BAHADURPUR, DISTT.- PATNA.\n                                     Versus\n                             THE STATE OF BIHAR\n                                    -----------\n<\/pre>\n<p id=\"p_1\">2.   14.01.2011                Heard Mr. Ashok Kumar, learned counsel for the<\/p>\n<p>                  petitioner and Mr. Ajay Kumar Jha, learned Addl. P.P. for<\/p>\n<p>                  the State.\n<\/p>\n<p id=\"p_1\">                               The petitioner, who is in custody in Bahadurpur<\/p>\n<p>                  P.S. Case no. 61 of 2010 for the offence under <a href=\"\/doc\/619940\/\" id=\"a_1\">Sections<\/p>\n<p>                  363<\/a>, <a href=\"\/doc\/1559723\/\" id=\"a_1\">366A<\/a> of the Indian Penal Code, has prayed for grant<\/p>\n<p>                  of bail.\n<\/p>\n<p id=\"p_2\">                               It was alleged by the informant that his daughter<\/p>\n<p>                  was abducted by the petitioner for purposes of marriage.<\/p>\n<p>                  On that accusation First Information Report was lodged on<\/p>\n<p>                  27.6.2010. Subsequently the victim girl herself appeared<\/p>\n<p>                  before the police and thereafter her statement          under<\/p>\n<p>                  <a href=\"\/doc\/497457\/\" id=\"a_2\">Section 164<\/a> of the Code of Criminal Procedure was got<\/p>\n<p>                  recorded before the learned Magistrate wherein she<\/p>\n<p>                  disclosed that voluntarily she had gone along with the<\/p>\n<p>                  petitioner and she had also solemnized marriage. She<\/p>\n<p>                  along with the petitioner after marriage had gone to Delhi<\/p>\n<p>                  and after coming to know regarding the institution of the<\/p>\n<p>                  case she returned back and appeared before the police.<\/p>\n<p>                  Before the Magistrate she has disclosed his age as eighteen<\/p>\n<p>                  and half years. However, in the First Information Report<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          2<\/span><\/p>\n<p>       the informant has alleged that she is only 15 years old.<\/p>\n<p id=\"p_3\">                 Be that as it may, keeping in view the statement<\/p>\n<p>       under <a href=\"\/doc\/497457\/\" id=\"a_3\">Section 164<\/a> of the Cr.P.C. of the victim wherein she<\/p>\n<p>       had categorically stated that she had gone along with the<\/p>\n<p>       petitioner on her own volition, there is no reason to further<\/p>\n<p>       detain the petitioner. Let the above named petitioner be<\/p>\n<p>       enlarged on bail on furnishing bail bond of Rs.10,000\/-<\/p>\n<p>       (ten thousand) with two sureties of like amount each to the<\/p>\n<p>       satisfaction of S.D.J.M. Patna City in connection with<\/p>\n<p>       Bahadurpur P.S.
