SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/09\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">1.\tBy<br \/>\nway of this petition under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of India,<br \/>\nthe petitioner has prayed for an appropriate writ, direction and<br \/>\norder quashing and setting aside the impugned judgment and award<br \/>\ndated 2.12.1993 passed by Labour Court, Ahmedabad passed in Reference<br \/>\n(LCA) No. 55 of 1992, by which the Labour Court has dismissed the<br \/>\nsaid Reference.\n<\/p>\n<p id=\"p_1\">2.0\tThe<br \/>\nfacts leading to the present Special Civil Application  in nutshell<br \/>\nare as under:\n<\/p>\n<p id=\"p_2\">2.1.\tThe<br \/>\npetitioner was serving with the respondent and it appears that on<br \/>\n21.8.1983 he was caught red handed with one choke, which was found in<br \/>\nhis Tiffin and therefore, it was alleged against the petitioner that<br \/>\nhe has committed a theft of the company property. It appears that the<br \/>\ncompany was to initiate criminal proceedings against him, however the<br \/>\npetitioner requested not to take any action and not to initiate any<br \/>\nproceedings and he tendered resignation, which came to be accepted on<br \/>\n24.8.1983. It appears that thereafter, as a second thought and after<br \/>\nhis resignation was accepted, petitioner by communication dated<br \/>\n21.8.1983 turn around and submitted that his resignation was by<br \/>\nforce, compulsion and under duress. Therefore, it was requested to<br \/>\ntake him back on duty. That thereafter, petitioner raised an<br \/>\nindustrial dispute which was referred to Labour Court, Ahmedabad,<br \/>\nwhich was numbered as Reference(LCA) No. 55 of 1992 and Labour Court<br \/>\nby impugned judgment and award dismissed the said Reference by<br \/>\nholding that once the resignation tendered by the petitioner was<br \/>\naccepted, it was not open for the petitioner to withdraw the same.<br \/>\nThe Labour Court also found that the resignation tendered by the<br \/>\npetitioner was not under duress. Being aggrieved and dissatisfied<br \/>\nwith the impugned judgment and award passed by the Labour Court,<br \/>\nAhmedabad in dismissing the said Reference, the petitioner has<br \/>\npreferred present Special Civil Application  under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the<br \/>\nConstitution of India.\n<\/p>\n<p id=\"p_3\">3.\tShri<br \/>\nPC Master, learned advocate for the petitioner has vehemently<br \/>\nsubmitted that as such the so called resignation of the petitioner<br \/>\nwas under duress. It is submitted that as such there was no theft<br \/>\ncommitted by the petitioner at all and, therefore, any admission or<br \/>\nconfession made by the petitioner cannot be used as evidence against<br \/>\nthe petitioner without holding any inquiry and straightway order of<br \/>\ntermination could not have been passed and, therefore, it is<br \/>\nrequested to allow the present Special Civil Application.\n<\/p>\n<p id=\"p_4\">4.\tHaving<br \/>\nheard the learned advocate for the petitioner and considering the<br \/>\nimpugned judgment and award, at the outset, it is required to be<br \/>\nnoted that it is not a question of termination of the petitioner on<br \/>\nconfession and\/ or admission. It is a question of resignation<br \/>\ntendered by the petitioner. It appears that to avoid criminal<br \/>\nproceedings and other departmental proceedings, the petitioner<br \/>\nvoluntarily tendered the resignation on 21.8.1983, which came to be<br \/>\naccepted immediate on the very day. Thereafter, after a period of<br \/>\nthree days as an afterthought the petitioner submitted the<br \/>\napplication on 24.8.1983 and came out with a case that his alleged<br \/>\nresignation was under duress and he tried to withdraw  the same and<br \/>\nretract the same. Considering the fact that earlier, the resignation<br \/>\nsubmitted by the petitioner was already accepted and as rightly<br \/>\nobserved by the Labour Court that it was not open for the petitioner<br \/>\nsubsequently to withdraw the same.\n<\/p>\n<p id=\"p_5\">5.\tNow<br \/>\nso far as the contention on behalf of the petitioner that he has not<br \/>\ncommitted theft is concerned, even in the cross-examination the<br \/>\npetitioner has categorically stated that one choke was found from his<br \/>\nTiffin. Learned advocate for the petitioner is not in a position to<br \/>\nsatisfy the Court how the choke was found from the Tiffin. Therefore,<br \/>\nit appears that to avoid any criminal proceedings, the petitioner<br \/>\nvoluntarily submitted the resignation, which came to be accepted on<br \/>\n24.8.1983 and as an afterthought subsequently he tried to retract the<br \/>\nsame, which is not permitted by the Labour Court, Ahmedabad.\n<\/p>\n<p id=\"p_6\">6.\tIn<br \/>\nview of the above there is no substance in the petition, which<br \/>\ndeserve to be dismissed and is accordingly dismissed.
