F; Act for violation &#8216;of the legal provisions under the said Act and, to take<br \/>\ncognizance for the same may kindly be furnished.\n<\/p>\n<p id=\"p_6\">Reply of the Public Information Officer (PIO)<br \/>\nInformation pertain to 187 pages and hence deposit Rs.374\/- to get the information.\n<\/p>\n<p id=\"p_7\">Grounds for the First Appeal:\n<\/p>\n<p id=\"p_8\">No information was provided.\n<\/p>\n<p id=\"p_9\">Order of the First Appellate Authority (FAA):\n<\/p>\n<p id=\"p_10\">Not mentioned.\n<\/p>\n<p id=\"p_11\">Grounds for the Second Appeal:\n<\/p>\n<p id=\"p_12\">Unsatisfactory information provided by the PIO and Dismissal of Appeal by the FAA.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                                            Page 1 of 2<\/span><\/p>\n<p id=\"p_13\"> Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_14\">The following were present<br \/>\nAppellant: Absent;\n<\/p>\n<p id=\"p_15\">Respondent: Ms. Nisha O. V., Public Information Officer &amp; Regional PF Commissioner<\/p>\n<p>        The respondent admits that the RTI application reached her office on 16\/011\/2009. She states that<br \/>\nthe application did not go to the RTI application but was lying in the enforcement file since the appellant<br \/>\nhad the matter pending there. In March 2010 the RTI application was sent to the PIO who demanded an<br \/>\nadditional fee of Rs.374\/- for providing the information. The PIO states that she provided the information<br \/>\nto the appellant on 09\/08\/2010. It is apparent that the organization has no system in place to provide the<br \/>\ninformation when RTI application is received. It is a fact that the appellant has being harassed unncesarily<br \/>\nand had to wait for nearly 10 months to get the information which he should have obtained within 30<br \/>\ndays. The Commission therefore awards a compensation to the appellant for the unnecessarily harassment<br \/>\nhe had to undergo. As per the provisions of <a href=\"\/doc\/131273063\/\" id=\"a_1\">Section 19(8)(b)<\/a> the Commission awards a compensation of<br \/>\nRs.1000\/- to the appellant for the loss and detriment suffered by in having to file a second appeal and<br \/>\nwaiting for 10 months for the information.\n<\/p>\n<p id=\"p_16\">Decision:\n<\/p>\n<p id=\"p_17\">The Appeal is allowed.\n<\/p>\n<p id=\"p_18\">      The claims that the information has been sent to the appellant on 09\/08\/2010.\n<\/p>\n<p id=\"p_19\">The issue before the Commission is of not supplying the complete, required information by the PIO<br \/>\nwithin 30 days as required by the law.\n<\/p>\n<p id=\"p_20\">From the facts before the Commission it is apparent that the PIO is guilty of not furnishing information<br \/>\nwithin the time specified under sub-section (1) of <a href=\"\/doc\/18566603\/\" id=\"a_1\">Section 7<\/a> by not replying within 30 days, as per the<br \/>\nrequirement of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_21\">It appears that the PIO&#8217;s actions attract the penal provisions of <a href=\"\/doc\/131273063\/\" id=\"a_3\">Section 20<\/a> (1). A show cause notice is<br \/>\nbeing issued to her, and she is directed give her reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on her.\n<\/p>\n<p id=\"p_22\">She will present herself before the Commission at the above address on 28 September 2010 at 11.30am<br \/>\nalongwith her written submissions showing cause why penalty should not be imposed on her as mandated<br \/>\nunder <a href=\"\/doc\/131273063\/\" id=\"a_4\">Section 20<\/a> (1).
