Justice M.SASIDHARAN NAMBIAR\n\n Dated :05\/10\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n            CRL.M.C.NO.3634 OF 2010\n           ---------------------------------------------\n            Dated        5th    October, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>         Petitioners are accused 1,2,3, and<\/p>\n<p>6 in C.C.758\/2009 on the file of Judicial<\/p>\n<p>First Class Magistrate&#8217;s                     Court-I, Hosdurg<\/p>\n<p>taken cognizance for the offences under<\/p>\n<p>Sections 143, 147, 148, 457, 380 and 427<\/p>\n<p>read with Section 149               of Indian Penal Code<\/p>\n<p>on Annexure-AII final report submitted by<\/p>\n<p>Sub Inspector of Police. Prosecution case,<\/p>\n<p>as seen from Annexure-AII final report, is<\/p>\n<p>that ten accused formed themselves into an<\/p>\n<p>unlawful assembly with the common object of<\/p>\n<p>causing damage to the Shakha office of<\/p>\n<p>Indian National              League at Kooliyangal,<\/p>\n<p>being the members of Indian                          Union Muslim<\/p>\n<p>League and in furtherance of the common<\/p>\n<p>Crmc 3634\/10<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>object,      armed  with  deadly   weapons    broke<\/p>\n<p>opened the door and threw the furniture and<\/p>\n<p>took away the colour TV and caused loss to the<\/p>\n<p>tune of Rs.10,000\/- to Indian National League<\/p>\n<p>and thereby committed the offences. Petition is<\/p>\n<p>filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure       to quash the proceedings pending<\/p>\n<p>before the      learned Magistrate  contending that<\/p>\n<p>subsequently entire disputes        were    settled<\/p>\n<p>amicably and consequent to the settlement, it<\/p>\n<p>is not in the interest of justice to continue<\/p>\n<p>the         prosecution.    Petitioners    produced<\/p>\n<p>Annexure-AIII agreement entered into by Sakha<\/p>\n<p>committee        of    Indian   National    League,<\/p>\n<p>Kooliyangal Shakha whereunder President         and<\/p>\n<p>Secretary of Indian Nationl League decided to<\/p>\n<p>withdraw the case and issued a consent letter<\/p>\n<p>and affidavit and agreed to file an affidavit<\/p>\n<p>Crmc 3634\/10<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>before this Court. Annexure-AIV    consent letter<\/p>\n<p>was also executed by the Secretary of Indian<\/p>\n<p>National League authorizing Irshad to file an<\/p>\n<p>affidavit      before  this  Court.  A   separate<\/p>\n<p>affidavit was filed by the second respondent<\/p>\n<p>Secretary of Indian National League who is the<\/p>\n<p>de    facto    complainant  stating  that  entire<\/p>\n<p>disputes were settled amicably and consequent<\/p>\n<p>to the settlement, he is not interested        to<\/p>\n<p>continue the prosecution. Second respondent was<\/p>\n<p>represented by a counsel who submitted that<\/p>\n<p>entire disputes were settled amicably.<\/p>\n<p>            2. Learned   Public   Prosecutor  on<\/p>\n<p>instructions     submitted  that   the  statement<\/p>\n<p>recorded      subsequently  from  the  de   facto<\/p>\n<p>complainant     establishes that  the matter  has<\/p>\n<p>been settled amicably.\n<\/p>\n<p>            3. Offences   alleged   against  the<\/p>\n<p>Crmc 3634\/10<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>petitioners      are  purely   personal  in   nature<\/p>\n<p>against the office of Shakha of Indian National<\/p>\n<p>League. Affidavit filed by the Secretary          of<\/p>\n<p>Shakha         committee     with      Annexure-AIII<\/p>\n<p>agreement establishes that entire disputes were<\/p>\n<p>settled amicably. As held by the Apex Court in<\/p>\n<p><a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008 (3)<\/p>\n<p>KLT 19 (SC)        when the disputes were settled<\/p>\n<p>amicably      between  the  parties    and  offences<\/p>\n<p>alleged are purely personal in nature,        it is<\/p>\n<p>not in the interest of justice to continue the<\/p>\n<p>prosecution.\n<\/p>\n<p>            Petition is allowed.
