Mankad has<br \/>\ninstructions to appear for the respondent. Mr.Mankad has filed leave<br \/>\nnote.  Heard Mr.Jairaj Chauhan for the petitioner.\n<\/p>\n<p id=\"p_1\">Pursuant<br \/>\nto order dated 14th October 2011, Deputy Municipal<br \/>\nCommissioner, Gandhinagar, Mr.N.S. Jadhav, is present in the Court.<br \/>\nAttention of the officer is drawn to his reply dated 15th<br \/>\nJuly 2011.  The officer present states that he will look into the<br \/>\nmatter more closely and will reply to the representation of the<br \/>\npetitioner afresh. This is required to be done because the text of<br \/>\nthe communication dated 15th July 2011 gives an impression<br \/>\nthat the provisions of the <a href=\"\/doc\/142278\/\" id=\"a_1\">Minimum Wages Act<\/a> and the Gujarat Minimum<br \/>\nWages Rules, 1961 became applicable to 80 Part-Time Safai Kamdars of<br \/>\nGandhinagar Notified Area (at present Gandhinagar Municipal<br \/>\nCorporation) for the first time when Urban Development &amp; Urban<br \/>\nHousing Department passed Resolution No.EST\/ 132008\/ CFA-72\/ R  dated<br \/>\n20.08.2008.  Prima facie, this Court is of the opinion that the reply<br \/>\ndoes not deal with the question involved in the matter as required<br \/>\nunder the law.  On pointing out this fact the officer volunteers that<br \/>\nhe will give the reply afresh to the representation of the<br \/>\npetitioner. Presence of the officer is dispensed with for the<br \/>\npresent.\n<\/p>\n<p id=\"p_2\">2.\tIn<br \/>\nabsence of the Government, it may not be possible to get the dispute<br \/>\ninvolved in the matter adjudicated. At this juncture, the learned<br \/>\nadvocate for the petitioner seeks permission to implead the State<br \/>\nGovernment as a party to be served through Finance Department;  and<br \/>\nUrban Development &amp; Urban Housing Department. Amendment be<br \/>\ncarried out during the course of the day.\n<\/p>\n<p id=\"p_3\">3.\t NOTICE<br \/>\nto the newly added respondents returnable on 15th November<br \/>\n2011.
