(J)\n\nCITATION:\n 1981 AIR 1915\t\t  1982 SCR  (1) 353\n 1981 SCC  (4) 102\t  1981 SCALE  (3)1246\n CITATOR INFO :\n R\t    1984 SC 160\t (2)\n\n\nACT:\n     Indian  Police   Service  (Appointment   by  Promotion)\nRegulations  1955-Regulation  5(5)-Scope  of-Police  officer\nreverted to  a lower  rank-Reasons  for\t reversion-  Whether\nnecessary to record.\n\n\n\nHEADNOTE:\n     On being  selected by a Selection Committee constituted\nunder the  Indian Police  Service (Appointment by Promotion)\nRegulations, 1955  the appellant, a Deputy Superintendent of\nPolice\tprior\tto  13th   April,  1960,   was\tpromoted  as\nSuperintendent of Police.\n     In September,  1963, purporting to act under regulation\n5 of  the Regulations,\tthe Selection  Committee recommended\nhis supersession, along with some others, on the ground that\nthe Committee  considered that\tthe records of \"the officers\nwere not  such as to justify their appointment to the Indian\nPolice Service at this stage\". He was reverted in September.\n1964.\n     Before the\t High Court the appellant contended that the\nSelection Committee's failure to specify the reasons for his\nsupersession, in  contravention of the Regulations, rendered\nthe list non est. This plea was rejected.\n     Allowing the appeal:\n^\n      HELD:  The Select\t List reverting\t the appellant\tto a\nlower post  prepared in\t accordance with the recommendations\nof the\tSelection Committee  contravened the mandate in sub-\nregulation (5) of Regulation 5. [358 G]\n     Regulation 5(5)  imposed  a  mandatory  duty  upon\t the\nSelection Committee  to record\tits reasons for the proposed\nsupersession. In  the context of the protection conferred on\npublic servants by articles 14 and 16 of the Constitution it\nwas incumbent  on the  Selection Committee  to\thave  stated\nreasons in  a manner  which would disclose how the record of\neach officer  superseded stood in relation to the records of\nothers who  were to  be preferred.  This is the only visible\nsafeguard against  possible injustice  and arbitrariness  in\nmaking selections.  Had that  been done\t it would  have been\npossible to correlate facts on service records considered by\nthe Selection  Committee with  the conclusions reached. [358\nC]\n354\n     Reasons which  are the  links between  the materials on\nwhich  certain\t conclusions  are   based  and\t the  actual\nconclusions disclose  how the mind is applied to the subject\nmatter for  a decision,\t They should reveal a rational nexus\nbetween the  facts considered  and the\tconclusions reached.\n[358 <a href=\"\/doc\/714743\/\" id=\"a_1\">E]\n     Union of India v. Mohan Lal Capoor &amp; Ors<\/a>., [1974] 1 SCR\n797; applied.\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">     CIVIL APPELLATE  JURISDICTION: Civil Appeal No. 2173 of<br \/>\n1970.\n<\/p>\n<p id=\"p_1\">     From the judgment and order dated 29th October, 1969 of<br \/>\nthe Madhya  Pradesh High  Court in  Misc. Petition No. 89 of<br \/>\n1967.\n<\/p>\n<p id=\"p_2\">     Gyan  Chand   Mathur  and\t A.G.  Ratnaparkhi  for\t the<br \/>\nAppellant.\n<\/p>\n<p id=\"p_3\">     D.P. Mohanty and R.A. Shroff for Respondent No. 1.<br \/>\n     The judgment of the Court was delivered by<br \/>\n     KOSHAL J.\tThis is\t an appeal by certificate granted by<br \/>\nthe High  Court of  Madhya Pradesh  against a  judgment of a<br \/>\nlearned Single\tJudge of  that Court dismissing with costs a<br \/>\npetition filed by the present appellant under <a href=\"\/doc\/1712542\/\" id=\"a_1\">article 226<\/a> of<br \/>\nthe Constitution  of India challenging his demotion from the<br \/>\npost  of   Superintendent  of\tPolice\tto  that  of  Deputy<br \/>\nSuperintendent of Police.