The present interlocutory application has been preferred for the<br \/>\n      reasons that the condition upon which the anticipatory bail was<br \/>\n      granted to the petitioners vide order dated 28th August, 2010 in<br \/>\n      A.B.A. No. 2268 of 2010 has not been fulfilled by the present<br \/>\n      applicants and, therefore, the present interlocutory application has<br \/>\n      been preferred for modification of condition no. 4(a) of the order<br \/>\n      dated 28th August, 2010, which was imposed while granting<br \/>\n      anticipatory bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the Code of Criminal<br \/>\n      Procedure.\n<\/p>\n<p id=\"p_6\">2.    The present applicants are involved in the offence punishable under<br \/>\n      <a href=\"\/doc\/1599401\/\" id=\"a_1\">Sections 341<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_2\">323<\/a>, <a href=\"\/doc\/538436\/\" id=\"a_3\">498A<\/a>, <a href=\"\/doc\/1101188\/\" id=\"a_4\">379<\/a> and <a href=\"\/doc\/555306\/\" id=\"a_5\">504<\/a> of the Indian Penal Code, in<br \/>\n      pursuance of Complaint Case No. 7 of 2008, which is pending<br \/>\n      before the learned Chief Judicial Magistrate, Garhwa.\n<\/p>\n<p id=\"p_7\">3.    A.B.A. No. 2268 of 2010 was instituted, which was allowed on a<br \/>\n      condition by this Court on 28th August, 2010 that the applicants shall<br \/>\n      remain present before the court of learned Chief Judicial Magistrate,<br \/>\n      Garhwa on 13th September, 2010 between 10.00 a.m. to 3.00 p.m. It<br \/>\n      further appears from the facts of the case that the present applicants<br \/>\n      have violated the condition upon which the anticipatory bail was<br \/>\n      granted. They did not remain present before the concerned court i.e.<br \/>\n      before the court of learned Chief Judicial Magistrate, Garhwa. The<br \/>\n      reasons, stated in this interlocutory application, are not sufficient<br \/>\n      enough for remaining absent. Not to remain present on a particular<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                    2.<\/span><br \/>\n                  date before the court of learned Chief Judicial Magistrate, Garhwa,<br \/>\n                  and not to make themselves available before the Court tantamounts<br \/>\n                  to non-availability of the applicants before the court for trial.\n<\/p>\n<p id=\"p_8\">             4.   In view of the aforesaid facts, there is no substance in this<br \/>\n                  interlocutory application and hence the same is hereby dismissed.\n<\/p>\n<p id=\"p_9\">                                                          ( D.N.
