ANAND, J.\n<\/pre>\n<p id=\"p_1\">            The respondent-accused was exonerated by the learned Trial<\/p>\n<p>Judge of the charge of having been found in possession of 6 Kgs. of opium.<\/p>\n<p>He was apprehended by the police on 8.7.1989 in the area of village Sandli.<\/p>\n<p id=\"p_1\">            The learned Trial Judge recorded the impugned verdict of<\/p>\n<p>acquittal on the premise    that the only independent witness ( Sukhdev<\/p>\n<p>Singh) had not been examined at the trial, the grounds of arrest had not<\/p>\n<p>been indicated to the respondent\/accused and the Investigating Officer DSP<\/p>\n<p>Harbhajan Singh PW-2 had not even prepared an inventory of contraband<\/p>\n<p>allegedly recovered from the possession of the respondent\/accused. In that<\/p>\n<p>very context, learned trial Judge noticed the variations in the inter-se<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Appeal No. 61-DBA of 2000                    -2-<\/span><\/p>\n<p>                               ****<\/p>\n<p>statements of PW-1 HC Joginder Pal and PW-2 DSP Harbhajan Singh on<\/p>\n<p>point of availability of weighing scale and weights. While the former told<\/p>\n<p>the Court that scale and the weights were already available in the<\/p>\n<p>investigating bag; the latter indicated that the weighing scale and the<\/p>\n<p>weights were brought by a Constable from village Fatta Maluka.<\/p>\n<p id=\"p_2\">            We have examined the finding, and also the reasoning recorded<\/p>\n<p>in support thereof on the touch stone of the parameters laid down by the<\/p>\n<p>Apex Court in Ramesh Babulal Vs. State of Gurarat, AIR 1996 SC<\/p>\n<p>2035, Jaswant Singh Vs. State of Haryana AIR 2000 SC 1833 and Main<\/p>\n<p>Pal Vs. State of Haryana AIR 2004 SC 2158 for adjudication of a such<\/p>\n<p>like controversy.\n<\/p>\n<p id=\"p_3\">            We find that the reasoning adopted by the learned Trial Judge<\/p>\n<p>cannot be faulted on any valid score.\n<\/p>\n<p id=\"p_4\">            Dismissed.<\/p>\n<pre id=\"pre_1\">\n\n                                            ( S.
