No.11999 of 2011\n                             JAGDHARI PRASAD\n                                      Versus\n                            THE STATE OF BIHAR\n                                    -----------\n<\/pre>\n<p>2   18.04.2011                Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The petitioner being a teacher is apprehending<\/p>\n<p>                 his arrest in a case registered under Sections 420, 467,<\/p>\n<p>                 468, 471, 120(B) of the Indian Penal Code.<\/p>\n<p>                              The accusation is of the appointment of one<\/p>\n<p>                 Nawal Kishore Prasad as Assistant Teacher in 1997<\/p>\n<p>                 against      a   non   sanction    post.   Subsequently,      the<\/p>\n<p>                 appointment was found forged.\n<\/p>\n<p>                              It is submitted by the learned counsel for the<\/p>\n<p>                 petitioner that the petitioner was not named in the F.I.R.<\/p>\n<p>                 and his name transpired on the confession of co-accused<\/p>\n<p>                 who suggested that it was the petitioner who received the<\/p>\n<p>                 money on behalf of the teacher which was illegally<\/p>\n<p>                 appointed. It is further submitted that still the investigation is<\/p>\n<p>                 pending and warrant of arrest has been issued in the year<\/p>\n<p>                 2010.\n<\/p>\n<p>                              Considering    the   aforesaid    facts   that   still<\/p>\n<p>                 investigation is pending and the accused was not named in<\/p>\n<p>                 the F.I.R., let the petitioner namely, Jagdhari Prasad, in the<\/p>\n<p>                 event of his arrest or surrender before the Court below<\/p>\n<p>                 within a period of 12 weeks from today, be released on<br \/>\n<span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>          anticipatory bail on furnishing bail bond of Rs. 10,000\/- (ten<\/p>\n<p>          thousand) with two sureties of the like amount each to the<\/p>\n<p>          satisfaction of Chief Judicial Magistrate, Jehanabad in<\/p>\n<p>          connection with Karpi P.S.
