Justice K.T.SANKARAN\n\n Dated :31\/03\/2010\n\n O R D E R\n                           K.T.SANKARAN, J.\n              ------------------------------------------------------\n                        B.A. NO. 1222 OF 2010\n              ------------------------------------------------------\n              Dated this the 31st day of March, 2010\n\n                                 O R D E R\n<\/pre>\n<p id=\"p_1\">       When the Bail Application came up for hearing on 19.3.2010,<\/p>\n<p>the following order was passed:\n<\/p>\n<p id=\"p_1\">\n<blockquote id=\"blockquote_1\"><p>              &#8220;This is an application for anticipatory bail under<\/p>\n<p>       <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the Code of Criminal Procedure. The<\/p>\n<p>       petitioners are the accused in Crime No.85 of 2010 of<\/p>\n<p>       Sreekandapuram Police Station, Kannur District.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>              2. The offences alleged against the petitioners<\/p>\n<p>       are under <a href=\"\/doc\/661069\/\" id=\"a_1\">Sections 341<\/a>, <a href=\"\/doc\/770961\/\" id=\"a_2\">323<\/a>, <a href=\"\/doc\/1264755\/\" id=\"a_3\">326<\/a> and <a href=\"\/doc\/1326470\/\" id=\"a_4\">427<\/a> read with<\/p>\n<p>       <a href=\"\/doc\/37788\/\" id=\"a_5\">Section 34<\/a> of the Indian Penal Code.<\/p><\/blockquote>\n<p id=\"p_2\">\n<p id=\"p_3\">              3.     The statement made by the de facto<\/p>\n<p>       complainant in the First Information Statement is the<\/p>\n<p>       following: On 9.2.2010 at about 8.30 PM, the de facto<\/p>\n<p>       complainant closed his shop and went home. After he<\/p>\n<p>       reached his house, at about 9.45 PM, Saju (accused<\/p>\n<p>       No.1) called him over phone and stated that there was<\/p>\n<p>       some problem near the shop of the de facto<\/p>\n<p>       complainant. The de facto complainant was requested<\/p>\n<p>       to reach the place immediately. Believing the words of<\/p>\n<p>       the first accused, the de facto complainant rushed to the<\/p>\n<p>       place in his Mahindra Pick up autorickshaw. When the<\/p>\n<p>B.A. NO. 1222 OF 2010<\/p>\n<p>                                   :: 2 ::\n<\/p>\n<p id=\"p_4\">      de facto complainant reached near his shop, at 9.55<\/p>\n<p>      PM, the accused persons intercepted the vehicle.<\/p>\n<p>      Accused No.2, Renjit, removed the key of the<\/p>\n<p>      autorickshaw. Later, the accused persons pulled the de<\/p>\n<p>      facto complainant out of the vehicle and he was<\/p>\n<p>      manhandled. He was beaten with an iron rod and also<\/p>\n<p>      with hands. It is also alleged that the accused persons<\/p>\n<p>      destroyed the windshield glass of the autorickshaw.<\/p>\n<p>      The de facto complainant was admitted in the hospital.<\/p>\n<p>      The wound certificate shows that the de facto<\/p>\n<p>      complainant had sustained dislocation of his right<\/p>\n<p>      shoulder and fracture of neck of IV metacarpal.<\/p>\n<p id=\"p_5\">            4.    The learned counsel for the petitioners<\/p>\n<p>      submitted that no motive is alleged for the offence. It is<\/p>\n<p>      submitted that even though motive is not necessary for<\/p>\n<p>      the proof of offence, in the peculiar facts and<\/p>\n<p>      circumstances of the case, one would expect as to why<\/p>\n<p>      the de facto complainant was called by the accused to<\/p>\n<p>      go over to the place of occurrence. The learned counsel<\/p>\n<p>      for the petitioners submitted that an altercation took<\/p>\n<p>      place at the place of occurrence when the de facto<\/p>\n<p>      complainant, in a drunken stage, abused the accused<\/p>\n<p>      persons. But there was no attack or manhandling as<\/p>\n<p>      alleged by the accused and he had sustained injuries<\/p>\n<p>      not due to any overt acts committed by the accused.<\/p>\n<p>B.A. NO. 1222 OF 2010<\/p>\n<p>                                    :: 3 ::\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">             5. Heard the learned Public Prosecutor. I have<\/p>\n<p>      also perused the case diary.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">             6.     Taking   into   account  the    facts   and<\/p>\n<p>      circumstances of the case, I am of the view that before<\/p>\n<p>      disposing of the Bail Application, an opportunity should<\/p>\n<p>      be given to the petitioners to appear before the<\/p>\n<p>      investigating officer.   Accordingly, there will be a<\/p>\n<p>      direction to the petitioners to appear before the<br \/>\n      investigating officer at 9 AM on 24th and 25th March,<\/p>\n<p>      2010. The petitioners shall produce a copy of the order<\/p>\n<p>      before the investigating officer.\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">             7. Post on 31st March, 2010.\n<\/p>\n<p id=\"p_12\">             It is submitted by the learned Public Prosecutor<\/p>\n<p>      that the petitioners will not be arrested until further<\/p>\n<p>      orders in connection with Crime No.85        of 2010 of<\/p>\n<p>      Sreekandapuram Police Station, Kannur District.&#8221;<\/p>\n<p id=\"p_13\">      2. It is submitted by the learned counsel for the petitioners as<\/p>\n<p>well as the learned Public Prosecutor that the direction in the order<\/p>\n<p>dated 19.3.2010 has been complied with by the petitioners.<\/p>\n<p id=\"p_14\">      3. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and also taking note of the fact that<\/p>\n<p>B.A. NO. 1222 OF 2010<\/p>\n<p>                                     :: 4 ::\n<\/p>\n<p id=\"p_15\">the direction in the order dated 19.3.2010 has been complied with<\/p>\n<p>by the petitioners, I am of the view that anticipatory bail can be<\/p>\n<p>granted to the petitioners. There will be a direction that in the event<\/p>\n<p>of the arrest of the petitioners, the officer in charge of the police<\/p>\n<p>station shall release them on bail on their executing bond for<\/p>\n<p>Rs.15,000\/- each with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<p id=\"p_16\">\n<blockquote id=\"blockquote_2\"><p>      a)     The petitioners shall report before the investigating<br \/>\n             officer between 9 A.M.        and 11 A.M. on alternate<br \/>\n             Mondays, till the final report is filed or until further<br \/>\n             orders;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>      b)     The petitioners shall appear before the investigating<br \/>\n             officer for interrogation as and when required;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_4\"><p>      c)     The petitioners shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_5\"><p>      d)     The petitioners shall not commit any offence or indulge<br \/>\n             in any prejudicial activity while on bail;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_6\"><p>      e)     In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p id=\"p_17\">\n<p id=\"p_18\">                                                   (K.T.SANKARAN)<br \/>\n                                                           Judge<br \/>\nahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Saju vs State Of Kerala on 31 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 1222 of 2010() 1.