\n<\/p>\n<p id=\"p_4\">     2. The  facts giving  rise to  the dispute\t between the<br \/>\nappellant and  the State  of Madhya Pradesh are now admitted<br \/>\non all\thands and may be briefly stated. Prior to 13th April<br \/>\n1960 the  appellant was a member of the Madhya Pradesh State<br \/>\nPolice Service and was working as a Deputy Superintendent of<br \/>\nPolice. On  that date  a meeting  of the Committee set up in<br \/>\naccordance with\t regulation 3  of the  India Police  Service<br \/>\n(Appointment by\t Promotion) Regulations,  1955\t(hereinafter<br \/>\ncalled the Regulations) was held, and therein was prepared a<br \/>\nlist of\t such members  of the  State Police  Service as were<br \/>\neligible and  suitable for  promotion to  the Indian  Police<br \/>\nService. The  said  Committee  is  popularly  known  as\t the<br \/>\n&#8220;Selection  Committee&#8221;\t and  will   be\t  so   referred\t  to<br \/>\nhereinafter. The  list was  approved  by  the  Union  Public<br \/>\nService Commission  and\t thus  became  the  Select  List  as<br \/>\nenvisaged in  regulation 7 of the Regulations. The appellant<br \/>\nwas accordingly\t promoted to  the Indian  Police Service and<br \/>\nwas posted  as a  Superintendent of Police which position he<br \/>\nheld till  the impugned reversion effected by an order dated<br \/>\n11th September, 1964. The reason for that reversion was that<br \/>\non the 18th of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">355<\/span><br \/>\nSeptember 1963\tthe Selection  Committee reviewed the Select<br \/>\nList, A purporting to act in accordance with regulation 5 of<br \/>\nthe Regulations\t and recommended  that the  appellant and 27<br \/>\nothers be  superseded The  sole ground\tfor the supersession<br \/>\nwas thus stated by the Selection Committee:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>\t  &#8220;The\tCommittee   consider  that,  on\t an  overall<br \/>\n     assessment, the  records of these officers are not such<br \/>\n     as to  justify their  appointment to  the Indian Police<br \/>\n     Service at this stage.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">      3.  The reversion\t of  the  appellant  was  challenged<br \/>\nbefore the  High Court\twith the  contention inter alia that<br \/>\nthe ground set out by the Selection Committee in that behalf<br \/>\ndid not\t specify any  reason, good,  bad or indifferent, for<br \/>\nhis supersession, that under regulation 5 of the Regulations<br \/>\nit was duty of the Selection Committee to record reasons and<br \/>\nthat not having been done the review of the Select List made<br \/>\non the\t18th of September, 1963 was clearly in contravention<br \/>\nof the\tRegulations and,  therefore, as\t good as non-est. Th<br \/>\ncontention was\tturned down  by the  learned Single Judge of<br \/>\nthe High Court, who dismissed the appellant&#8217;s petition, with<br \/>\nthe following observations:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>\t  &#8220;The\tcontention   of\t learned   counsel  for\t the<br \/>\n     applicant\tthat   the  giving  of\treasons\t under\tsub-<br \/>\n     regulation (5)  of\t regulation  5\tfor  superseding  an<br \/>\n     officer makes the order justiciable, does not appeal to<br \/>\n     us. It  is not for the Court to see whether the reasons<br \/>\n     given by the Committee are sufficient or not, but it is<br \/>\n     for the State Government and the Central Public Service<br \/>\n     Commission to see the sufficiency of the reasons.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">      The  contention  thus  rejected  has  been  reiterated<br \/>\nbefore us.\n<\/p>\n<p id=\"p_7\">     4. Regulations  5 and  7  of  the\tRegulations  may  be<br \/>\nreproduced here with advantage:\n<\/p>\n<blockquote id=\"blockquote_2\"><p>     &#8220;5. Preparation of a list of suitable officers.<br \/>\n     (1) The  Committee shall prepare a list of such members<br \/>\n\t  of  the   State  Police  Service  as\tsatisfy\t the<br \/>\n\t  condition specified  in regulation  4 and  as\t are<br \/>\n\t  held by the Committee to be suitable for promotion<br \/>\n\t  to the Service.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_1\">356<\/span><\/p>\n<blockquote id=\"blockquote_3\"><p>     (2)  The selection\t for inclusion in such list shall be<br \/>\n\t  based on  merit and  suitability in  all  respects<br \/>\n\t  with due regard to seniority.