Justice V.K.MOHANAN\n\n Dated :22\/06\/2010\n\n O R D E R\n                      V.K.MOHANAN, J.\n                     ~~~~~~~~~~~~~\n                   Crl.R.P.No.1875 of 2010\n                 ~~~~~~~~~~~~~~~~~\n           Dated this the 22nd day of June 2010\n\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">      The accused in a prosecution for an offence u\/s.138 of the<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable Instruments Act<\/a> is the revision petitioner, who is<\/p>\n<p>aggrieved by the order of conviction and sentence imposed by<\/p>\n<p>the courts below.\n<\/p>\n<p id=\"p_1\">      2. The case of the complainant is that the accused\/revision<\/p>\n<p>petitioner, towards the discharge of a debt due to the<\/p>\n<p>complainant,    issued   a   cheque    dated    30.12.2007    for<\/p>\n<p>Rs.1,10,000\/-,   which    when   presented     for  encashment<\/p>\n<p>dishonoured and the cheque amount was not repaid inspite of a<\/p>\n<p>formal demand notice and thus the revision petitioner has<\/p>\n<p>committed the offence punishable u\/s.138 of <a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable<\/p>\n<p>Instruments Act<\/a>.    With the same allegation, the complainant<\/p>\n<p>approached the Judicial First Class Magistrate Court-II, (Addl.<\/p>\n<p>Munsiff), Kasaragod, by filing a formal complaint, upon which<\/p>\n<p>cognizance was taken u\/s.138 of <a href=\"\/doc\/1132672\/\" id=\"a_2\">Negotiable Instruments Act<\/a> and<\/p>\n<p>instituted C.C.No.400\/08. During the trial of the case, PW1 was<\/p>\n<p>Crl.R.P.No.1875 of 2010<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                : 2 :<\/span><\/p>\n<p>examined from the side of the complainant and Exts.P1 to P5<\/p>\n<p>were marked. No evidence either oral or documentary adduced<\/p>\n<p>from the side of the defence.       On the basis of the available<\/p>\n<p>materials and evidence on record, the trial court has found that<\/p>\n<p>the   cheque     in   question  was   issued   by  the  revision<\/p>\n<p>petitioner\/accused for the purpose of discharging his debt due to<\/p>\n<p>the complainant.      Thus accordingly the court found that, the<\/p>\n<p>complainant      has    established   his   case   against   the<\/p>\n<p>accused\/revision petitioner and consequently found that the<\/p>\n<p>accused is guilty and thus convicted him u\/s.138 of the<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_3\">Negotiable Instruments Act<\/a>. On such conviction, the trial court<\/p>\n<p>sentenced     the    revision  petitioner  to  undergo    simple<\/p>\n<p>imprisonment for 3 months and also directed the revision<\/p>\n<p>petitioner to pay an amount of Rs.1,10,000\/- as compensation to<\/p>\n<p>the complainant under Sec.357(3) of <a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a> and default sentence<\/p>\n<p>is fixed as one month simple imprisonment.\n<\/p>\n<p id=\"p_2\">      3. In appeal, at the instance of the revision petitioner\/<\/p>\n<p>accused in Crl.A.43\/09, by judgment dated 12.3.2010 in the<\/p>\n<p>Court of Sessions, Kasaragod, allowed the appeal only in part<\/p>\n<p>and the sentence of imprisonment reduced to 10 days and while<\/p>\n<p>Crl.R.P.No.1875 of 2010<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                : 3 :<\/span><\/p>\n<p>confirming the amount of compensation ordered by the trial<\/p>\n<p>court, the default sentence is enhanced to 3 months simple<\/p>\n<p>imprisonment.       It is the above conviction and sentence<\/p>\n<p>challenged in this revision petition.\n<\/p>\n<p id=\"p_3\">      4.   I have heard the learned counsel appearing for the<\/p>\n<p>revision petitioner and also perused the judgments of the courts<\/p>\n<p>below.\n<\/p>\n<p id=\"p_4\">      5.   Reiterating the stand taken by the accused\/revision<\/p>\n<p>petitioner during the trial and appeal, submitted that the<\/p>\n<p>complainant has not established the transaction and also the<\/p>\n<p>execution and issuance of the cheque. But no case is made out<\/p>\n<p>to interfere with the concurrent findings of the trial court as well<\/p>\n<p>as the lower appellate court. Therefore, I find no merit in the<\/p>\n<p>revision petition and accordingly the conviction recorded by the<\/p>\n<p>courts below against the revision petitioner u\/s.138 of<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_5\">Negotiable Instruments Act<\/a> is confirmed.\n<\/p>\n<p id=\"p_5\">      6. The learned counsel submitted that some breathing time<\/p>\n<p>may be granted to the revision petitioner to pay the<\/p>\n<p>compensation amount and also submitted that the sentence of<\/p>\n<p>imprisonment may be set aside. Having regard to the facts and<\/p>\n<p>Crl.R.P.No.1875 of 2010<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                 : 4 :<\/span><\/p>\n<p>circumstances involved in the case, I am of the view that the said<\/p>\n<p>submission     can    be    considered    favourably    with    slight<\/p>\n<p>modifications with respect to the compensation amount.<\/p>\n<p id=\"p_6\">      In the result, this revision petition is disposed of confirming<\/p>\n<p>the conviction against the revision petitioner u\/s.138 of<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_6\">Negotiable Instruments Act<\/a> as recorded by the trial court as well<\/p>\n<p>as the lower appellate court. Accordingly, the revision petitioner<\/p>\n<p>is sentenced to undergo simple imprisonment till rising of the<\/p>\n<p>court and he is also directed to pay a sum of Rs.1,15,000\/- as<\/p>\n<p>compensation to the complainant u\/s.357(3) of <a href=\"\/doc\/445276\/\" id=\"a_7\">Cr.P.C<\/a>. If there is<\/p>\n<p>any failure on the part of the revision petitioner in paying the<\/p>\n<p>compensation, he is directed to undergo simple imprisonment for<\/p>\n<p>a period of 3 months. Accordingly, the revision petitioner is<\/p>\n<p>directed to appear before the trial court on 22nd September,<\/p>\n<p>2010 to pay the compensation amount as directed by this court.<\/p>\n<p>In case any failure on the part of the revision petitioner in<\/p>\n<p>appearing before the court below as directed above and in<\/p>\n<p>making the deposit of compensation amount, the trial court is<\/p>\n<p>free to take coercive steps to secure the presence of the revision<\/p>\n<p>petitioner and to execute the sentence awarded against the<\/p>\n<p>Crl.R.P.No.1875 of 2010<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                : 5 :<\/span><\/p>\n<p>revision petitioner.
