in granting  bail<\/p>\n<p>was that petitioner shall surrender his       passport.<\/p>\n<p>Petitioner  surrendered   his   passport  pursuant   to<\/p>\n<p>Annexure A order.     He thereafter filed Annexure B<\/p>\n<p>application  before  the  learned  Sessions  Judge,  to<\/p>\n<p>release the passport and to delete condition No.2 and 4<\/p>\n<p>contending that he is working  abroad and unless he is<\/p>\n<p>permitted to go abroad and for that purpose         the<\/p>\n<p>passport is released, he will loose his employment and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.1924\/2009              2<\/span><\/p>\n<p>if that be so he cannot maintain his family as he has no<\/p>\n<p>other source of income. Under Annexure C order, learned<\/p>\n<p>Sessions Judge dismissed the application stating that he<\/p>\n<p>cannot be allowed to go abroad by deleting    the conditions<\/p>\n<p>or releasing the passport,    as in that case  investigation<\/p>\n<p>and   the trial will be protracted.     This   petition   is<\/p>\n<p>filed under <a href=\"\/doc\/1679850\/\" id=\"a_2\">section 482<\/a> of Code of Criminal Procedure for<\/p>\n<p>deleting the said      conditions in the bail order and to<\/p>\n<p>release the passport.\n<\/p>\n<p id=\"p_1\">      2.    Learned counsel appearing for the petitioner and<\/p>\n<p>learned Public Prosecutor were heard.<\/p>\n<p id=\"p_2\">      3.    Learned counsel submitted that petitioner is the<\/p>\n<p>only breadwinner of the family and he has been working in<\/p>\n<p>Saudi Arabia for the last eight years and he was employed<\/p>\n<p>to do      menial jobs and he obtained a decent job only<\/p>\n<p>recently and unless he reports for the new employment<\/p>\n<p>before 1.6.2009 he will loose the employment and on his<\/p>\n<p>request the employer was pleased to extent the period till<\/p>\n<p>15.6.2009 and if he is not permitted to go abroad he will<\/p>\n<p>loose his means of livelihood and therefore the passport is<\/p>\n<p>to be released and he is to be permitted to go abroad.<\/p>\n<p id=\"p_3\">      4.   Learned  Public  Prosecutor  submitted  that  the<\/p>\n<p>investigation is not yet completed and if the petitioner is<\/p>\n<p>allowed to go abroad, he will not be available for trial<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.1924\/2009              3<\/span><\/p>\n<p>and in that case the case would be unnecessarily protracted<\/p>\n<p>and so petitioner may not be permitted to go abroad.<\/p>\n<p id=\"p_4\">      5.     When petitioner is working abroad for the last<\/p>\n<p>several years and he is not permitted to rejoin, he would<\/p>\n<p>loose his employment.       The question is whether for the<\/p>\n<p>reason that petitioner is involved in this case, he has to<\/p>\n<p>forego his means of      livelihood.   There is force in the<\/p>\n<p>submission of the learned Public Prosecutor that petitioner<\/p>\n<p>must be available for trial.      In view of the findings of<\/p>\n<p>learned Sessions Judge in Annexure A order, it is to be<\/p>\n<p>taken that an offence under <a href=\"\/doc\/4266\/\" id=\"a_3\">section 308<\/a> of Indian Penal<\/p>\n<p>Code will not lie.     If that be the case, if the petitioner<\/p>\n<p>is not disputing his identity at the time of trial even if<\/p>\n<p>petitioner is not present the trial could be proceeded<\/p>\n<p>with.     In such circumstance interest of justice warrants<\/p>\n<p>that petitioner is permitted to go abroad after releasing<\/p>\n<p>the passport. Annexure A order shows that petitioner was in<\/p>\n<p>custody and was sufficiently interrogated      by the Police<\/p>\n<p>for the purpose of investigation.\n<\/p>\n<p id=\"p_5\">      Petition is allowed.     Petitioner is permitted to go<\/p>\n<p>abroad for his employment and for that purpose     Magistrate<\/p>\n<p>is directed to release the passport to the petitioner on<\/p>\n<p>the following conditions.\n<\/p>\n<p id=\"p_6\">        1.
