Misra, J.\n<\/p>\n<p id=\"p_1\"> 1. This is an appeal directed<br \/>\nagainst the order dated 3-2-65<br \/>\npassed by the learned Subordinate<br \/>\nJudge, Berhampur, directing recovery of<br \/>\npossession of certain properlies which had<br \/>\nbeen sold away by the ex-receiver in<br \/>\nfavour of the appellants without authority of<br \/>\nthe court.\n<\/p>\n<p id=\"p_2\"> 2. In T. S. No. 23 of 1943<br \/>\nthere was a compromise in April 1951.<br \/>\nThe subject matter of the title suit<br \/>\nrelated to vast immovable properties and a<br \/>\nrunning business. Receivers were appointed<br \/>\nto be in charge of the properties. Damodar<br \/>\nSahu, a member of the family, came to be<br \/>\nappointed as a receiver. In February,<br \/>\n1959 Damodar appointed an authorised<br \/>\nagent and in [July, 1959 there were a<br \/>\nnumber of transfers under which properties<br \/>\nwhich were the subject matter of the<br \/>\nlitigation and in respect of which receiver<br \/>\nhad been appointed were alienated in<br \/>\nfavour of a number of persons. In April,<br \/>\n1961 Damodar was discharged from<br \/>\nreceivership. , An application was made in<br \/>\nthe court of the learned Subordinate<br \/>\nJudge purporting to be under Order 40,<br \/>\nRule 1 read with Section 151, Civil P. C.<br \/>\non 6-11-63 by Dayanidhi Sahu who<br \/>\nhappens to be a party and receiver for<br \/>\neviction of the transferees and for recovery<br \/>\nof possession of the properties. As it<br \/>\nappears from the schedule, the extent of<br \/>\nproperties transferred was about 88 acres.<br \/>\nThe learned Subordinate Judge called<br \/>\nupon the transferees to file their objection<br \/>\nand many of them appeared and contested<br \/>\nthe proceeding. The learned Subordinate<br \/>\nJudge took into consideration the various<br \/>\ncontentions raised on behalf of the<br \/>\ntransferee-opposite parties. Their first<br \/>\ncontention was that the petitioner had no<br \/>\nlocus standi. Secondly they contended that<br \/>\nthe petition was not maintainable in law<br \/>\nwithout impleading the State of Orissa as a<br \/>\nparty mainly on account of the fact that<br \/>\nsome of the properties had vested in the<br \/>\nState of Orissa by operation of law under<br \/>\nAct I of 1952. The third contention was<br \/>\nthat the estate having already vested in the<br \/>\nState Government the relief for eviction<br \/>\nwas not maintainable. All these contentious<br \/>\nwere negatived by the learned<br \/>\nSubordinate Judge and he came to hold<br \/>\nthat the sale deeds were illegal and void,<br \/>\nand the respondents were liable to be<br \/>\nevicted from the disputed lands. He<br \/>\naccordingly called upon the transferees to<br \/>\nmake over the vacant possession of the<br \/>\ndisputed properties under their possession<br \/>\nto the petitioner receiver within a month<br \/>\nfrom the date of the order failing which<br \/>\nthe receiver was permitted to take<br \/>\npossession by execution.\n<\/p>\n<p id=\"p_3\"> 3. The appeal in this Court has<br \/>\nbeen dismissed as against respondents .2,<br \/>\n3, 7, 15<\/p>\n<p>to 21, 22 and 25 by two separate<br \/>\norders being orders Nos. 17 and 29.<br \/>\nThe dismissal of this appeal may not lead<br \/>\nto total abatement on account of the fact<br \/>\nthat the alienations which were attacked in<br \/>\nthe proceeding were different and the<br \/>\ncauses of action were independent and<br \/>\nseverable. As it appears, these<br \/>\nrespondents are also alienees who have not<br \/>\njoined in the appeal as appellants.\n<\/p>\n<p id=\"p_4\"> 4. Mr. Mohanty, learned counsel<br \/>\nfor the appellants raised two contentions.