Appellant was present in person, while the<br \/>\nrespondents were absent. Respondents&#8217; written submission has been received in<br \/>\nthe Commission.\n<\/p>\n<p id=\"p_2\">2.     Appellant had filed his RTI-request dated 08.01.2008 soliciting certain<br \/>\ninformation pertaining to a Cooperative Society called Kirpal CGHS; 44, I.P.<br \/>\nExtension, Patparganj, Delhi. The AA stated in his order dated 22.02.2008,<br \/>\npursuant to the appellant&#8217;s first-appeal dated 11.02.2008, that appellant should<br \/>\nfile a proper application under Section 139 of the DCS Act-2003 read with<br \/>\nSection 65 of the DCS Rules-2007, which entitles the appellant as a member of<br \/>\nthe above Cooperative Society to receive directly from the Society the<br \/>\nrequisitioned information. He further pointed out that appellant was free to file<br \/>\nan appeal under the same Section before the Asst. Registrar of Cooperative<br \/>\nSocieties, if he fails to receive the information from the Society.\n<\/p>\n<p id=\"p_3\">3.     The AA further ordered that a part of the information requested in the<br \/>\nappellant&#8217;s RTI-application, which related to the office of the Registrar of<br \/>\nCooperative Societies, may be provided to him by the Asst. Registrar (East).\n<\/p>\n<p id=\"p_4\">4.     Earlier, the SPIO through his communications dated 01.02.2008 and<br \/>\n18.02.2008 informed the appellant that the Cooperative Society&#8217;s management<br \/>\nwas willing to allow the appellant to inspect all the records.\n<\/p>\n<p id=\"p_5\">5.    Copy of letter dated 09.02.2008 received from the Society management<br \/>\ncomprising 2 pages was also transmitted to the appellant by SPIO, Shri Sushil<br \/>\nKumar, Assistant Registrar (East).\n<\/p>\n<p id=\"p_6\">6.     The appellant has challenged the findings of the respondents \u2015 the SPIO<br \/>\nand the AA \u2015 in second-appeal.\n<\/p>\n<p id=\"p_7\">7.     He has argued that AA had erred in directing the appellant to take<br \/>\nrecourse to Section 139 of the DCS Act. According to him, if a Society<br \/>\nmanagement itself is disinclined to provide information to the Registrar of<br \/>\nCooperative Societies, how was it expected that the information would be<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                      Page 1 of 3<\/span><br \/>\n disclosed to an ordinary member of the Society. He has demanded that all the<br \/>\ninformation should be ordered to be disclosed to him as requested by him and the<br \/>\nRegistrar of Cooperative Societies conduct a time-bound enquiry as to &#8220;how this<br \/>\nbogus bye-law provided to applicant reaches their office and how SPIO without<br \/>\nchecking whether these are genuine or bogus send them to applicant [sic]&#8221;\n<\/p>\n<p id=\"p_8\">Decision:\n<\/p>\n<p id=\"p_9\">8.     This application raises an important point about the applicability of the<br \/>\nprovisions of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a> under <a href=\"\/doc\/1516599\/\" id=\"a_1\">Section 2(f)<\/a> in matters where the &#8216;other laws&#8217;<br \/>\nsuch as the Delhi Cooperative Societies Act (DCS Act) contains a specific<br \/>\ndisclosure of information provision for a certain category of applicants, viz.<br \/>\nmembers of Cooperative Society.\n<\/p>\n<p id=\"p_10\">9.     The Cooperative Societies are undoubtedly private organizations. As such<br \/>\nthey are prima-facie outside the scope of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>. However, information<br \/>\nrelated to the Cooperative Societies are accessible through the <a href=\"\/doc\/671631\/\" id=\"a_3\">RTI Act<\/a> through<br \/>\n<a href=\"\/doc\/1516599\/\" id=\"a_4\">Section 2(f)<\/a> of the Act, which states that information held by a private body<br \/>\nwhich can be accessed by a public authority under a given law can be accessed<br \/>\nthrough the <a href=\"\/doc\/671631\/\" id=\"a_5\">RTI Act<\/a>. It follows from it, that the <a href=\"\/doc\/671631\/\" id=\"a_6\">RTI Act<\/a> can be invoked to<br \/>\naccess privately held