conduct  se.c’tioii of the Probation of Offenders<\/p>\n

the Filature~’fa’ctory of ohe Aslam, accused Nos. 1 and 2<\/p>\n

asfsaulte.dl:o:nll:the forehead of PW2 with \ufb01re wood and<\/p>\n
  ‘-\u00bb.caused..grieVous injuries to him.<\/p>\n
it  As already stated Accused No.2 had not filed<\/p>\n
  .l many appeal against conviction for an offence punishable<\/p>\n
under section 355<\/a> of IPC. Therefore, the points that<\/p>\n
arises for determination are as follows:<\/p>\n
(i) Whether the prosecution has proved’

7. l’  orderftofibringt”home the guilt of the accused,<\/p>\n
prosecution.’ ha_s”exatnined PWs- 1 to 9, got marked<\/p>\n
it  f\u00a7’?._and material objects as per MO. 1.<\/p>\n
  and 3 are stated to have witnessed the<\/p>\n
oceizlrrence;:”” They have supported the case of<\/p>\n
prosecution during the examination– in– chief and<\/p>\n
 lsuppflorted the defence during the course of cross-<\/p>\n
VV Wexaxnination. Therefore, their evidence is not of any help to<\/p>\n

prosecution. The learned Trial Judge has directed to<\/p>\n
proceed against PW1 and PW3 for offences punishable<\/p>\n
under sections 191<\/a> and 193<\/a> IPC. ‘Fherefore_,;'”We–i’are_V”lcft\u00ab _<\/p>\n
with evidence of injured\/ PW2–Mahade_\\ffa1ah:: \u00ab. <\/p>\n

9. PW2 has deposed that on theldate oft   ;<\/p>\n
he was working in the Fi1ature\u00ab.:Factor$f’of orie l\u00e9kslam in
\nRamanagariown. Accused21.i’s._’the~tr1other–ir1-law of
\nPW2. v1z., she is the Aimotherfb of wife of PW2.<\/p>\n
Accused No.2′:  elder ubrojther’ oi”second wife of PW2<\/p>\n
by   (;A1′.”_iVV”1′.lVl.2001, Accused No.2
\ncame tothe  where PW2 was working<\/p>\n
and Vq_uestion_ed~_ti*1e’*.PW2 why he had assaulted his<\/p>\n
 ‘-secoridi.._wiieJayarri’ala. PW2 pacified her and sent her<\/p>\n
he  No.1 and 2 came there and<\/p>\n
AcAcu:sed.-Notsllllpicked up \ufb01re Wood and assaulted on the<\/p>\n
.”*”\u00ab.__f”back and forehead of PW2. He was taken to General<\/p>\n
A   at Ramanagar. He lodged the first information<\/p>\n
   “at; about 6.30 P.M. on the same day. <\/p>\n
examined on 25.8.2003 have deposed that, Accused<\/p>\n
No.1 had assaulted PW2 with \ufb01re wood piece. <\/p>\n
factory of Aslam. However, at the ir1stance_j’of\u00ab’ H<\/p>\n
cousnel for the defence, their cross- examination\u00ab.wa_s 2 0′<\/p>\n
deferred. During their cro=ss–.~\u00bb eexarninationf-a..,__ <\/p>\n
10.10.2003, these witnessesuhaxre-,.  <\/p>\n
deposing that they had not  ocvveurrence
\nand Accused No.1 ass\u00abauitiug
\nll. PW4.=Dr.Th.a1’1au’VahV ” d\u00e9tvosed that on<\/p>\n
1.1.2001 at   Mahadevajah<\/p>\n
in   and found following
\ninjurieisz.   0 if  if   H
\n (1) l,a’ce_rat.e.d  over the right parietal region
\n  size  X 2 inch, skin deep bleeding

\n bleeding from the right ear.\n<\/p>\n
P’Af4 has opined that injury No.1 was grievous in<\/p>\n
 _ 0′ natiire and injury No.2 was simple in nature.<\/p>\n

12. The first information relating to occurrence
\nwas lodged by PW2 at 3.00 p.m. on 1.1.2001. There was<\/p>\n
no delay in lodging the first information. Th,eri3-foife,<\/p>\n
notwithstanding the hostility shown by   _<\/p>\n
and the evidence of PW2 [injured] and  ‘*<\/p>\n
of PW4 would amply prove that’-._the_y”Accuisecil <\/p>\n
assaulted PW 1. with a fire    to <\/p>\n
him. A\n<\/p>\n
13. The next  “fo1f{.,lrie’te3frn’iri.ation is as to<\/p>\n
whether the injury 1\\l’o}i” ‘   PW2 was a<\/p>\n
grievous  under” section 320<\/a> of IPC. As
\ncould sl’een\u00abfrom:  of PW4, injuries suffered<\/p>\n
by PW2 dolizot iritolthe definition of grievous injury<\/p>\n
  se.etion  Therefore, I hold that Accused<\/p>\n
  caused hurt to PW2 by hitting on<\/p>\n
his’-…foreh~eadAlwith \ufb01re wood piece and committed an<\/p>\n
 “‘oxffegr1ce’vptL1nishable under section 324<\/a> of IPC.<\/p>\n
   $514. The next point for determination would be as<\/p>\n
A    whether the Accused No.1 could be extended bene\ufb01t<\/p>\n

\nAct, which in fact, has been extended to the
\nNo.2 by the Trial Court.\n<\/p>\n

PW2 is the native of  Kolie\u00a7gal.a\u00ab.a13.;d~<\/p>\n
has been residing with  .”F”ashpa”,   his’<\/p>\n
children in Ramanagar  \\iVhe1’i”;he was
\nworking in the fiiature Srinivasa, he
\ndeveloped    No.1, by
\nname   siitekvas about 16 or 17
\nyears.:V’iPW’2′  thatllv\ufb01ccused No.1 had warned
\nPW2 alndlslaid it-Eovvever, they continued their<\/p>\n
affair. _ h_ad.adrriitted that he eioped said J ayamala<\/p>\n
Ramanagarlyytollvthe house of his paternai junior<\/p>\n
 uncle”  They stayed their for a period of two<\/p>\n
mon_ths.ther*eai’ter, they returned to Ramanagar by then,<\/p>\n
 Jayalnala was carrying two months pregnancy.<\/p>\n
  Tfiere was frequent quarrels between accused no.1 and<\/p>\n
 …PW2 and also between Accused No. 1 and Jayamala.<\/p>\n

Wife and he was not prepared to take her to his house.<\/p>\n
Therefore, the said Jayamaia was in doldrums. <\/p>\n
17. It is clear from the evidence  2 <\/p>\n
had deceived the said Jayamala.T__ <\/p>\n
very much annoyed with the-.___deceptive acts’  <\/p>\n
by PW2. PW2 had s1apped’V}}ayamaia{‘  i\ufb01she had
\nmet him and reques’ted’*    as his wife.
\nThis was the iInmed}’at–eh.fno’tive’ No.1 to
\nassault Ha   No.1 had not
\ncarried ‘  had assaulted PW2
\nwith  __ was lying in the factory
\npremisesA.”~-min   I am of the opinion<\/p>\n
thatjinstead o’f~i.n1posing sentence of imprisonment, it<\/p>\n
  apiii’ieo_priate to invoke the provision of Section<\/p>\n
