He also<br \/>\n\tsubmitted that the said appeals were filed against the judgment and<br \/>\n\taward dated 17.2.1983 passed in M.A.C.Petition Nos. 157 to 160 of<br \/>\n\t1981 and 11 to 13 of 1982. He has also submitted that all of the<br \/>\n\taforesaid appeals came to be dismissed by the judgment and order<br \/>\n\tdated 20.6.2007 passed by the High Court in the aforesaid appeals.<br \/>\n\tHe has relied upon the paras-6 and 7 of the said order, which reads<br \/>\n\tthus:-\n<\/p>\n<p id=\"p_2\">\t&#8220;6.\tIn<br \/>\n\tabsence of a plea, issue, argument, discussion and finding by the<br \/>\n\tlearned tribunal, it would not be proper on the part of this Court<br \/>\n\tto allow the Insurance Company to raise the issue of limited<br \/>\n\tliability for the first time before this Court.\n<\/p>\n<p id=\"p_3\">\t7.\tAll<br \/>\n\tthe appeals deserve to and are accordingly dismissed. Interim<br \/>\n\trelief, if any, is vacated. No costs.&#8221;\n<\/p>\n<p id=\"p_4\">2.\tHe has<br \/>\nsubmitted that after the aforesaid order was passed, the petitioners<br \/>\nhad moved application seeking permission to withdraw the deposited<br \/>\namount. He has also referred to the remark made by the learned<br \/>\nadvocate of the insurance company on the petitioners&#8217; application<br \/>\ndated 7.12.2010 seeking permission to withdraw the deposited amount.<br \/>\nMr. Amin submitted that the learned advocate for the insurance<br \/>\ncompany had, by the remark on the application (Exh.15), stipulated<br \/>\nand declared that the insurance company had no objection, if the<br \/>\npermission to withdraw the amount was granted. Mr. Amin has, made<br \/>\ngrievance that despite the final order passed by this Court in the<br \/>\naforesaid appeals and inspite of the fact that the learned advocate<br \/>\nfor the insurance company made a stipulation on the application, the<br \/>\nlearned Court passed order dated 24.1.2011, which contains below<br \/>\nmentioned directions:-\n<\/p>\n<p id=\"p_5\">&#8220;O<br \/>\nR D E R<\/p>\n<p id=\"p_6\">1.\tOut<br \/>\nof deposited amount by insurance company Rs.7,500\/- (Rupees Seven<br \/>\nThousand Five Hundred Only) be deducted and be paid to the Oriental<br \/>\nInsurance Co. by account payee cheque. Cheque be handed over to<br \/>\nauthorized person of the said insurance company on verification.\n<\/p>\n<p id=\"p_7\">2.\tOut<br \/>\nof the remaining amount the deficit Court fees, if any, shall be<br \/>\nrecovered from the award amount.\n<\/p>\n<p id=\"p_8\">3.\tFrom<br \/>\nrest of the deposited amount by the opponents 10% amount be given to<br \/>\nthe applicant by account payee cheque after proper verification and<br \/>\nidentification.\n<\/p>\n<p id=\"p_9\">4.\tBalance<br \/>\n90% amount be invested in a nationalized bank of the choice of the<br \/>\napplicant as Fixed Deposit for a period of 125 months. Applicant is<br \/>\nentitled to withdraw periodical interest on such FDR. Applicant is<br \/>\nnot entitle to create any charge or lien on such FDR except with the<br \/>\nprior permission of the Tribunal.&#8221;\n<\/p>\n<p id=\"p_10\">\tThe<br \/>\npetitioners are aggrieved by the said directions, more particularly<br \/>\nby the direction that balance 90% of the amount be invested for<br \/>\nfurther period of 125 months.\n<\/p>\n<p id=\"p_11\">3.\tMr.\n<\/p>\n<p id=\"p_12\">Amin has contended that after the original judgment and order dated<br \/>\n17.2.1983, more particularly after the order in the First Appeals,<br \/>\nthe learned Tribunal is rendered functus-officio and<br \/>\nany other directions could not be even passed by the learned<br \/>\nTribunal. He has also submitted that, in any case, the original<br \/>\njudgment and decree<br \/>\npassed in the claim petitions got merged in the order passed by the<br \/>\nHigh Court in the resultant appeals and when appeals have been<br \/>\ndismissed, there was no justification to pass the impugned order<br \/>\ndated 24.1.2011. Mr. Amin has requested that the petitioners may be<br \/>\npermitted to withdraw the deposited amount.\n<\/p>\n<p id=\"p_13\">4.\tMr. Meena,<br \/>\nlearned advocate for the insurance company, has submitted that he<br \/>\nneeds to find out as to whether any proceedings have been taken out<br \/>\nbefore the Hon&#8217;ble Supreme Court or not and as to whether any orders<br \/>\nhave been passed by the Hon&#8217;ble Supreme Court or not.\n<\/p>\n<p id=\"p_14\">5.\tSo<br \/>\nas to enable the learned advocate for the insurance company to get<br \/>\nnecessary information, S.O.\n<\/p>\n<p id=\"p_15\">to 3.5.2011<br \/>\nwith clarification that any further time will not be granted for the<br \/>\nsaid purpose.\n<\/p>\n<p id=\"p_16\">\t\t\t\t\t\t\t\t[K.M.Thaker,<br \/>\nJ.] <\/p>\n<p>kdc<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Rashmikant vs M\/S on 25 April, 2011 Author: K.M.Thaker,&amp;Nbsp;
