PRAKASH TATIA, J.\n<\/pre>\n<p id=\"p_1\">Mr.Pankaj Sharma, for the appellant.<br \/>\nMr.Jagdish Vyas, for the respondent.\n<\/p>\n<p id=\"p_1\">\n<p>      Heard learned counsel for the parties.<\/p>\n<p>      The appellant claimant is aggrieved against the order<\/p>\n<p>of the Motor Accident Claims Tribunal, Bhilwara dated<\/p>\n<p>15.2.2008 by which the tribunal in claim case No.343\/2005<\/p>\n<p>returned the claim petition to the claimant for presenting in<\/p>\n<p>the proper tribunal on account of want of territorial<\/p>\n<p>jurisdiction.\n<\/p>\n<p id=\"p_2\">      According to learned counsel for the appellant, the<\/p>\n<p>claim petition was filed before the Motor Accident Claims<\/p>\n<p>Tribunal on 9.9.2004 with clear averment that appellant is<\/p>\n<p>residing at Aazad Nagar, Bhilwara in the State of Rajasthan<\/p>\n<p>within the jurisdiction of the Bhilwara Court. The reply was<\/p>\n<p>filed by the respondent Insurance Company and in reply<\/p>\n<p>filed on 20.12.2005 no objection about lack of territorial<\/p>\n<p>jurisdiction was raised nor it was contended that appellant<br \/>\n                                                SBCMA No.459\/2008<br \/>\n                                        Laxman Lal Vs. Kanti lal &amp; Ors.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">                             -{2}-\n<\/p>\n<p id=\"p_5\">\nis not residing at the address given by the appellant in<\/p>\n<p>Bhilwara.    The Motor Accident Claims Tribunal recorded<\/p>\n<p>evidence of the parties and ultimately on 22.8.2007, the<\/p>\n<p>respondent     Insurance   Company      who       was       granted<\/p>\n<p>permission under Section 170 of the Motor Accident Act by<\/p>\n<p>order dated 10.10.2006 closed its evidence and the Motor<\/p>\n<p>Accident Claims Tribunal fixed the case for final hearing.<\/p>\n<p>The arguments were heard on 12.2.2008 by the tribunal,<\/p>\n<p>and, thereafter, while deciding the claim petition of the<\/p>\n<p>claimant, the considered the application filed by the<\/p>\n<p>respondent Insurance Company dated 14.2.2007 in which<\/p>\n<p>objection was raised by the respondent that as per the<\/p>\n<p>respondent&#8217;s survey they found that the appellant is not<\/p>\n<p>residing at Bhilwara, therefore, the tribunal at Bhilwara has<\/p>\n<p>no jurisdiction.\n<\/p>\n<p id=\"p_6\">     According to learned counsel for the appellant, the<\/p>\n<p>tribunal committed serious error of fact in holding that<\/p>\n<p>appellant is not residing at Bhilwara and further committed<\/p>\n<p>error of law by allowing the objection on the ground of<\/p>\n<p>territorial jurisdiction after such a late state and that to it<br \/>\n                                                   SBCMA No.459\/2008<br \/>\n                                           Laxman Lal Vs. Kanti lal &amp; Ors.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                -{3}-\n<\/p>\n<p id=\"p_9\">\nwas   not   persuaded     and    pressed   by     the    respondent<\/p>\n<p>Insurance Company, which is clear from the facts on record.<\/p>\n<p id=\"p_10\">      Learned   counsel    for     the   respondent        Insurance<\/p>\n<p>Comopany vehemently submitted that in view of sub-<\/p>\n<p>section (2) of <a href=\"\/doc\/136948773\/\" id=\"a_1\">Section 166<\/a> of the Motor Vehicles Act, 1988<\/p>\n<p>only that tribunal has jurisdiction within local limits the<\/p>\n<p>accident occurred or the claimant resides or carrying on<\/p>\n<p>business.    It is submitted that the appellant was not<\/p>\n<p>residing in Bhilwara and, therefore, the tribunal rightly<\/p>\n<p>passed the order returning the claim.<\/p>\n<p id=\"p_11\">      I considered the submissions of learned counsel for<\/p>\n<p>the parties and perused the facts of the case. The facts<\/p>\n<p>referred above are not in dispute so far as filing of the claim<\/p>\n<p>by the claimant on 29th Sept., 2004, filing of reply by the<\/p>\n<p>respondent Insurance Company on 20.12.2005 and further<\/p>\n<p>there was no objection of the respondent about territorial<\/p>\n<p>jurisdiction of the tribunal in the reply. The evidence was<\/p>\n<p>recorded by the tribunal and the objection for territorial<\/p>\n<p>jurisdiction was raised by moving application on 14.2.2007.<\/p>\n<p>Thereafter, the proceedings continued and no order was<br \/>\n                                                SBCMA No.459\/2008<br \/>\n                                        Laxman Lal Vs. Kanti lal &amp; Ors.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">                              -{4}-\n<\/p>\n<p id=\"p_14\">\nsought by the respondent- Insurance Company on this<\/p>\n<p>application. The tribunal by order dated 28th May, 2007 has<\/p>\n<p>ordered that the issue raised by the respondent about the<\/p>\n<p>territorial jurisdiction shall be decided after evidence of the<\/p>\n<p>parties.        The respondent- Insurance Company did not<\/p>\n<p>choose to produce any evidence with respect to any of their<\/p>\n<p>objection.\n<\/p>\n<p id=\"p_15\">        In view of the above reasons, the objection of<\/p>\n<p>territorial jurisdiction was raised after inordinate delay in<\/p>\n<p>spite      of    having   knowledge   from    beginning          that<\/p>\n<p>accident occurred on the road leading to the Puna, outside<\/p>\n<p>State of Rajasthan and the claimant claimed that he is<\/p>\n<p>residing in Bhilwara. The respondent if collected some<\/p>\n<p>evidence with respect to the residence of the claimant then<\/p>\n<p>the respondent did not choose to produce any evidence<\/p>\n<p>even after passing of the order by the tribunal dated 28th<\/p>\n<p>May, 2007 wherein the tribunal held that issue will be<\/p>\n<p>decided after evidence of the parties. There is no reason for<\/p>\n<p>the court below to reject the evidence of the claimant when<\/p>\n<p>there was no rebuttal from the side of the respondent.\n<\/p>\n<p id=\"p_16\">                                                               SBCMA No.459\/2008<br \/>\n                                                       Laxman Lal Vs. Kanti lal &amp; Ors.\n<\/p>\n<p id=\"p_17\">\n<p id=\"p_18\">                                              -{5}-\n<\/p>\n<p id=\"p_19\">\n                   In view of the above, the objection which was raised<\/p>\n<p>              after inordinate delay should have been rejected by the<\/p>\n<p>              tribunal and further on facts, the tribunal committed serious<\/p>\n<p>              error in returning the claim. It is not a case of inherent lack<\/p>\n<p>              of jurisdiction of the tribunal but it was an objection about<\/p>\n<p>              territorial jurisdiction which cannot be inherent lack of<\/p>\n<p>              jurisdiction of the tribunal.\n<\/p>\n<p id=\"p_20\">                   Hence, the appeal of the appellant is allowed. The<\/p>\n<p>              order dated 15.2008 is set aside. The matter is remanded<\/p>\n<p>              to the tribunal and tribunal shall decide the claim petition<\/p>\n<p>              within a period of four months from the date of receipt of<\/p>\n<p>              the copy of this order alongwith record.
