Roy, Advocates\n                                                  -----\n12 \/28.03.2011<\/pre>\n<p id=\"p_1\">                Although this matter has been listed for orders on the ground that<br \/>\n                 fresh steps for service by the opposite party No.11 have not been taken despite<br \/>\n                 repeated opportunities, but with the assistance of the learned counsel for the<br \/>\n                 State and learned counsel for the respondent No.1 and the learned counsel for<br \/>\n                 the informant we have heard the matter on merits.\n<\/p>\n<p id=\"p_1\">                              This is an appeal against the acquittal of the 11 accused jointly tried<br \/>\n                 under <a href=\"\/doc\/1258372\/\" id=\"a_1\">Sections 147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_1\">148<\/a>, <a href=\"\/doc\/455468\/\" id=\"a_2\">307<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a> and <a href=\"\/doc\/455468\/\" id=\"a_4\">307<\/a>\/<a href=\"\/doc\/999134\/\" id=\"a_5\">149<\/a> I.P.C. and <a href=\"\/doc\/1961417\/\" id=\"a_6\">Sections 25<\/a>(1-B), 26\/27<br \/>\n                 of the <a href=\"\/doc\/1934415\/\" id=\"a_7\">Arms Act<\/a> and 3\/5 of the Explosive Substance Act.\n<\/p>\n<p id=\"p_2\">                              The prosecution story is that on 29.03.1991, i.e. 20 years ago, at<br \/>\n                 about 7.00 a.m. all the accused armed with pistols, bombs, lathi and Farsa<br \/>\n                 surrounded the house of the victim. Several bombs were exploded, according to<br \/>\n                 the prosecution case, however, there is one single injury of lathi. Although it has<br \/>\n                 been alleged that some splinter injuries were also received by some other<br \/>\n                 persons but no injury report was brought on record, neither the Doctor who had<br \/>\n                 examined the injuries was examined as a prosecution witness.               In the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                               2.<\/span><br \/>\n      circumstances, the trial Court has acquitted the accused in this case of large<br \/>\n      scale implication of as many as 11 accused.\n<\/p>\n<p id=\"p_3\">                   Considering the above facts, we are of the opinion that this<br \/>\n      judgment of acquittal does not call for any interference. Accordingly, this appeal<br \/>\n      against the acquittal is dismissed.\n<\/p>\n<p id=\"p_4\">                                                           (Sushil Harkauli, J.)<\/p>\n<p>                                                            (R.R.
