However, there was much delay in implementation of the<br \/>\n\tscheme though the members had handed over the possession well in<br \/>\n\ttime. Resultantly, there was price escalation and respondent<br \/>\n\tNo.1-Board demanded a total of Rs. 34,506\/- for handing over the<br \/>\n\tpossession of allotted premises. It is contended that such price<br \/>\n\tescalation was unauthorised, impermissible and arbitrary.\n<\/p>\n<p id=\"p_2\">On<br \/>\n\tbehalf of respondent No.1-Board, affidavit in reply has been filed<br \/>\n\tcontending inter-alia that members of the petitioner association<br \/>\n\twere encroaching on Government land. To solve the problem, they were<br \/>\n\tgiven preferential allotment of premises to be constructed by the<br \/>\n\tBoard. Some of the occupants had resisted eviction, resulting into<br \/>\n\tdelay in implementation of the scheme. Ultimately, upon completion<br \/>\n\tof the construction, premises were offered for Rs. 34,506\/- payable<br \/>\n\tin installment spread over 15 years and allotments were made by<br \/>\n\tdrawing lots. The allottees accepted the terms and accordingly after<br \/>\n\tentering into agreement allotments were made.\n<\/p>\n<p id=\"p_3\">It<br \/>\n\tmay be noted that though said affidavit was served to the petitioner<br \/>\n\tin the year 1996, so far no rejoinder has been filed.\n<\/p>\n<p id=\"p_4\">It<br \/>\n\tappears that initially Learned Single Judge of this Court granted<br \/>\n\tstay against further recovery from allottee. However, Division Bench<br \/>\n\tof this Court by an order dated 23.9.1997 passed in Letters Patent<br \/>\n\tAppeal No. 445\/1997 vacated the stay. Learned advocate for the<br \/>\n\tpetitioner stated that the members have thereupon paid the remaining<br \/>\n\tamount also.\n<\/p>\n<p id=\"p_5\">Short<br \/>\n\tquestion is whether the petitioner can resist respondent No.1-Board<br \/>\n\trecovering total amount of Rs. 34,506\/- for allotment of the<br \/>\n\tpremises.\n<\/p>\n<p id=\"p_6\">Learned<br \/>\n\tadvocate for the petitioner placed heavy reliance on the decision of<br \/>\n\t<a href=\"\/doc\/434494\/\" id=\"a_1\">Kanpur Development Authority v. Smt. Sheela Devi and others<\/a> etc.<br \/>\n\treported in AIR 2004 Supreme Court 400.\n<\/p>\n<p id=\"p_7\">On<br \/>\n\tthe other hand, learned advocate Shri Bambhania for respondent<br \/>\n\tNo.1-Board contended that it is a matter of contractual obligation<br \/>\n\tbetween the parties. The allottees had undertaken to abide by the<br \/>\n\tterms of allotment. They now cannot challenge such conditions.\n<\/p>\n<p id=\"p_8\">From<br \/>\n\tmaterial on record, it is clear that upon completion of the<br \/>\n\tconstruction of premises, the same was offered to the interested<br \/>\n\tperson for sale consideration of Rs. 34,506\/- Those who were<br \/>\n\tallotted the premises were handed over possession upon entering into<br \/>\n\tagreement. Sometimes thereafter, the present petition has been filed<br \/>\n\tquestioning price escalation.\n<\/p>\n<p id=\"p_9\">Quite<br \/>\n\tapart from impermissiblity of such a stand at this stage, even<br \/>\n\totherwise respondent No.1-Board has sufficiently explained reasons<br \/>\n\tfor price escalation. As noted it is stated that there was much<br \/>\n\tdelay in handing over possession by members of association<br \/>\n\tthemselves resulting into delay in implementation of the project.<br \/>\n\tThere is no denial to these averments in the affidavit in reply. I<br \/>\n\thave therefore, no reason to discard such contention. In any case<br \/>\n\tallottees not only applied for being considered for allotment, upon<br \/>\n\tdrawing of lots they were offered premises at above-mentioned rate.<br \/>\n\tThey entered into agreement with the Board and accepted the<br \/>\n\tallotment on terms as specified in the agreement. On all counts<br \/>\n\ttherefore, no case for interference is made out. In case of Kanpur<br \/>\n\tDevelopment Authority(supra),<br \/>\n\t Apex Court had noted that there was a clause limiting<br \/>\n\tescalating only upto 10% and further that there was unexplained<br \/>\n\tdelay on part of Development Authority in handing over the<br \/>\n\tpossession even after completion of the construction and further<br \/>\n\tthat price escalation was four and half times the initial price<br \/>\n\tindicated. In the present case, facts are substantially different.\n<\/p>\n<p id=\"p_10\">Under<br \/>\n\tthe circumstances, petition fails, is hereby dismissed.
