Baghel assisted by Sri Gautam Baghel, learned<br \/>\ncounsel for the petitioner that the petitioner was appointed on the post of<br \/>\nAssistant Director \/Assistant Professor, Plant Breading in the month of<br \/>\nMarch, 2005, and since then he has been working on the said post . The<br \/>\nappointment of the petitioner has been cancelled by the respondent no. 2 on<br \/>\nthe representation made by the respondent no. 5 on the ground that the<br \/>\npetitioner had not cleared NET Examination. It is submitted that in the<br \/>\nAdvertisement (Annexure no. 1 to the writ petition) issued for the<br \/>\nappointment on the post of Assistant Director \/Assistant Professor, Plant<br \/>\nBreeding, there was no requirement that the applicants should have cleared<br \/>\nNET Examination. In the Comments submitted on behalf of the respondent<br \/>\nnos. 3 and 4 (Annexure no. 5 to the writ petition) before the respondent no. 2,<br \/>\nno requirement of clearing NET Examination by the applicants has been<br \/>\nmentioned. It is submitted that the petitioner fulfilled all the requirements<br \/>\nmentioned in the Advertisement as well as in the aforesaid Commens, thus the<br \/>\npetitioner was rightly appointed on the said post.\n<\/p>\n<p id=\"p_2\">  Sri. Baghel has relied upon the decision of this Court in Dr. Ravindra<br \/>\nKumar Vs. State of U.P. and others 2008(8) ADJ 484 (DB) (Paragraph 40).\n<\/p>\n<p id=\"p_3\">  The matter requires consideration.\n<\/p>\n<p id=\"p_4\">  Issue notice pending admission.\n<\/p>\n<p id=\"p_5\">   Notice on behalf of respondent no. 1 has been accepted by the learned<br \/>\nStanding Counsel.\n<\/p>\n<p id=\"p_6\">   Notice on behalf of respondent no. 2 has been accepted by Sri. Neeraj<br \/>\nTripathi.\n<\/p>\n<p id=\"p_7\">  Notice on behalf of respondent no. 3 and 4 has been accepted by Sri. P.K.<br \/>\nGanguly.\n<\/p>\n<p id=\"p_8\">  Notice will be issued to respondent no. 5 fixing the next date fixed in the<br \/>\nmatter.\n<\/p>\n<p id=\"p_9\">  Counter affidavit on behalf of the respondents may be filed within three<br \/>\nweeks.\n<\/p>\n<p id=\"p_10\">   Rejoinder affidavit may be filed by the next date fixed in the matter.\n<\/p>\n<p id=\"p_11\">  List this case on 15.02.2010.\n<\/p>\n<p id=\"p_12\">  Heard on the question of grant of interim relief ,<\/p>\n<p>   Having regard to the facts of the case, and having considered the<br \/>\nsubmissions made by Sri. P.S.
