No.35514 of 2010\n                                    BUTAN MANDAL\n                                          Versus\n                                   STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p id=\"p_1\">2   18.11.2010              Heard learned counsel for the petitioner as well<\/p>\n<p>                 as learned counsel for the state.\n<\/p>\n<p id=\"p_1\">                            Allegedly, the petitioner and other FIR named<\/p>\n<p>                 accused persons put Gamchha around the neck of one,<\/p>\n<p>                 Kailu Mandal and pulled the said Gamchha with intention to<\/p>\n<p>                 kill him. Furthermore, it is alleged that petitioner made firing<\/p>\n<p>                 in air.\n<\/p>\n<p id=\"p_2\">                            Learned counsel for the petitioner submits that<\/p>\n<p>                 the instant case has been lodged on account of land dispute<\/p>\n<p>                 and as a matter of fact, no such occurrence as alleged in the<\/p>\n<p>                 FIR did ever take place. He further submits that no doubt,<\/p>\n<p>                 the injured sustained grievous injury on his neck but as a<\/p>\n<p>                 matter of fact , the aforesaid injury report is manufactured<\/p>\n<p>                 and engineered by the doctor concerned. In this connection,<\/p>\n<p>                 he drew my attention towards this fact that the injured<\/p>\n<p>                 examined on 27.7.2008 but the injury report was written on<\/p>\n<p>                 02.08.2008. Perusal of injury report (Annexure-2) reveals<\/p>\n<p>                 that injured Kailu Mandal has received multiple bruise and<\/p>\n<p>                 swelling   (3&#8243; x 3&#8243;)   over the ant part of the neck due to<\/p>\n<p>                 throttling of the neck leading to dysponoea (difficulty in<\/p>\n<p>                 breathing). The doctor has opined that the above said injury<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>        is grievous in nature but I am unable to understand as to<\/p>\n<p>        how   the   aforesaid     doctor   came   to    the    above-said<\/p>\n<p>        conclusion. Admittedly, the aforesaid doctor is Medical<\/p>\n<p>        Officer of Primary Health Centre, Bhargama but he did not<\/p>\n<p>        take pain to refer the aforesaid patient for better treatment.<\/p>\n<p id=\"p_3\">                    Considering      the    aforesaid         facts   and<\/p>\n<p>        circumstances, this anticipatory bail petition is allowed. In<\/p>\n<p>        the event of arrest\/surrender within 30 days from receipt of<\/p>\n<p>        the order, the petitioner, Butan Mandal shall be released on<\/p>\n<p>        bail on furnishing bail bond of Rs 10,000\/- (ten thousand)<\/p>\n<p>        with two sureties of the like amount each in connection with<\/p>\n<p>        Bhargama P.S.
