Shukla, J.\n<\/pre>\n<p id=\"p_1\">      Present writ petition has been filed by the petitioner questioning the<br \/>\nvalidity of the order dated 6.11.2009 passed by the respondent no.1 wherein<br \/>\napplication under Section 88C(2) moved by the petitioner has been rejected.\n<\/p>\n<p id=\"p_1\">      Brief background of the case is that Motor Accident Claim petition No.<br \/>\n96 of 1997 had been filed Vijendra Singh Versus Shailendra Kumar and<br \/>\nanother. Petitioner claims that Tractor in question on account of which<br \/>\naccident had taken place on 4.12.1996 same had already been sold in favour<br \/>\nof Bhuri Singh Yadav. Petitioner has been trying to contend that once tractor<br \/>\nin question had been sold then liability in respect of claim is to be fastened on<br \/>\nthe shoulder of Bhuri Singh Yadav. In the claim petition, petitioner&#8217;s case has<br \/>\nbeen that Tractor in question was got released in favour of Bhuri Singh Yadav<br \/>\nwhereas fact of the matter is that he has never moved an application for<br \/>\nrelease of the tractor and entire manipulation has been made by the Bhuri<br \/>\nSingh Yadav. Petitioner had moved an application for expert opinion of the<br \/>\ndisputed signature. Said application was rejected on 1.9.2006. Against the<br \/>\nsame, petitioner preferred Civil Misc. Writ Petition No. 54500 of 2006 and this<br \/>\ncourt passed order after noticing the fact that though impugned order, expert<br \/>\nopinion has been rejected, file of criminal case was summoned. Relevant<br \/>\nextract of the said judgement is being extracted below:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8221; In my opinion there is absolutely nothing wrong in the<br \/>\n            impugned order. If the petitioner had any grievance he<br \/>\n            could approach the criminal Court which released the<br \/>\n            Tractor. No Court except a higher court hearing appeal ,<br \/>\n            revision etc. can decide the correctness or otherwise of<br \/>\n            the proceedings of another Court. In the impugned order<br \/>\n            it has repeatedly been held that the question as to<br \/>\n            whether before the date of accident the petitioner had<br \/>\n            already transferred the tractor on 28.12.1988 to Udai Vir<br \/>\n            Singh respondent no.8, who thereafter transferred the<br \/>\n            same to respondent no.9 or not would be decided after<br \/>\n            evidence. The apprehension that only on the basis of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                          2<\/span><\/p>\n<p>             release order in favour of petitioner, it will be held that at<br \/>\n             the time of accident the tractor belonged to the petitioner<br \/>\n             is unfounded. As already held in the impugned order, this<br \/>\n             question will be decided after the evidence.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                     It is made abundantly clear that each and every<br \/>\n             point raised by the petitioner shall be specifically dealt<br \/>\n             with by the Claims Tribunal in its final judgment, the<br \/>\n             findings must be recorded after appraisal of entire<br \/>\n             evidence and the petitioner must be permitted to adduce<br \/>\n             full evidence.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                     Writ petition is, therefore, dismissed.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">      Thereafter, petitioner moved an application and therein prayer was<br \/>\nmade to accept the evidence and for cross examination, said application was<br \/>\nconsidered and was rejected on 3.10.2007. Thereafter, again application for<br \/>\nreview had been moved with the same prayer and same has been rejected. At<br \/>\nthis juncture present writ petition has been filed.\n<\/p>\n<p id=\"p_3\">       Sri Mahesh Narain Singh, learned counsel for the petitioner contended<br \/>\nwith vehemence that in the present case, for the end of justice for doing<br \/>\ncomplete justice in between the parties, such application ought to have been<br \/>\nallowed and as such writ petition be entertained and accordingly allowed.\n<\/p>\n<p id=\"p_4\">      After respective arguments have been advanced, undisputed factual<br \/>\nposition, which has emerged in the present case is that petitioner had moved<br \/>\nan application for expert opinion on the disputed signature and same was<br \/>\nrejected on 1.9.2006 and said order has been affirmed by this court in Civil<br \/>\nMisc. Writ Petition No. 54500 of 2006. In the said order it was made clear that<br \/>\napprehension of the petitioner that challenge on the basis of release in favour<br \/>\nof the petitioner, that at the time of accident tractor belongs to the petitioner is<br \/>\nunfounded. It was made clear that said question will be decided after the<br \/>\nevidence, and it was also mentioned that each and every aspect of the matter<br \/>\nraised by the petitioner, shall be specifically dealt with in its final judgment and<br \/>\nfinding must be recorded after appraisal of the evidence and petitioner must<br \/>\nbe provided opportunity of hearing for adducing evidence. After the said order<br \/>\nhas been passed, on 9.10.2006 again coining the said prayer though in<br \/>\ndifferent manner, application was moved, which had been rejected on<br \/>\n22.10.2007 and then review application has also been rejected on 6.11.2009.<br \/>\nInterest of petitioner has been fully protected by this court.         Whatsoever<br \/>\nspecific prayer has been made by the petitioner in the application and what<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                           3<\/span><\/p>\n<p>would be its impact, and as to whether same will have material peacing will<br \/>\nbe considered by the claim tribunal. At each stage when proceeding are en<br \/>\nroute, it is not at all appropriate to interfere with the same.\n<\/p>\n<p id=\"p_5\">      Consequently in the facts of the present case whatsoever points are<br \/>\nbeing sought to be raised by the petitioner by filing present writ petition, it<br \/>\nwould be open to the petitioner to raise before the claim tribunal at the point of<br \/>\ntime of final judgment being passed by advancing arguments and then at the<br \/>\nsaid point of time each and every aspect of the matter shall be considered by<br \/>\nthe tribunal while delivering the final judgment.\n<\/p>\n<p id=\"p_6\">      With these observations, writ petition is disposed of.\n<\/p>\n<p id=\"p_7\">Dt.13.01.2010<br \/>\nT.S.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Shailendra Kumar Singh vs Motor Accidents Claim &#8230; on 13 January, 2010 Court No. 21 Civil Misc.