information provided it can be proved that there was a<br \/>\ngiven set of laws under which that information can be accessed by a public<br \/>\nauthority. In this case, that law is the DCS Act. It, however, follows from it that<br \/>\nthe manner of accessing the information held by the private body under that law<br \/>\nshall be strictly under the provisions of &#8216;other law&#8217;. In other words, if the<br \/>\n&#8216;other law&#8217; clearly lays down as to who can access the information held by the<br \/>\nprivate body \u2015 Cooperative Society being one &#8212; and the methodology of<br \/>\naccessing that information including the appellate process, it is this law and not<br \/>\n<a href=\"\/doc\/671631\/\" id=\"a_7\">RTI Act<\/a> that shall be invoked for accessing the information.\n<\/p>\n<p id=\"p_11\">10.    The respondents have persuasively argued that as Section 139 of the DCS<br \/>\nAct and Rule 65 of the DCS Rules were incorporated in the DCS Act after the<br \/>\nenactment of the <a href=\"\/doc\/671631\/\" id=\"a_8\">RTI Act<\/a>, the access to the information held by the Cooperative<br \/>\nSocieties shall be governed by the provisions of the DCS Act and not the <a href=\"\/doc\/671631\/\" id=\"a_9\">RTI<br \/>\nAct<\/a>. Even otherwise, in the light of what has been stated in the preceding<br \/>\nparagraph, the application of <a href=\"\/doc\/1516599\/\" id=\"a_10\">Section 2(f)<\/a> to privately held information must<br \/>\nsubject itself to the limits of the &#8216;other law&#8217; under which such information is<br \/>\nsought to be accessed under this Section of the RTI Act. If the other law has a<br \/>\nself-contained provision about accessing any privately held information, the <a href=\"\/doc\/671631\/\" id=\"a_11\">RTI<br \/>\nAct<\/a> cannot be invoked for accessing that information.\n<\/p>\n<p id=\"p_12\">11.    This matter was discussed in some detail in Rajender Goel &amp; Ors. Vs.<br \/>\nRegistrar of Cooperative Societies; Appeal Nos.CIC\/AT\/A\/2007\/01525, 1526,<br \/>\nCIC\/AT\/A\/2008\/00040, 41, 42, 99, 100 &amp; 101; Date of Decision: 30.06.2008.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                        Page 2 of 3<\/span><\/p>\n<p id=\"p_13\"> 12.    In the context of the above discussion, it would be correct to argue that<br \/>\nmatters related to Cooperative Societies \u2015 those Societies being private bodies<br \/>\n\u2015 cannot be accessed by &#8216;any&#8217; petitioner, but only by a member of the Society<br \/>\nas provided in Section 139 of the DCS Act. Apart from the above, the<br \/>\nentitlement of such members and the procedure of the disclosure as well as the<br \/>\nappellate proceeding shall be in terms of the provisions of Section 139 of the<br \/>\nDCS Act read with Rule 65 of the DCS Rules and not the <a href=\"\/doc\/671631\/\" id=\"a_12\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_14\">13.    In view of the above, the part of the information the appellant wishes to<br \/>\nhave from the Cooperative Society will need to be accessed by him under<br \/>\nSection 139 of the DCS Act. The other part of the information, which was<br \/>\ntransmitted to him as held by the Registrar of Cooperative Societies, was<br \/>\nproperly done under the <a href=\"\/doc\/671631\/\" id=\"a_13\">RTI Act<\/a>. Appellant seems to have some reservations<br \/>\nabout the veracity of that information. If he so wishes, he can inspect the records<br \/>\nof the RCS to satisfy himself about the validity of the information provided to<br \/>\nhim. The SPIO is directed to facilitate such inspection by the appellant within 2<br \/>\nweeks from the date of the receipt of this order.\n<\/p>\n<p id=\"p_15\">14.    It is also noted that the Cooperative Society has given in writing to the AA<br \/>\nand the SPIO that they have no objection to the appellant inspecting their<br \/>\nrecords. The appellant may take advantage of this offer under Section 139 of the<br \/>\nDCS Act.\n<\/p>\n<p id=\"p_16\">15.     The appeal is accordingly disposed of.\n<\/p>\n<p id=\"p_17\">16.
