Justice ANTONY DOMINIC\n\n Dated :23\/05\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                      ================\n             W.P.(C) NOs. 11567 &amp; 12437 OF 2009\n             =========================\n\n             Dated this the 23rd day of May, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      In these writ petitions, the grievances raised being common,<\/p>\n<p>the cases are heard and disposed of by this common judgment.<\/p>\n<p id=\"p_1\">      2.   In so far as WP(C) No.11567\/09 is concerned, the<\/p>\n<p>petitioner is Water Front Enclave Residents Association. They<\/p>\n<p>were aggrieved by the electric posts that were installed by the<\/p>\n<p>respondent Board at a busy junction known as the Chilavannoor<\/p>\n<p>Water Front Road Junction.         They have been requesting the<\/p>\n<p>authorities to shift the electric posts. According to the petitioners,<\/p>\n<p>not only that their complaints are ignored, but the respondents<\/p>\n<p>were proposing to install a transformer in the objectionable<\/p>\n<p>location. It was at that stage after filing Ext.P2 complaint, the writ<\/p>\n<p>petition was filed.\n<\/p>\n<p id=\"p_2\">      3.   In so far as WP(C) No.12437\/09 is concerned, the<\/p>\n<p>petitioners are residents of the aforesaid area. Their grievance is<\/p>\n<p>against Ext.P3, an order passed by the Additional District<\/p>\n<p>Magistrate exercising his powers under the <a href=\"\/doc\/357830\/\" id=\"a_1\">Indian Telegraph Act<\/a><\/p>\n<p>and ordering that the transformer be installed at the place<\/p>\n<p>WPC 11567 &amp; 12437 \/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 :2 :<\/span><\/p>\n<p>objected to by the petitioner in WP(C) NO.11567\/09,         as the<\/p>\n<p>location is in close proximity to the residential houses of the<\/p>\n<p>petitioners. From Ext.P3 in WP(C) NO.12437\/09, it would appear<\/p>\n<p>that when steps were initiated for the installation of the<\/p>\n<p>transformer at a particular location, that was objected to,<\/p>\n<p>necessitating   proceedings      before  the   Additional   District<\/p>\n<p>Magistrate resulting in Ext.P3. By Ext.P3, it has been ordered that<\/p>\n<p>the transformer be installed at the location objected by the<\/p>\n<p>petitioners herein.\n<\/p>\n<p id=\"p_3\">      4.   The admitted factual position is that while passing such<\/p>\n<p>an order, the petitioners in these writ petitions who are affected<\/p>\n<p>by such order were not put on notice nor were they heard. In my<\/p>\n<p>view, when an order in the nature of Ext.P3 referred to above is<\/p>\n<p>passed, it is only appropriate that the Additional District<\/p>\n<p>Magistrate shall hear all the affected parties.<\/p>\n<p id=\"p_4\">      5.   Therefore, I set aside Ext.P3 in WP(C) NO.12437\/09<\/p>\n<p>and direct that the Additional District Magistrate shall reconsider<\/p>\n<p>the request made by the Assistant Executive Engineer, KSEB,<\/p>\n<p>Ernakulam and pass orders thereon with notice to the petitioners<\/p>\n<p>in these cases or anybody else, who is likely to be affected by<\/p>\n<p>WPC 11567 &amp; 12437 \/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                :3 :<\/span><\/p>\n<p>such order.\n<\/p>\n<p id=\"p_5\">     6.