<br \/>\nAccording to him, in a summary<br \/>\nproceeding of this nature title to the<br \/>\ndisputed properties should not have been<br \/>\ngone into and concluded. He further<br \/>\ncontends that a reasonable and adequate<br \/>\nopportunity of contest has not been given<br \/>\nto the alienees. Even the documents which<br \/>\nthey had filed in the court below, as would<br \/>\nappear from the impugned order, were<br \/>\nnot exhibited and taken into account to find<br \/>\nout whether the title that has been<br \/>\nconveyed to the alienees should be<br \/>\nsustained or not. According to him,<br \/>\nwhile the general title in respect of the<br \/>\ndisputed properties was the subject-<br \/>\nmatter of litigation in the partition suit in<br \/>\nwhich receivers had been appointed, in<br \/>\nconsequence of different statutes coming<br \/>\ninto force like the temporary tenancy<br \/>\nlegislations and the Orissa Estates Abolition<br \/>\nAct different consequences had arisen and<br \/>\nthe learned Subordinate Judge should<br \/>\nat least have applied his mind to find out<br \/>\nthe incidence of these statutes on the<br \/>\ndisputed properties and should have<br \/>\nfurther examined as to whether the alienor<br \/>\nDamodar Sahu had any personal interest in<br \/>\nthese properties which could be duly<br \/>\nconveyed under the various sale deeds. To<br \/>\nsupport his contention he makes<br \/>\nreference to some comments in<br \/>\nWoodroffe&#8217;s Tagore Law Lecture on the<br \/>\nlaw Relating to Receivers. He also seeks to<br \/>\nplace reliance on an observation of their<br \/>\nLordships of the Supreme Court in AIR<br \/>\n1958 SC 725, <a href=\"\/doc\/1232578\/\" id=\"a_1\">Kanhaiyalal v. Dr. D.<br \/>\nR. Banaji<\/a>.\n<\/p>\n<p id=\"p_5\"> 5. The contentions raised by Mr.<br \/>\nMohanty, however, cannot be sustained in<br \/>\nthe facts&#8217; of the present case. Admittedly<br \/>\nthe property was in custodia legis at the<br \/>\nmaterial point of time. Damodar may have<br \/>\nbeen a party with some interest in the dis-<br \/>\nputed property, but qua receiver he had no<br \/>\nright to alienate the properly without the<br \/>\nleave of the court. It is well known that a<br \/>\nreceiver holds property as an officer of the<br \/>\ncourt for the ultimate successful party |in a<br \/>\nlitigation. The position of a party receiver is<br \/>\nnot different in law. Ahmad, J. |in AIR<br \/>\n1959 Pat 582, <a href=\"\/doc\/1838098\/\" id=\"a_1\">Jamilur Rahaman v.<br \/>\nLaxmi Narayan<\/a> examined a case of this<br \/>\ntype and held, <\/p>\n<p> &#8220;In law it is well<br \/>\nestablished that in certain circumstances in<br \/>\nmatters like this the Court may resort to<br \/>\nsummary proceeding and award relief both<br \/>\nfor or against a third person who is not a<br \/>\nparty to the suit. This is based on the<br \/>\nprinciple that once a court<\/p>\n<p>is in possession of a property in custodia<br \/>\nlegis through a Receiver, it is the duty of the<br \/>\nCourt to see that the property is kept intact<br \/>\nand secure in the interests of those for<br \/>\nwhom the Court holds it.\n<\/p>\n<p id=\"p_6\"> Necessarily,  therefore, if     a  third<br \/>\nperson comes   to   deal   with   that<br \/>\nproperty   on   the basis  of a transaction<br \/>\nentered into  between him and the<br \/>\nCourt, either directly or through the<br \/>\nReceiver,  he,  by implication,  surrenders<br \/>\nhimself to the  Court so  far as the<br \/>\ntransaction  relating to  the property is<br \/>\nconcerned. &#8230;&#8230;Therefore,  to  that<br \/>\nextent,     it cannot<br \/>\nbe said that the Court had no jurisdiction to<br \/>\ndeal with the relief that was brought to its<br \/>\nnotice in that connection, though at the<br \/>\ninstance of the third party purchaser.&#8221;\n<\/p>\n<p id=\"p_7\">  On the aforesaid analysis I am not<br \/>\nprepared to accept the contentions of Mr.<br \/>\nMohanty. The impugned order is bound<br \/>\nto be sustained. The appeal fails and is<br \/>\ndismissed.
