Secretary, Health &amp; Others\nPetitioner Counsel :- Praveen Tripathi,Som Nath\nRespondent Counsel :- G.A.\n\nHon'ble Raj Mani Chauhan,J.\n<\/pre>\n<p id=\"p_1\">Hon&#8217;ble Virendra Kumar Dixit,J.\n<\/p>\n<p id=\"p_1\">Heard learned counsel for the petitioner, learned A.G.A. and<br \/>\nperused the record.\n<\/p>\n<p id=\"p_2\">This writ petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India has<br \/>\nbeen filed by the petitioner for quashing the impugned F.I.R.<br \/>\nregistered at Police Station Alambagh District Lucknow in case<br \/>\nCrime No.181 of 2010 under <a href=\"\/doc\/471092\/\" id=\"a_1\">Sections 272<\/a>, <a href=\"\/doc\/285163\/\" id=\"a_2\">273<\/a> I.P.C. read with<br \/>\nSection 23 (Kha) of Khadya Upmishran Adhiniyam, 1954 and<br \/>\nalso for direction to the opposite parties not to arrest the<br \/>\npetitioner in pursuance of the said impugned F.I.R.<br \/>\nThe submission of the learned counsel for the petitioner is that<br \/>\nthe petitioner Awdhesh Kumar Agnihotri is the Manager of<br \/>\nM\/s.Shyam Traders, situated in premises C-7, Talkatora,<br \/>\nIndustrial Area, Police Station Alambagh, Lucknow, which<br \/>\nmanufactures Gutka\/Pan Pasala under the licence granted by the<br \/>\nappropriate authority. The Flying Squad of food departments in<br \/>\nthe presence of Smt.Sunita Singh, Deputy Superintendent of<br \/>\nPolice inspected the premises of the petitioner and collected the<br \/>\nsample of Gutka observing the requisite formalities. The samples<br \/>\nwere sent to the public analyst for its analysis, which after<br \/>\nanalysis were found containing &#8220;Gambier&#8221;. The sample were<br \/>\naccordingly reported to be adulterated.\n<\/p>\n<p id=\"p_3\">The learned counsel for the petitioner submits that on the basis<br \/>\nof public analyst report, the Food Inspector had filed three<br \/>\nseparate complaints under <a href=\"\/doc\/32969400\/\" id=\"a_3\">Prevention of Food Adulteration Act<\/a> in<br \/>\nthe court of Magistrate concerned against the petitioner, which<br \/>\n are still pending. The complainant thereafter lodged the<br \/>\nimpugned F.I.R. under <a href=\"\/doc\/471092\/\" id=\"a_4\">Sections 272<\/a>\/<a href=\"\/doc\/285163\/\" id=\"a_5\">273<\/a> I.P.C. at Police Station<br \/>\nAlambagh, Lucknow. Learned counsel submits that on the same<br \/>\nfacts three complaints were already pending against the<br \/>\naccused-petitioner therefore, the impugned first information<br \/>\nreport could not be lodged by the complainant on the same facts<br \/>\nunder <a href=\"\/doc\/471092\/\" id=\"a_6\">Section 272<\/a> I.P.C. against the petitioner.<br \/>\nLearned counsel submits that the accused in view of provision<br \/>\nunder <a href=\"\/doc\/17858\/\" id=\"a_7\">Article 20 (2)<\/a> of the Constitution of India cannot be<br \/>\nprosecuted and punished for the same offence more than once.<br \/>\nIn this case the accused is going to be prosecuted for the fourth<br \/>\ntime, which is hit by <a href=\"\/doc\/17858\/\" id=\"a_8\">Article 20 (2)<\/a> of the Constitution of India. The<br \/>\nfurther submission of the learned counsel is that the provision<br \/>\nunder <a href=\"\/doc\/471092\/\" id=\"a_9\">Section 272<\/a> I.P.C. is attracted only when the adulterated<br \/>\nmaterial is found to be noxious. In this case, the public analyst&#8217;s<br \/>\nreport does not show that the sample was found to be noxious.