Registrar (NW)\n                                             O\/o Registrar of Co-operative Societies\n                                             GNCTD, Old Court Building,\n                                             Parliament Street, New Delhi 110001\n\nRTI application filed on             :       06\/01\/2010\nPIO replied                          :       Not replied\nFirst appeal filed on                :       15\/02\/2010\nFirst Appellate Authority order      :       26\/02\/2010\nSecond Appeal received on            :       07\/04\/2010\n\nInformation Sought:\n<\/pre>\n<p id=\"p_1\">The Appellant had sought following information in respect of his application dated<br \/>\n04\/05\/2007, 06\/06\/2007 and 12\/12\/2007 which he filed with the RCS.\n<\/p>\n<p id=\"p_2\">    1) Copy of the action taken report by the office in respect of the above said cases till<br \/>\n        today along with copy of the order sheet.\n<\/p>\n<p id=\"p_3\">    2) Name and designation of the concerned officers of the RCS who were deputed to<br \/>\n        take action in respect of the above.\n<\/p>\n<p id=\"p_4\">The Appellant further sought following information with respect to the direction given by<br \/>\nthe RCS to the Society (Janyug Co-operative Group Housing Society Ltd.) to issue NOC to<br \/>\nthe petitioner for getting the flat converted into freehold\n<\/p>\n<p id=\"p_5\">            a) Copy of the action taken report by the office in respect of the above said<br \/>\n                case till date along with copy of the order sheet.\n<\/p>\n<p id=\"p_6\">            b) Name and designation of the concerned officers of the RCS who were<br \/>\n                deputed to take action in respect of the above.\n<\/p>\n<p id=\"p_7\">Reply of the PIO:\n<\/p>\n<p id=\"p_8\">Not replied.\n<\/p>\n<p id=\"p_9\">Ground for the First Appeal:\n<\/p>\n<p id=\"p_10\">Non-receipt of the information from the PIO within the stipulated time.\n<\/p>\n<p id=\"p_11\">Order of the First Appellate Authority (FAA):\n<\/p>\n<p id=\"p_12\">The SPIO was directed to provide specific point wise reply to the Appellant as per record<br \/>\nwithin 15 days.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                                Page 1 of 2<\/span><\/p>\n<p id=\"p_13\"> Ground for the Second Appeal:\n<\/p>\n<p id=\"p_14\">Non-compliance of the FAA&#8217;s order by the PIO.\n<\/p>\n<p id=\"p_15\">Decision:\n<\/p>\n<p id=\"p_16\">The Commission has perused the documents submitted by the Appellant. The Appellant<br \/>\nfiled an RTI Application on 06\/01\/2010. The Appellant did not receive any reply from the<br \/>\nPIO and he filed a First Appeal dated 15\/02\/2010. The First Appellate Authority in its order<br \/>\nheld a hearing on 24\/02\/2010 during which the Appellant and Mr. Ved Prakash, SPIO were<br \/>\npresent. The First Appellate Authority vide its order dated 26\/02\/2010 directed the SPIO to<br \/>\nprovide a specific point-wise reply to the Appellant within 15 days of the order. However,<br \/>\ntill the date of filing Second Appeal (07\/04\/2010), the Appellant was not provided any<br \/>\ninformation.\n<\/p>\n<p id=\"p_17\">The information sought by the Appellant falls within the definition of <a href=\"\/doc\/1516599\/\" id=\"a_1\">Section 2(f)<\/a> of the<br \/>\nRTI Act and no exemption can be claimed by the PIO to refuse disclosure. If the<br \/>\ninformation would not have been available with the PIO or if any exemption under <a href=\"\/doc\/1001313\/\" id=\"a_1\">Section<br \/>\n8(1)<\/a> or 9 applied in the present case, the First Appellate Authority would have made an<br \/>\nobservation in that respect. However, no such observation has been made. The Commission<br \/>\ntherefore directs the SPIO &amp; Asst. Registrar (NW) to comply with the order of the First<br \/>\nAppellate Authority and provide the point-wise information to the Appellant before 20<br \/>\nMay 2010.\n<\/p>\n<p id=\"p_18\">Appeal is allowed.\n<\/p>\n<p id=\"p_19\">The SPIO &amp; Asst. Registrar (NW) is directed to provide the complete information<br \/>\nfree of cost to the Appellant before 20\/05\/2010. He is further directed to submit proof of<br \/>\nsending the information to the Appellant to the Commission before 25\/05\/2010.\n<\/p>\n<p id=\"p_20\">From the facts before the Commission it is apparent that the SPIO &amp; Asst. Registrar (NW)<br \/>\nis guilty of not complying with sub-section (1) of <a href=\"\/doc\/1831074\/\" id=\"a_2\">Section 7<\/a>.