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     (3)  The names  of the  officers included\tin the\tlist<br \/>\n\t  shall be  arranged in\t order of  seniority in\t the<br \/>\n\t  State Police Service;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>\t       Provided that  any junior  officer who in the<br \/>\n\t  opinion of  the Committee  is of exceptional merit<br \/>\n\t  and suitability  may be  assigned a  place in\t the<br \/>\n\t  list higher than that of officers senior to him.<br \/>\n     (4)  The list so prepared shall be reviewed and revised<br \/>\n\t  every year.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>     (5)  If in the process of selection, review or revision<br \/>\n\t  it is\t proposed to  supersede any  members of\t the<br \/>\n\t  State Police\tService, the  Committee shall record<br \/>\n\t  its reasons for the proposed supersession.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>     7.\t  Select List.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>     (1)  The Commission shall consider the list prepared by<br \/>\n\t  the  Committee  along\t with  the  other  documents<br \/>\n\t  received from\t the State Government and, unless it<br \/>\n\t  considers any change necessary, approve the list.<br \/>\n     (2)  If the  Commission consider  it necessary  to make<br \/>\n\t  any changes  in the  list received  from the State<br \/>\n\t  Government, the  Commission shall inform the State<br \/>\n\t  Government  of  the  changes\tproposed  and  after<br \/>\n\t  taking into  account the  comments, if any, of the<br \/>\n\t  State Government,  may approve  the  list  finally<br \/>\n\t  with such  modification, if  any, as\tmay, in\t its<br \/>\n\t  opinion, be just and proper.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>     (3)  The list  as finally\tapproved by  the  Commission<br \/>\n\t  shall form  the Select  List of the members of the<br \/>\n\t  State Police Service.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>     (4)  The Select List shall ordinarily be in force until<br \/>\n\t  it is\t reviewed or revised in accordance with sub-<br \/>\n\t  regulation (4) of regulation 5:\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_2\">356<\/span><\/p>\n<blockquote id=\"blockquote_11\"><p>\t       Provided that  in the  event of a grave lapse<br \/>\n\t  in the  conduct or  performance of  duties on\t the<br \/>\n\t  part of  any member  of the  State Police  Service<br \/>\n\t  included in  the Select  List, a special review of<br \/>\n\t  the Select  List may\tbe made\t at any\t time at the<br \/>\n\t  instance  of\t the  State   Government   and\t the<br \/>\n\t  Commission may.  if it  so thinks  fit, remove the<br \/>\n\t  name of  such member\tof the\tState Police Service<br \/>\n\t  from the Select List.&#8221;<\/p><\/blockquote>\n<p id=\"p_8\">     It is  not disputed  that a Select List may be reviewed<br \/>\nas stated  in sub-regulation  (4) of  regulation 7 read with<br \/>\nsub-regulation (5)  of regulation  5. So  all that has to be<br \/>\ndetermined is  whether the  Selection Committee was bound to<br \/>\ngive reasons  for the  supersession  of\t the  appellant\t and<br \/>\nwhether the  note recorded  by it  which sets out the ground<br \/>\nfor supersession does give any reason at all.\n<\/p>\n<p id=\"p_9\">     The matter\t is really  covered by\ta decision  of\tthis<br \/>\nCourt in  <a href=\"\/doc\/714743\/\" id=\"a_2\">Union of  India v. Mohan Lal Capoor and others<\/a>. In<br \/>\nthat case also the ground set out by the Selection Committee<br \/>\nfor the proposed supersession was:\n<\/p>\n<blockquote id=\"blockquote_12\"><p>\t  &#8220;On an  over all  assessment, the records of these<br \/>\n     officers are  not such  as to justify their appointment<br \/>\n     to\t the  Indian  Administrative  Service\/Indian  Police<br \/>\n     Service at this stage in preference to those selected.