PHUKAN\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">JUDGMENT<\/p>\n<p>2000 (2) SCR 272<\/p>\n<p>The Judgment of the Court was delivered by PHUKAN, J. Leave granted.\n<\/p>\n<p id=\"p_1\">The appellant challenged the order of detention dated 12 the April, 1999,<br \/>\npassed by the Commissioner of Police, Brihan Murnbai under sub-section (1)<br \/>\nof Section 3 of the Maharashtra Prevention of Dangerous Activities of<br \/>\nSlumlords, Bootleggers, Drug Offenders and Dangerous Persons Act, 1981 read<br \/>\nwith Government Order, Home Department (Special) dated 30th March, 1999,<br \/>\ndetaining the appellant with a view to prevent him from acting in any<br \/>\nmanner prejudicial to the maintenance of public order before the High Court<br \/>\nof Bombay by filing a writ petition which was dismissed and hence this<br \/>\nappeal.\n<\/p>\n<p id=\"p_2\">Before the High Court, the detention order was challenged on two grounds,<br \/>\nnamely (1) the documents supplied to the appellant were illegible and (2)<br \/>\nif the alleged prejudicial activities of the detenu were accepted on their<br \/>\nface value, they would demonstrate a breach of law and order and not public<br \/>\norder. The High Court rejected both the grounds. Before this Court only<br \/>\nground No. 2 has been canvassed. We may refer to some of the grounds of<br \/>\ndetention which require out consideration in view of the contentions raised<br \/>\non behalf of the appellant.\n<\/p>\n<p id=\"p_3\">In the grounds of detention, reference had been made to a criminal<br \/>\nproceeding registered against the appellant and his associates with<br \/>\nreference to occurrence which took place on 9.12.98. Harishchandra Gupta<br \/>\nwent near his place of business and noticed that his younger brother was<br \/>\nbeing assaulted by the appellant and his associates and when he rushed to<br \/>\nsee his brother, appellant and his associates assaulted him and when<br \/>\nHarishchandra Gupta and his brother sought for help, none dared to come<br \/>\nforward for their help.\n<\/p>\n<p id=\"p_4\">Gist of the statements of witnesses &#8220;A and B&#8221; recorded have been stated in<br \/>\nthe grounds of detention and their entire statement have also been produced<br \/>\nbefore this Court. From the statement of witness &#8220;A&#8221;, we find that \/the<br \/>\nappellant is a notorious goonda of the locality and with his associates<br \/>\nmoved about armed with deadly weapons and collected money from the<br \/>\nresidents and assaulted those who refused to pay. The appellant with his<br \/>\nassociates went to the fruit stall of this witness and took out a chopper<br \/>\nand started threatening him by using filthy language and on seeing the<br \/>\nincident the nearby vegetable and fruit vendors started running away with<br \/>\ntheir baskets. The passerby also ran away to fright. From the statement of<br \/>\nwitness &#8220;B&#8221;, we find that the appellant and his associates used to collect<br \/>\nmoney from the businessmen on threats of assault and out of fear of the<br \/>\nappellant none could dare to inform the police.\n<\/p>\n<p id=\"p_5\">This Court in <a href=\"\/doc\/918071\/\" id=\"a_1\">Amanulla Khan Kudeatalla Khan Pathan v. State of Gujarat and<br \/>\nOrs<\/a>., [1999] 5 SCC 613 considered the expression &#8220;acting in any manner<br \/>\nprejudicial to the maintenance of public order&#8221; and referring to earlier<br \/>\ndecision of this Court in <a href=\"\/doc\/341889\/\" id=\"a_1\">Mustakmiya Jabbarmiya Shaikh v. M.M. Mehta,<br \/>\nCommissioner of Police<\/a>, [1995] 3 SCC 237 held that the fallout and the<br \/>\nextent and reach of the alleged activities must be of such a nature that<br \/>\nthey travel beyond capacity of the ordinary law to deal with him or to<br \/>\nprevent his subversive activities affecting the community at large or a<br \/>\nsection of society and it is the decree of disturbance and its impact upon<br \/>\nthe even tempo of life of the society or the people of a locality which<br \/>\ndetermines whether the disturbance caused by such activity amounts only to<br \/>\na breach of &#8220;law and order&#8221; or it amounts to breach of &#8220;public order&#8221;.\n<\/p>\n<p id=\"p_6\">Mr. Jain, learned senior counsel for the appellant has urged that the above<br \/>\nactivities of the appellant were stray incidents and as such did not<br \/>\ndisturb the public order. Applying the above ratio to the grounds of<br \/>\ndetention, we find that the appellant extorted money from businessmen and<br \/>\nalso gave threats to the people the public place and thereby undoubtedly<br \/>\naffected the even tempo of life of the society, therefore, such activities<br \/>\ncannot be said to be mere disturbance of law and order. The contention of<br \/>\nMr. Jain has no force.\n<\/p>\n<p id=\"p_7\">Mr. Jain has further urged that the criminal proceeding which was started<br \/>\non the complaint of Harishchandra Gupta was under <a href=\"\/doc\/1599401\/\" id=\"a_2\">Sections 341<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_3\">323<\/a>, <a href=\"\/doc\/299470\/\" id=\"a_4\">334<\/a>,<br \/>\n<a href=\"\/doc\/555306\/\" id=\"a_5\">504<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_6\">506(II)<\/a> and <a href=\"\/doc\/37788\/\" id=\"a_7\">34<\/a> IPC and all these Sections were bailable and in fact<br \/>\nbail was granted and, therefore, this act cannot be said to disturb public<br \/>\norder. From the grounds of detention, we find that when Harishchandra Gupta<br \/>\nand his brother sought for help, none came forward for their help out of<br \/>\nfear of the appellant and this fact would show that the activities of the<br \/>\nappellant disturbed the life of the people of the area.\n<\/p>\n<p id=\"p_8\">In the grounds of detention, reference was made to the conviction of the<br \/>\nappellant under MRTP Act. According to Mr. Jain, this cannot be a ground<br \/>\nfor detention of the appellant. Mr. Dhabe, learned senior counsel for the<br \/>\nrespondent, has rightly submitted that reference was made to the above<br \/>\nconviction only to show the past criminal history of the appellant.\n<\/p>\n<p id=\"p_9\">Mr. Jain has further submitted that there was delay in passing the<br \/>\ndetention order. We find that the inquiry was completed during the last<br \/>\npart of February at the level of Deputy Commissioner of Police and the<br \/>\nfinal order was passed on 12.4.1999. It cannot be said that there was undue<br \/>\ndelay and action was being taken in a routine manner, as after completion<br \/>\nof inquiry matter had to be examined at various levels and finally the<br \/>\norders were passed by the Commissioner.\n<\/p>\n<p id=\"p_10\">For the reasons stated above we hold that the High Court rightly dismissed<br \/>\nthe petition and we find no reason to interfere with the order of the High<br \/>\nCourt.\n<\/p>\n<p id=\"p_11\">The appeal is dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Hasan Khan Ibne Haider Khan vs R.H.
