Of Post Offices\n                                Department of Post\n                                Ujjain- 456 010\n\nBackground<\/pre>\n<p id=\"p_1\">1.   The RTI request was filed on 4.2.08. The Appellant requested for<br \/>\n     certified copies of the MIS Account that she had opened at the Post<br \/>\n     Office, Behugarh, Extra Departmental Sub Office (EDSO), Ujjain (MP).<br \/>\n     This MIS account amounting to Rs.12,000\/- was opened on 4.2.04.<br \/>\n     The CPIO replied on 3.3.08 stating that the information cannot be<br \/>\n     provided as per Section 8(1) (g) of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. He did not given any<br \/>\n     other reason for denial of information to the appellant. The Appellant<br \/>\n     filed her first appeal on 28.3.08 reiterating her request for the<br \/>\n     information. The Appellate Authority replied on 30.4.08, upholding the<br \/>\n     CPIO&#8217;s decision but   stating that the denial of information ought to<br \/>\n     have based on <a href=\"\/doc\/1001313\/\" id=\"a_1\">Section 8(1)<\/a> (h) instead of 8(1) (g) of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>. The<br \/>\n     Appellant filed her second appeal before the CIC on 26.7.08.      She<br \/>\n     stated that the officers of the postal department had willfully denied<br \/>\n     her information and once again reiterated her request for payment of<br \/>\n     Rs. 12000 which she has deposited in the MIS account.\n<\/p>\n<p id=\"p_1\">2.   The Bench of Mrs. Annapurna Dixit, Information Commissioner, heard<br \/>\n     the matter on November 05, 2008.\n<\/p>\n<p id=\"p_2\"> 3.   The Appellant was not present at the hearing.\n<\/p>\n<p id=\"p_3\">4.   Mr. H.C. Khadse, SSPOS &amp; CPIO, Ujjain, Mr. L.K. Mitthankheehwak,<br \/>\n     ASPOS, Indore and Mr. Ravindra Sharma, ACPIO represented the<br \/>\n     Public Authority.\n<\/p>\n<p id=\"p_4\">Decision<\/p>\n<p id=\"p_5\">5.   The   Respondents    submitted   that   the   Appellant   had   deposited<br \/>\n     Rs.12,000\/- with    Mr. Sanjay Saxena, Post Master, Behugarh, Extra<br \/>\n     Departmental Sub Office (EDSO), Ujjain (MP) and that the Post master<br \/>\n     instead of opening the MIS account ,opened a Saving Bank Account for<br \/>\n     Rs.60 in the name of the Appellant without the Appellant&#8217;s consent and<br \/>\n     pocketed the remaining amount. The respondents also stated that the<br \/>\n     Postmaster is involved in several other such fraud cases and that an<br \/>\n     FIR had been lodged against him and a criminal case is pending<br \/>\n     against him. At present Mr. Sanjay Saxena is out of the prison on bail.<br \/>\n     The respondents further submitted that they do not have any records<br \/>\n     relating to the appellants MIS Account and that all they possess are<br \/>\n     documents related to the Rs.60\/- Saving Bank Account that was<br \/>\n     opened by Mr. Sanjay Saxena.\n<\/p>\n<p id=\"p_6\">6.   The Commission directs the CPIO to provide an affidavit to the<br \/>\n     Appellant stating that the Post Office in Ujjain has no record related to<br \/>\n     the Appellant&#8217;s MIS Account and send a copy of the same to the<br \/>\n     Commission. The CPIO is also directed to provide certified copies of all<br \/>\n     documents related to the Savings Account of the Appellant including<br \/>\n     the receipts for Rs.60, relevant pages from the ledger book, Pay-in-<br \/>\n     Slip, index card etc. to the Appellant. All information to be provided to<br \/>\n     the Appellant within 10 days of the receipt of this Order.\n<\/p>\n<p id=\"p_7\"> 7.