<br \/>\nTherefore, no offence under <a href=\"\/doc\/471092\/\" id=\"a_10\">Section 272<\/a> I.P.C. is made out<br \/>\nagainst the petitioner-accused. The F.I.R. lodged by the<br \/>\ncomplainant is, therefore, liable to be quashed.<br \/>\nLearned A.G.A. opposed the petition and argued that in this case<br \/>\nprinciple of double jeopardy as provided under <a href=\"\/doc\/17858\/\" id=\"a_11\">Article 20 (2)<\/a> of<br \/>\nthe Constitution of India is not attracted. The protection under<br \/>\n<a href=\"\/doc\/17858\/\" id=\"a_12\">Article 20 (2)<\/a> of Constitution of India will be available only when<br \/>\nthere had been prosecution and punishment both. The provision<br \/>\nunder <a href=\"\/doc\/17858\/\" id=\"a_13\">Article 20 (2)<\/a> of the Constitution of India is that no person<br \/>\nshall be prosecuted and punished for the same offence more<br \/>\nthan once. The word prosecuted and punished shall be read<br \/>\ntogether not separately otherwise the word would have been<br \/>\nused as prosecuted or punished. In this case the petitioner can<br \/>\nnot avail protection under <a href=\"\/doc\/17858\/\" id=\"a_14\">Article 20 (2)<\/a> of the Constitution of<br \/>\nIndia as he is not going to be punished twice for the same<br \/>\noffence. At this stage the F.I.R. lodged against the petitioner is<br \/>\nunder investigation. The petitioner can seek the protection of<br \/>\n <a href=\"\/doc\/17858\/\" id=\"a_15\">Article 20 (2)<\/a> of Constitution of India if he is going to be<br \/>\nprosecuted and punished twice for the same offence which is not<br \/>\nbeing done. The learned A.G.A. further submits that prevention of<br \/>\n<a href=\"\/doc\/32969400\/\" id=\"a_16\">Food Adulteration Act<\/a> is a <a href=\"\/doc\/701797\/\" id=\"a_17\">Special Act<\/a>. If any person is guilty of<br \/>\nany offence under prevention of <a href=\"\/doc\/32969400\/\" id=\"a_18\">Food Adulteration Act<\/a>, he may<br \/>\nbe prosecuted accordingly irrespective of the fact that the same<br \/>\nact of accused is also offence under the provision<a href=\"\/doc\/1569253\/\" id=\"a_19\"> of Indian Penal<br \/>\nCode<\/a>. Unless such offence is deleted from<a href=\"\/doc\/1569253\/\" id=\"a_20\"> the Indian Penal Code<\/a><br \/>\nthe accused may be prosecuted under<a href=\"\/doc\/1569253\/\" id=\"a_21\"> Indian Penal Code<\/a> too.<br \/>\nAccused, therefore, can be prosecuted under Indian Penal too.<br \/>\nThe learned A.G.A. in support of his argument placed reliance in<br \/>\nthe case of Shamsul Islam @ Afroz v. State of U.P. and<br \/>\nanother, reported in 1999 (38) A.C.C.\n<\/p>\n<p id=\"p_4\">We have gone through the record and the allegations made in<br \/>\nthe F.I.R. which disclose the commission of cognizance offence.<br \/>\nWe do not find any ground to quash the F.I.R., which is liable to<br \/>\nbe dismissed.\n<\/p>\n<p id=\"p_5\">The petition is devoid of any merits and           is accordingly<br \/>\ndismissed.\n<\/p>\n<p id=\"p_6\">However, keeping in view the facts and circumstances of the<br \/>\ncase, it is observed that in case after investigation the charge<br \/>\nsheet is filed against the petitioner, he may raise his objection<br \/>\nbefore the trial court.
