          While working as Inspector Grade I in the Kerala<\/p>\n
State   Road    Transport    Corporation    {for   short  ‘the<\/p>\n
Corporation’},    the   petitioner    responded    to   Ext.P1<\/p>\n
notification, by which the first respondent Corporation called<\/p>\n
for the confidential reports in respect of those persons, who<\/p>\n
were eligible for promotion to the post of Assistant Transport<\/p>\n
Officer.  The period of review was 2004-05, 2005-06 and<\/p>\n
2007 (upto 30.6.2007). The petitioner’s confidential reports<\/p>\n
for the said period were called for. But he was not included<\/p>\n
in the list as per Ext.P2, though his juniors’ names were<\/p>\n
included.  As   evidenced    by Ext.P8,    the   Departmental<\/p>\n
Promotion    Committee    had    considered   the  reports  of<\/p>\n
candidates and found that, a punishment of bar of increment<\/p>\n
for one year without cumulative effect, was imposed on the<\/p>\n
petitioner as per order dated 21.6.2006. Similarly another<\/p>\n
W.P.(C).No.1646 of 2008<\/p>\n
                             :: 2 ::\n<\/p>\n
\npunishment for three months’ without cumulative effect was<\/p>\n
also imposed, as per order dated 25.2.2005. It was found<\/p>\n
that the petitioner was not eligible to be considered, as he<\/p>\n
had suffered the punishment during the relevant period.<\/p>\n
That has been challenged in this writ petition.<\/p>\n
          2. According to the petitioner, the stand taken by<\/p>\n
the Corporation is wrong, firstly because the punishment did<\/p>\n
not relate to a delinquency during the period, but much<\/p>\n
earlier. Secondly, the punishments in question are minor in<\/p>\n
nature viz., barring of an increment without cumulative<\/p>\n
effect. It is also pointed out that the second punishment of<\/p>\n
bar of increment for three months without cumulative effect<\/p>\n
actually came to be suffered only after the relevant period.<\/p>\n
          3.  The Corporation, in its counter affidavit, has<\/p>\n
taken a stand that, apart from the punishments, the<\/p>\n
Departmental Promotion Committee has taken into account<\/p>\n
the earlier history of the petitioner as well.<\/p>\n

           4. I heard learned counsel for the petitioner and<\/p>\n
the learned counsel Sri.Unnikrishnan, who was requested to<\/p>\n
assist this court as Amicus Curiae and the learned counsel for<\/p>\n
the Corporation.\n<\/p>\n
           5. Reference is made to Ext.P5 judgment of this<\/p>\n
court where, in the matter of employees of the Corporation,<\/p>\n
it was noted that as per the Rules prevailing in the<\/p>\n
Corporation,    the   officer\/employee    is  entitled   to be<\/p>\n
considered for promotion under the following circumstances:<\/p>\n
             (a)   If  an   officer\/employee   has  been<\/p>\n
                   punished within the review period and<\/p>\n
                   the punishments are of major nature<\/p>\n
                   should    not    be   considered   for<\/p>\n
                   promotion;\n<\/p><\/blockquote>\n
             (b)   If an officer\/employee committed an<\/p>\n
                   offence prior to the review period and<\/p>\n
                   has been imposed punishment during<\/p>\n
                   the review period shall be considered<\/p>\n
                   for promotion;\n<\/p><\/blockquote>\n
             (c)   Those   who     have   been   awarded<\/p>\n
                   punishment of increment bar for a<\/p>\n

                            :: 4 ::\n<\/p><\/blockquote>\n
\n                  period less than one (1) year without<\/p>\n
                  cumulative effect shall be considered.”<\/p><\/blockquote>\n
\n
          6. It is pointed out that the punishment is not a<\/p>\n
major punishment and that though the punishment has been<\/p>\n
imposed during the period, the offence was committed prior<\/p>\n
to the review period. The dictum laid down therein supports<\/p>\n
the case of the petitioner.      Even otherwise, the bar of<\/p>\n
increment without cumulative effect is not a major<\/p>\n
punishment and it should not be taken into account for the<\/p>\n
purpose of selection conducted by the Departmental<\/p>\n
Promotion Committee.\n<\/p>\n
          7. Obviously, the petitioner’s case is eligible to be<\/p>\n
considered afresh by the corporation.        The petitioner has<\/p>\n
since retired on 30.6.2008 and he might be eligible for<\/p>\n
notional promotion and consequential benefits.<\/p>\n
          8.   Accordingly, the writ petition is allowed.<\/p>\n
Ext.P8 is quashed insofar as the petitioner is concerned. The<\/p>\n
W.P.(C).No.1646 of 2008<\/p>\n
                            :: 5 ::\n<\/p>\n
\ncorporation shall place the petitioner’s name in the next<\/p>\n
Departmental Promotion Committee for the post of Assistant<\/p>\n
Transport Officer which shall consider his case in the light of<\/p>\n
the observations above and, if he is otherwise entitled to, he<\/p>\n
shall be given all consequential benefits. Needful shall be<\/p>\n
done at the earliest, at any rate, within two months from<\/p>\n
the date of receipt of a copy of this judgment.<\/p>\n
         I place on record my appreciation for the service<\/p>\n
