The allegation against<br \/>\n\tthe petitioner was to the effect that he had induced the daughter of<br \/>\n\tthe complainant Babitaben, aged about 19 years with a view to marry<br \/>\n\ther.\n<\/p>\n<p id=\"p_4\">By<br \/>\n\tthe present application under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the Code of Criminal<br \/>\n\tProcedure, 1973, (&#8216;the Code&#8217;), the petitioner has prayed for<br \/>\n\tquashment of the aforesaid First Information Report.\n<\/p>\n<p id=\"p_5\">It<br \/>\n\tappears that, subsequently, the parties have amicably settled the<br \/>\n\tdispute between them, pursuant to which, the petitioner herein has<br \/>\n\tagreed that he would permit his wife to attend any religious and\/or<br \/>\n\tpersonal ceremony at Bihar in case any such occasion arises.  He has<br \/>\n\talso stated that he would look after his wife and in case of any<br \/>\n\tdisputes between them, inform her parents immediately.\n<\/p>\n<p id=\"p_6\">Mr.M.K.Patel,<br \/>\n\tlearned Advocate has tendered an undertaking dated 24th<br \/>\n\tJune, 2008 executed by the petitioner. The same is taken on record.<br \/>\n\tThe learned Advocate for the petitioner has submitted that in view<br \/>\n\tof the amicable settlement arrived at between the parties, the<br \/>\n\tpetitioner has executed an undertaking pursuant to which the<br \/>\n\trespondent-original complainant no longer desires to prosecute the<br \/>\n\tcomplaint.\n<\/p>\n<p id=\"p_7\">Mr.Sunil<br \/>\n\tMehta, learned Advocate for respondent No.2 has reiterated the<br \/>\n\tsubmissions advanced by the learned Advocate for the petitioner and<br \/>\n\thas submitted that in view of amicable settlement arrived at between<br \/>\n\tthe parties, more so in view of the undertaking given by the<br \/>\n\tpetitioner, the respondent No.2 does not desire to prosecute the<br \/>\n\tcomplaint against the petitioner any further. The complainant<br \/>\n\tPushpadevi Jagdishbhai Tiwari is also present before this Court and<br \/>\n\tshe has affirmed what is stated by the learned Advocate appearing on<br \/>\n\ther behalf. Both the learned Advocates for the parties have jointly<br \/>\n\tsubmitted that in view of the settlement arrived at between the<br \/>\n\tparties, the complaint in question be quashed in the interest of<br \/>\n\tjustice.\n<\/p>\n<p id=\"p_8\">It<br \/>\n\tis settled legal position as held by the Apex Court as well as this<br \/>\n\tCourt and other High Courts that in case where the parties have<br \/>\n\tsettled the disputes between them, more so in cases arising out of<br \/>\n\tmatrimonial disputes, it is permissible for this Court upon<br \/>\n\tconsideration of facts of each case to quash the complaint even<br \/>\n\toffences alleged are not compoundable in nature.\n<\/p>\n<p id=\"p_9\">In<br \/>\n\tthe facts of the present case, it is apparent that the parties have<br \/>\n\tsettled their disputes between them, pursuant to which the<br \/>\n\trespondent No.2 is no longer desires to prosecute the complaint.<br \/>\n\tEven otherwise, looking to the facts of the present case, the<br \/>\n\tdaughter of the complainant is 19 years of age. She appears to have<br \/>\n\tvoluntarily gone with the petitioner No.1, hence, no offence as<br \/>\n\talleged can be stated to have been made out against the petitioner.<br \/>\n\tIn the circumstances, this is a fit case for exercise of powers<br \/>\n\tunder <a href=\"\/doc\/1679850\/\" id=\"a_2\">Section 482<\/a> of the Code to prevent the abuse of the process of<br \/>\n\tCourt.\n<\/p>\n<p id=\"p_10\">\tFor the foregoing<br \/>\n\treasons, application succeeds and is accordingly allowed. The First<br \/>\n\tInformation Report registered vide Bhachau Police Station<br \/>\n\tI-C.R.No.43 of 2008 is hereby quashed.