&#8221;<br \/>\n     Except for\t the words &#8220;in preference to those selected&#8221;\n<\/p><\/blockquote>\n<p id=\"p_10\">the ground  just above\tset out is identical with the ground<br \/>\ngiven  by  the\tSelection  Committee  in  the  case  of\t the<br \/>\nappellant. Rejecting  this ground  as being  no statement of<br \/>\nreasons\t within\t  the  meaning\t of  sub-regulation  (5)  of<br \/>\nregulation 5, Mathew, J., speaking for the Court, observed:\n<\/p>\n<blockquote id=\"blockquote_13\"><p>\t  &#8220;We next  turn to  the provisions  of Regulation 5<br \/>\n     (5)  imposing  a  mandatory  duty\tupon  the  Selection<br \/>\n     Committee\tto   record  &#8220;its   reasons   for   proposed<br \/>\n     supersession&#8221;.  We\t  find\tconsiderable  force  in\t the<br \/>\n     submission made  on behalf\t of the respondents that the<br \/>\n     &#8220;rubber-stamp&#8221;  reason   given  mechanically   for\t the<br \/>\n     supersession  of\teach  officer  does  not  amount  to<br \/>\n     &#8220;reasons for the proposed supersession.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_3\">358<\/span><\/p>\n<blockquote id=\"blockquote_14\"><p>     the most  that could  be said  for the  stock reason is<br \/>\n     that it is a general description of the process adopted<br \/>\n     in arriving  at a\tconclusion. This apology for reasons<br \/>\n     to\t be   recorded\tdoes  not  go  beyond  indicating  a<br \/>\n     conclusion in  each case that the record of the officer<br \/>\n     concerned is not such as to justify his appointment &#8220;at<br \/>\n     this stage in preference to those selected&#8221;.<br \/>\n\t  &#8220;In the  context of  the effect upon the rights of<br \/>\n     aggrieved persons,\t as members  of a public service who<br \/>\n     are entitled  to  just  and  reasonable  treatment,  by<br \/>\n     reason of\tprotections conferred  upon them by articles<br \/>\n     14 and  16 of  the Constitution, which are available to<br \/>\n     them throughout  their service, it was incumbent on the<br \/>\n     Selection Committee  to have stated reasons in a manner<br \/>\n     which would  disclose how\tthe record  of each  officer<br \/>\n     superseded stood  in relation  to records of others who<br \/>\n     were  to\tbe  preferred,\t particularly  as   this  is<br \/>\n     practically  the\tonly  remaining\t  visible  safeguard<br \/>\n     against possible  injustice and arbitrariness in making<br \/>\n     selections. If  that had  been done,  facts on  service<br \/>\n     records  of   officers  considered\t  by  the  Selection<br \/>\n     Committee would have been correlated to the conclusions<br \/>\n     reached. Reasons are the links between the materials on<br \/>\n     which certain  conclusions are  based  and\t the  actual<br \/>\n     conclusions. They\tdisclose how  the mind is applied to<br \/>\n     the subject  matter for a decision whether it is purely<br \/>\n     administrative or\tquasi-judicial. They should reveal a<br \/>\n     rational nexus  between the  facts considered  and\t the<br \/>\n     conclusions reached.  Only in  this way can opinions or<br \/>\n     decisions recorded\t be shown  to be manifestly just and<br \/>\n     reasonable. We  think that it is not enough to say that<br \/>\n     preference should\tbe given  because a  certain kind of<br \/>\n     process was  gone through\tby the\tSelection Committee.<br \/>\n     This is  all that\tthe supposed  statement\t of  reasons<br \/>\n     amounts to.  We, therefore,  think that  the  mandatory<br \/>\n     provisions of Regulation 5 (5) were not complied with.&#8221;<\/p><\/blockquote>\n<p id=\"p_11\">      With  respect we\tfully agree and hold that the Select<br \/>\nList prepared  in accordance with the recommendations of the<br \/>\nSelection Committee  made in its meeting held on the 18th of<br \/>\nSeptember 1963\tcontravened the\t mandate in sub-regulation 5<br \/>\nof regulation 5.\n<\/p>\n<p id=\"p_12\">     5. In  the result\twe accept  the appeal, set aside the<br \/>\nimpugned judgment  and quash  the  Select  List\t just  above<br \/>\nmentioned in so far<br \/>\n<span class=\"hidden_text\" id=\"span_4\">359<\/span><br \/>\nas it  relates to  the appellant,  as also  the order of his<br \/>\nreversion.  He\t shall\tbe  entitled  to  all  consequential<br \/>\nbenefits even  though he  has since retired from service.
