Respondents\n\n\tHabeas corpus petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of\nIndia praying for a writ of habeas corpus calling for the records connected with\nthe detention order of the respondent No.2 in NSA Detention order No.01\/2008\ndated 25.7.2008 and quash the same and direct the respondents to produce the\nbody and person of the petitioner's son Mubarak, son of Mohamed Maideen aged\nabout 27 years detaining at Trichy Central Prison before this Court and set him\nat liberty forthwith.\n\n!For Petitioner\t\t... Mr.M.Daniel Manohar\n\t\t\t    Additional Public\n\t\t\t    Prosecutor for RR1, 2,\n\t\t\t\t4 and 5\n:ORDER\n<\/pre>\n<p id=\"p_1\">(Order of the Court was made by M.CHOCKALINGAM, J.)<br \/>\n\tChallenge is made to an order of detention made by the second respondent<br \/>\nunder the provisions of the <a href=\"\/doc\/190229\/\" id=\"a_1\">National Security Act<\/a>, dated 25.7.2008, pursuant to<br \/>\nwhich one M.Mubarak, the son of the petitioner Raziabegam was was detained.\n<\/p>\n<p id=\"p_1\">\t2.The Court perused the order under challenge along with the materials<br \/>\navailable and heard the learned Counsel for the petitioner and also the learned<br \/>\nAdditional Public Prosecutor on the contentions.\n<\/p>\n<p id=\"p_2\">\t3.Three grounds are raised challenging the order.  \t(a) Firstly, out of<br \/>\nsix adverse cases namely (1) Dindigul Town West PS Cr.No.244\/08 under Ss 147,<br \/>\n148, 294(b) and 506(ii) <a href=\"\/doc\/1569253\/\" id=\"a_2\">IPC<\/a>, (2) Dindigul Town North PS Cr.No.239\/08 under Ss<br \/>\n143, 341, 336 <a href=\"\/doc\/1569253\/\" id=\"a_3\">IPC<\/a> and 3(1) of TNPPDL Act; (3) Dindigul Town North PS<br \/>\nCr.No.479\/08 under Ss 147, 341, 336 <a href=\"\/doc\/1569253\/\" id=\"a_4\">IPC<\/a> and 3(1) of TNPPDL Act; (4) Dindigul<br \/>\nTown South PS Cr.No.346\/08 under Ss 147, 148, 341, 153(A), 153(B) <a href=\"\/doc\/1569253\/\" id=\"a_5\">IPC<\/a> r\/w 3(1)<br \/>\nTNPPDL Act; (5) Dindigul Town South PS Cr.No.347\/08 under Ss 147, 148, 341, 324,<br \/>\n307, 153(A), 153(B) <a href=\"\/doc\/1569253\/\" id=\"a_6\">IPC<\/a> r\/w 3(1) TNPPDL Act; and (6) Dindigul Town South PS<br \/>\nCr.No.348\/08 under Ss 147, 148, 341, 153(A), 153(b) <a href=\"\/doc\/1569253\/\" id=\"a_7\">IPC<\/a> r\/w 3(1) TNPPDL Act, and<br \/>\none ground case in Dindigul Town West Police Station Cr.No.382\/08 under Ss 147,<br \/>\n148, 341 <a href=\"\/doc\/1569253\/\" id=\"a_8\">IPC<\/a> and 3(1) of TNPPDL Act, 1984, he moved for bail in the ground case,<br \/>\nbut not in the adverse case Nos.3, 4, 5 and 6.  While the bail application was<br \/>\nnot filed, the detaining authority has pointed out in its order that there is a<br \/>\nreal possibility of the detenu coming out on bail.  The bail application in the<br \/>\nground case was actually dismissed on 23.7.2008.  The order under challenge came<br \/>\nto be passed on 25.7.2008, and thus without any material whatsoever, such an<br \/>\nobservation is made which impelled the authority to pass the order. Thus it<br \/>\nsuffers.\n<\/p>\n<p id=\"p_3\">\t(b) Secondly, as far as the extension of remand in all the said four<br \/>\nadverse cases is concerned, the copies of the documents relied on by the<br \/>\nauthority, were not served upon the detenu.  Hence, it would also affect the<br \/>\nimpugned order.\n<\/p>\n<p id=\"p_4\">\t(c) Thirdly, it has been specifically raised in the grounds that all those<br \/>\nmaterials were not placed before the Advisory Board within the stipulated period<br \/>\nof three weeks, and it is not replied in the course of the counter.  Hence it<br \/>\ncasts a doubt whether it would have been done as per the provisions of law.<br \/>\nUnder the circumstances, it has got to be set aside.\n<\/p>\n<p id=\"p_5\">\t4.The Court heard the Additional Public Prosecutor on all the above<br \/>\ncontentions and paid its anxious consideration on the submissions made.\n<\/p>\n<p id=\"p_6\">\t5.Pursuant to the recommendations made by the sponsoring authority that he<br \/>\nis involved in six adverse cases and one ground case as referred to above, the<br \/>\ndetaining authority has passed the order which is under challenge.  Firstly, as<br \/>\nrightly pointed out by the learned Counsel for the petitioner, it is an admitted<br \/>\nposition that only in the ground case, bail was asked for, and the same has also<br \/>\nbeen dismissed only on 23.7.2008.  As far as the adverse case Nos.3, 4, 5 and 6<br \/>\nare concerned, no application for bail was filed; but, the order came to be<br \/>\npassed on 25.7.2008, wherein it is observed that there was a real possibility of<br \/>\nthe detenu coming out on bail.  While the bail application filed in the ground<br \/>\ncase, was dismissed only on 23.7.2008 and in the four adverse cases as referred<br \/>\nto above, no application has even been filed, the said observation made by the<br \/>\ndetaining authority is nothing but prejudging the situation, and it cannot but<br \/>\nbe only an apprehension in the mind of the detaining authority.  Hence the order<br \/>\nsuffers.\n<\/p>\n<p id=\"p_7\">\t6.Secondly, as far as the said four adverse cases are concerned, the<br \/>\ndocuments relating to the order of remand, have not been supplied.  No answer<br \/>\nemanates from the State in order to deny that contention.\n<\/p>\n<p id=\"p_8\">\t7.Thirdly, a specific ground has been raised in the application that<br \/>\nwithin the stipulated time of three weeks, all materials were not placed before<br \/>\nthe Advisory Board; but, no reply is coming from the State even in the counter.<br \/>\nHence it is highly doubtful whether it would have been done as envisaged in law.<br \/>\nBut, it is a legal mandate.  Under the stated circumstances, this Court feels no<br \/>\nimpediment in setting aside the order.\n<\/p>\n<p id=\"p_9\">\t8.Accordingly, this habeas corpus petition is allowed setting aside the<br \/>\norder of the second respondent.
