R.P.No.2697 of 2010\n        -----------------------------------------------------\n      Dated this the 13th day of September, 2010.\n\n\n                             O R D E R\n<\/pre>\n<p id=\"p_1\">     The accused in a prosecution for an offence u\/s.138 of<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable Instruments Act<\/a> is the revision petitioner, as he<\/p>\n<p>is aggrieved by the order of conviction and sentence<\/p>\n<p>imposed by the courts below.\n<\/p>\n<p id=\"p_1\">     2. The     case    of the      complainant       is that  the<\/p>\n<p>accused\/revision petitioner, towards the discharge of a debt<\/p>\n<p>due to the complainant, issued a cheque dated 26.08.2002<\/p>\n<p>for a sum of Rs.20,650\/- (Rupees Twenty thousand six<\/p>\n<p>hundred and fifty only), which when presented for<\/p>\n<p>encashment dishonoured and the cheque amount was not<\/p>\n<p>repaid inspite of a formal demand notice and thus the<\/p>\n<p>revision petitioner has committed the offence punishable<\/p>\n<p>u\/s.138 of <a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable Instruments Act<\/a>.             With the same<\/p>\n<p>allegation, the complainant approached the Judicial First<\/p>\n<p>Class Magistrate Court-II, Kollam, by filing a formal<\/p>\n<p>complaint, upon which cognizance was taken u\/s.138 of<\/p>\n<p>Crl. R.P.No.2697\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_2\">Negotiable Instruments Act<\/a> and instituted S.T.No.597\/2000.<\/p>\n<p>During the trial of the case, PW1 was examined from the<\/p>\n<p>side of the complainant and Exts.P1 to P7 were marked. No<\/p>\n<p>evidence either oral or documentary adduced from the side<\/p>\n<p>of the defense. On the basis of the available materials and<\/p>\n<p>evidence on record, the trial court has found that the<\/p>\n<p>cheque      in   question was    issued  by   the   revision<\/p>\n<p>petitioner\/accused for the purpose of discharging his debt<\/p>\n<p>due to the complainant. Thus accordingly the court found<\/p>\n<p>that, the complainant has established the case against the<\/p>\n<p>accused\/revision petitioner and consequently found that the<\/p>\n<p>accused is guilty and thus convicted him u\/s.138 of<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_3\">Negotiable Instruments Act<\/a>. On such conviction, the trial<\/p>\n<p>court sentenced the revision petitioner to undergo simple<\/p>\n<p>imprisonment for 30 days and to pay a compensation of<\/p>\n<p>Rs.25,000\/- to the complainant u\/s. 357(3) of <a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a> and the<\/p>\n<p>default sentence is fixed as 30 days imprisonment. It is also<\/p>\n<p>ordered that on realisation of fine amount, it shall be paid<\/p>\n<p>to the complainant.\n<\/p>\n<p id=\"p_2\">Crl. R.P.No.2697\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                3<\/span><\/p>\n<p id=\"p_3\">      3. In appeal, at the instance of the revision petitioner\/<\/p>\n<p>accused, by judgment dated 10.06.2010 in Crl.A.482\/2008<\/p>\n<p>the Court of Second Addl. Sessions Judge, Kollam,<\/p>\n<p>dismissed the appeal but the sentence was modified to the<\/p>\n<p>effect that the appellant has to pay Rs.20,650\/- as fine and<\/p>\n<p>the appellant has to undergo simple imprisonment till rising<\/p>\n<p>of the court.      In default of paying the fine amount, the<\/p>\n<p>accused is directed to undergo simple imprisonment for 7<\/p>\n<p>days. It is also ordered that on realisation of the fine<\/p>\n<p>amount, the same shall be paid to the complainant as<\/p>\n<p>compensation. It is the above conviction and sentence<\/p>\n<p>challenged in this revision petition.\n<\/p>\n<p id=\"p_4\">      4. I have heard the learned counsel appearing for the<\/p>\n<p>revision petitioner and also perused the judgments of the<\/p>\n<p>courts below.\n<\/p>\n<p id=\"p_5\">      5. Reiterating the stand taken by the accused\/revision<\/p>\n<p>petitioner during the trial and appeal, submitted that the<\/p>\n<p>complainant has not established the transaction and also<\/p>\n<p>the execution and issuance of the cheque. But no case is<\/p>\n<p>Crl. R.P.No.2697\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                              4<\/span><\/p>\n<p>made out to interfere with the concurrent findings of the<\/p>\n<p>trial court as well as the lower appellate court. Therefore, I<\/p>\n<p>find no merit in the revision petition and accordingly the<\/p>\n<p>conviction recorded by the courts below against the<\/p>\n<p>revision petitioner u\/s.138 of <a href=\"\/doc\/1132672\/\" id=\"a_5\">Negotiable Instruments Act<\/a> is<\/p>\n<p>approved.\n<\/p>\n<p id=\"p_6\">      6. As this court is not inclined to interfere with the<\/p>\n<p>conviction, the counsel for the revision petitioner submitted<\/p>\n<p>that, some breathing time may be granted to the revision<\/p>\n<p>petitioner to pay the fine amount. Having regard to the<\/p>\n<p>facts and circumstances involved in this case, I am of the<\/p>\n<p>view that the said submission can be considered favourably<\/p>\n<p>and one month time can be granted to pay the fine amount.<\/p>\n<p id=\"p_7\">      In the result, the conviction of the revision petitioner<\/p>\n<p>u\/s.138 of <a href=\"\/doc\/1132672\/\" id=\"a_6\">Negotiable Instruments Act<\/a> is confirmed as<\/p>\n<p>recorded by the courts below. Accordingly, the sentence of<\/p>\n<p>imprisonment as modified and fixed by the appellate court<\/p>\n<p>is also confirmed. Thus while confirming the sentence to<\/p>\n<p>pay the fine of Rs.20,650\/- the petitioner is granted one<\/p>\n<p>Crl. R.P.No.2697\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                               5<\/span><\/p>\n<p>month time to pay the fine amount and the default sentence<\/p>\n<p>fixed by the appellate court will attract only if there is<\/p>\n<p>failure on the part of the revision petitioner in depositing<\/p>\n<p>the fine amount within one month from today. But default<\/p>\n<p>sentence is enhanced to one month simple imprisonment.<\/p>\n<p>Accordingly, the revision petitioner is directed to appear<\/p>\n<p>before the trial court on 13.10.2010 to receive the sentence<\/p>\n<p>of imprisonment and deposit the fine amount.
