The latter borrowed\n\n  the complainant agreeing to repay the\n\n  regard issued two cheques for\n\n Rs.5.,&#039;00,&#039;000\/it each both dated 28.10.2003 towards\n\n of liability. On presentation, the cheques were\n\nr&quot;etu&#039;rn&#039;ed dishonoured on 5.11.2003 for &#039;insufficiency of\n\n3 &#039;funds&#039;, necessitating issuance of statutory notice on\n\n17.11.2003 which was served on the petitioner accused, but\n\n \n\n \n\n\n\n5\n\nit held the debt had to be discharged and since the..wh:&#039;ol\u00bbe~~.of\n\nthe debt was not repaid, he was held to have  ~\n\noffence. Therefore, it \nthat the finding of the trial cou__rt._on \nremained undisturbed. Dalai v,__Bratindranath Banerjee\n[(vl2&#039;O&#039;O1).,6,SCC&quot;i.6]&#039;,,a&#039; 3-Judge Bench of this Court\n\nheid thatalthouigh..,i;;y....re-ason of Sections 138 and\n\n139 of Vthe&#039;\u00ab.&#039;Act,~_.th,e,presumption of law as\ndistinguisheci from presumption of fact is drawn,\n\nthe coL.irt&quot;has_ no other option but to draw the\nsame in &quot;every case where the factual basis of\n _ffrai&#039;s,irig_ the &quot;pi*--e--su&#039;mption is established. Pal, J.\n<\/pre>\n<p id=\"p_1\">&#8216;  &#8216; sp&#8217;eai:.in&#8217;g._ for a 3&#8211;Judge Bench, however, opined:<\/p>\n<p>__ . Vf&#8217;~3f,&#8230;~..IV;;;;&#8221;Presumptions are rules of evidence<br \/>\n&#8220;and &#8216;d-i3_ir&#8217;;not conflict with the presumption of<br \/>\n&#8220;~.inn&#8217;ocen&#8217;ce, because by the latter, all that is<br \/>\nrneant is that the prosecution is obliged to prove<br \/>\n..  the case against the accused beyond reasonabie<br \/>\n, &#8220;\u00abdoubt. The obligation on the prosecution may be\n<\/p>\n<p id=\"p_1\"> -discharged with the help of presumptions of law<br \/>\nor fact unless the accused adduces evidence<br \/>\nshowing the reasonable possibility of the non-<br \/>\nexistence of the presumed fact.\n<\/p>\n<p id=\"p_2\">In other words, provided the facts required to<br \/>\nform the basis of a presumption of iaw exist, no<\/p>\n<p>i2<\/p>\n<p>received from the accused. Even otherwise, the conjplja-inia_nt<\/p>\n<p>had failed to account for the money recovered  .<\/p>\n<p>to D3 in c.c.329\/04 and Exs.D2 to as in c.c&#8217;;1rijj\/io4~}:1ii,,thev <\/p>\n<p>circumstances, the allegation of &#8220;the;&#8221;co5m&#8217;;:.l,ai-na&#8217;nt'&#8221;&#8216;i:s..__not<\/p>\n<p>convincing and at the most, it_co_uld tie &#8216;held that,jth,efe:&#8217;\u00a7<\/p>\n<p>transaction between him and th_e&#8217;p.etit,i_oners.\u00ab.:1:n V}<\/p>\n<p id=\"p_3\">9. To sustain   <a href=\"\/doc\/1132672\/\" id=\"a_1\">N.I. Act<\/a>,<br \/>\nexistence of as be proved. In<br \/>\nthe case or &#8216;j1\\imvAol-rARAN M.J. &amp;<br \/>\nANOTI:-i&#8217;E%R&#8217;  the apex court, after<br \/>\naccepting the  about issuance of<\/p>\n<p>cheque tow&#8217;a.rd&#8217;s .|ia_bil~i~ty&#8217;,~.-&#8220;held that the complainant must<\/p>\n<p>that onV&#8217;the*date of presenting the cheque, the<\/p>\n<p> _&#8217;deb:t&#8217;0r&#8221;l~iabil&#8217;iity&#8217; was existing. In the instant case, it was the<\/p>\n<p>dlutyyl\u00e9of _t.h&#8217;e&#8217;i__cbmplainant to prove that the debt or legal<\/p>\n<p>l&#8217;,_|iabi|ityVstibsisted as on the date of when the cheques were<\/p>\n<p>A&#8221;i,&#8221;_prese_nted. Except producing the cheques, bank<\/p>\n<p> endorsement and copy of legal notice, there is nothing to<\/p>\n<p> show that the debt\/legal liability existed. On the other<\/p>\n<p>hand, the accused have produced receipts and also reply<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">14<\/span><\/p>\n<p>Metropolitan Magistrate, Bangalore, dated 26.4.2007 are set   <\/p>\n<p>aside. The accused in both the cases are absolved of <\/p>\n<p>charges levelled under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a>, N1.
