SIRI JAGAN, J.\n               - - - - - - - - - - - - - - - - - - - - - - -\n                  W.P.(C)No. 14718 of 2010\n               - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 24th day of May, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioner challenges Ext.P2 order passed by the<\/p>\n<p>District Collector directing the petitioner to pay an amount<\/p>\n<p>of Rs.1,00,000\/- being the value of the vehicle seized,<\/p>\n<p>towards River Management Fund, on a finding that the<\/p>\n<p>petitioner has used the vehicle for illegal transportation of<\/p>\n<p>river sand in violation of the Kerala Protection of River<\/p>\n<p>Banks and Regulation of Removal of Sand Act, 2001 &amp;<\/p>\n<p>Rules. The petitioner&#8217;s contention is that the consignment<\/p>\n<p>was supported by a valid pass which has been produced by<\/p>\n<p>the petitioner as Ext.P1. Petitioner therefore submits that<\/p>\n<p>Ext.P2 order without reference Ext.P1 is unsustainable.<\/p>\n<p id=\"p_1\">     2.   I have heard the learned Government Pleader<\/p>\n<p>also. He points out that as found by the District Collector,<\/p>\n<p>Ext.P1 is a pass for transportation of ordinary sand and in<\/p>\n<p>Ext.P2, the District Collector had got the sand examined by<\/p>\n<p>W.P.(C)No. 14718 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>the Geologist who reported that the same is of &#8216;riverine<\/p>\n<p>origin&#8217;.\n<\/p>\n<p id=\"p_2\">      3.    The counsel for the petitioner submits that no<\/p>\n<p>sample had been taken by the District Collector and no<\/p>\n<p>report of the Geologist has been obtained in respect thereof.<\/p>\n<p>The learned Government Pleader points out that there is no<\/p>\n<p>such contention in the writ petition.\n<\/p>\n<p id=\"p_3\">      4.    I have considered the rival contentions in detail.<\/p>\n<p id=\"p_4\">      5.    As rightly pointed out by the learned Government<\/p>\n<p>Pleader the petitioner has not chosen to make any averment<\/p>\n<p>to the effect that no examination of sand was got done by<\/p>\n<p>the Geologist as stated in Ext.P2 order. Without raising<\/p>\n<p>appropriate pleadings in the writ petition the petitioner<\/p>\n<p>cannot challenge Ext.P2 order on that ground. That being<\/p>\n<p>so, the contention raised by the petitioner cannot be<\/p>\n<p>countenanced. The District Collector found that the sand is<\/p>\n<p>river sand which has not been disputed by the petitioner.<\/p>\n<p>Admittedly Ext.P1 is a pass for transporting ordinary sand<\/p>\n<p>W.P.(C)No. 14718 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              3<\/span><\/p>\n<p>and not river sand. That being so, clearly the petitioner had<\/p>\n<p>been transporting river sand illegally as found by the<\/p>\n<p>District Collector. The vehicle has been got valued by the<\/p>\n<p>Joint Regional Transport Officer, which amount only has<\/p>\n<p>been directed to be paid towards River Management Fund,<\/p>\n<p>which is perfectly in accord with the Act and Rules.<\/p>\n<p>Therefore there is no infirmity whatsoever in Ext.P2 order.<\/p>\n<p>Accordingly the writ petition is dismissed.<\/p>\n<p id=\"p_5\">                                              S.
