THE ACCOUNTANT GENERAL, BIHAR, PATNA.\n                                      -----------\n<\/pre>\n<p id=\"p_1\">2   29\/10\/2010             Certain claim of the petitioner with regard to<\/p>\n<p>                   second time bound promotion and second A.C.P. has<\/p>\n<p>                   been rejected vide annexure-12. This is the speaking<\/p>\n<p>                   order which has been passed on 2.6.2005 after<\/p>\n<p>                   considering the service record of the petitioner and<\/p>\n<p>                   taking into consideration the earlier direction of the High<\/p>\n<p>                   Court contained in annexure-6.\n<\/p>\n<p id=\"p_1\">                           It is evident from a reading of annexure-6<\/p>\n<p>                   coupled with annexure-12 that the petitioner was re-<\/p>\n<p>                   appointed in service in the year 1981 and the High Court<\/p>\n<p>                   in its earlier order clearly directed that for the purposes<\/p>\n<p>                   of pension the entire period of service would be taken<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          -2-<\/span><\/p>\n<p>        into consideration but whether such a relief will also<\/p>\n<p>        apply to time bound promotion is another issue.<\/p>\n<p>        Obviously the benefit of promotion and other benefits<\/p>\n<p>        will have to be calculated from the date the petitioner<\/p>\n<p>        was re-appointed and the High Court directed benefit to<\/p>\n<p>        the petitioner to a limited extent in the sense that for<\/p>\n<p>        calculation of pension of the petitioner, entire length of<\/p>\n<p>        service from the date of initial appointment was to be<\/p>\n<p>        considered but the same cannot be extended even to<\/p>\n<p>        cases of promotion as there is no dispute that the<\/p>\n<p>        petitioner came to be re-appointed and a fact which was<\/p>\n<p>        never challenged otherwise.\n<\/p>\n<p id=\"p_2\">                Reasoning given for rejection of the second time<\/p>\n<p>        bound promotion and the benefit of second A.C.P. to the<\/p>\n<p>        petitioner seems to be cogent and correct.<\/p>\n<p id=\"p_3\">                This writ application has no merit.
