Balakrishnan, J.\n<\/p>\n<p id=\"p_1\">\tLeave granted.\n<\/p>\n<p id=\"p_2\">\tHeard the learned Counsel for the appellant and the learned<br \/>\nCounsel for the Maharashtra State Electricity Board (in short<br \/>\n&#8220;MSEB&#8221;). By the impugned Judgment, the Writ Petition filed by the<br \/>\nappellant company was rejected by the High Court.  The appellant<br \/>\ncompany, M\/s. Amit Products (India) Ltd., is a company incorporated<br \/>\nin India and registered under the provisions of the <a href=\"\/doc\/1353758\/\" id=\"a_1\">Companies Act<\/a>,<br \/>\n1956.  The appellant company obtained Provisional Registration<br \/>\nCertificate as a small scale industry from the Director of Companies<br \/>\nof Government of Maharashtra.  The Director of the Appellant<br \/>\nCompany Shri Shridhar Natekar filed an application for getting<br \/>\nelectricity connection.  This was rejected by the respondent MSEB.<br \/>\nMSEB insisted on clearance of all arrears of electricity charges<br \/>\npayable by M\/s. Amar Amit Jalna Alloys Pvt. Limited which according<br \/>\nto the MSEB was the previous consumer.  The appellant company<br \/>\ncontended that they are not liable to pay the electricity charges<br \/>\npayable by M\/s. Amar Amit Jalna Alloys Pvt. Ltd. and the appellant<br \/>\ncompany herein is a distinct and separate company which had<br \/>\nnothing to do with M\/s. Amar Amit Jalna Alloys Pvt. Ltd.\n<\/p>\n<p id=\"p_3\">\tIt may be noted that previously appellant company filed a Writ<br \/>\nPetition namely, W.P. 2090\/2002.  In the Writ Petition, the appellant<br \/>\ncompany requested for power supply to its factory contending that it<br \/>\nis a separate company situated at a separate portion of the property<br \/>\ncomprised in the same Survey No. and the insistence of the MSEB to<br \/>\npay the arrears of electricity charges to be payable by M\/s. Amar Amit<br \/>\nJalna Alloys Pvt. Ltd. and the refusal to give supply was arbitrary and<br \/>\nviolative of <a href=\"\/doc\/367586\/\" id=\"a_1\">Article 14<\/a> and <a href=\"\/doc\/935769\/\" id=\"a_2\">19(1)(g)<\/a> of the Constitution.  The matter<br \/>\nwas elaborately considered by the High Court of Bombay and by<br \/>\njudgment dated 18.12.21003, it was held that the appellant company<br \/>\nwas seeking connection in respect of the same premises, by the<br \/>\nsame consumer, under the guise of separate corporate body and it<br \/>\nwas found that the appellant company was the very same corporate<br \/>\nentity which committed default in paying the electricity charges.  It<br \/>\nwas held  that the appellant company was not an independent entity<br \/>\nhaving no concern with the previous defaulter.\n<\/p>\n<p id=\"p_4\">\tThe present appellant company now contends that the previous<br \/>\njudgment was passed at a time when the Directors of the appellant<br \/>\nCompany were Amit Dembada, Anita Dembada and Thakur Das<br \/>\nTejnani and it is now pointed out that the present Directors are Abhay<br \/>\nAbad, Sridhar Natekar and Thakurdas Tejnani and the learned<br \/>\ncounsel for the appellant company further contended that the<br \/>\nshareholders of the appellant company have also been changed and<br \/>\nthe details of the present shareholders are mentioned to be seven in<br \/>\nnumber and they are not belonging to the family to Dembada.  It is<br \/>\nsubmitted that the previous defaulter M\/s. Amar Amit Jalna Alloys<br \/>\nPvt. Ltd. was a family concern of Dembada and they have nothing to<br \/>\ndo with the present appellant company and the whole corporate entity<br \/>\nhas changed and the respondent MSEB is bound to give connection<br \/>\nwithout insisting for the payment of electricity charges to be payable<br \/>\nby M\/s. Amar Amit Jalna Alloys Pvt. Ltd.\n<\/p>\n<p id=\"p_5\">\tThe appellant company also contended that it is in possession<br \/>\nof only 40 Ares of land out of the total property comprising Gut No.<br \/>\n953; Its total area bearing 2 hectares 82 Ares.  The appellant<br \/>\ncompany has also pointed out that M\/s. Amar Amit Jalna Alloys Pvt.<br \/>\nLtd. was having factory on the north-eastern corner of the property<br \/>\nwhereas the appellant company is on the north-western corner side<br \/>\nof the property.\n<\/p>\n<p id=\"p_6\">\tThe learned Counsel for the first respondent contended that the<br \/>\nvery same company had applied for connection and the Writ Petition<br \/>\nfiled by the appellant company previously was dismissed and the<br \/>\nsame was challenged before this Court and this Court dismissed SLP<br \/>\nand there was further Review and Curative Petition and all of them<br \/>\nwere dismissed by this Court, and therefore, the appellant company<br \/>\nwas not justified in filing a fresh appeal.\n<\/p>\n<p id=\"p_7\">\tWe have carefully considered the rival contentions of both the<br \/>\nparties.  We are unable to accept the contention of the appellant<br \/>\ncompany that by changing the members of the Board of Directors of<br \/>\nthe Company or by changing the shareholding pattern, the appellant<br \/>\nCompany had undergone any change.  The very same company<br \/>\nwanted the electricity connection without making any payment<br \/>\ntowards the electricity charges payable by the previous consumer<br \/>\nand the matter was dealt with in detail by the High Court and it was<br \/>\nheld that the appellant company is none other than the sister concern<br \/>\nof M\/s. Amar Amit Jalna Alloys Pvt. Ltd. and was representing the<br \/>\nsame consumer who had committed the default and it was held that<br \/>\nCondition 23(b) of the Conditions of Miscellaneous Charges for<br \/>\nsupply of electricity energy would apply to the appellant Company.<br \/>\nWe do not think that by change of Directors or by change of pattern of<br \/>\nthe shareholding, the appellant company is really a different entity<br \/>\nthan M\/s. Amit Products (India) Ltd. who filed the previous Writ<br \/>\nPetition No. 2090\/2002.  The reasons given in the previous Judgment<br \/>\nwhich were confirmed by this Court would apply with all force against<br \/>\nthe present appellant company and the High Court has rightly<br \/>\ndismissed the Writ Petition filed by the appellant Company.\n<\/p>\n<p id=\"p_8\">\tWe find no reason to interfere with the impugned judgment and<br \/>\nthe appeal is dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India M\/S.
