2       12.08.2011              Heard       learned        counsel         for     the<\/p>\n
                     petitioner and counsel for the State.<\/p>\n
                                The prayer of the petitioner in this<\/p>\n
                     writ    application         to   quash    the     order        of<\/p>\n
                     punishment dated 17.11.2003 and the appellate<\/p>\n
                     order dated 20.10.2006 is based on a simple<\/p>\n
                     and    plain       premises      that    even     when        the<\/p>\n
                     petitioner      was    exonerated        by     the     Enquiry<\/p>\n
                     Officer       in      his     enquiry         report        dated<\/p>\n
                     13.6.2003, the resultant order of punishment<\/p>\n
                     was passed either without differing with the<\/p>\n
                     findings      of    the     enquiry     report        and    also<\/p>\n
                     giving him notice and\/or an opportunity of<\/p>\n
                     hearing. Learned counsel for the petitioner<\/p>\n
                     has    also    assailed      the   appellate          order    by
\n                  2<\/span><\/p>\n
taking a plea that this vital aspect was not<\/p>\n
at all gone into by the appellate authority<\/p>\n
who had some how read between the lines in<\/p>\n
the show cause reply filed by the petitioner<\/p>\n
for treating them as his admission that he<\/p>\n
was    unauthorisedly        absent      from      duty     in<\/p>\n
afternoon on 7.4.2003.\n<\/p>\n
            Learned counsel for the State on the<\/p>\n
other hand has supported the view taken by<\/p>\n
the appellate authority, the Commissioner of<\/p>\n
Purnia      Division     affirming       the      order     of<\/p>\n
punishment by pointing out that it was an<\/p>\n
admitted     position    that     the    petitioner        had<\/p>\n
left the school on 7.4.2003 after luncheon<\/p>\n
interval without taking any permission from<\/p>\n
his    controlling      authority       and,    therefore,<\/p>\n
once   he    was     found   to   be     absent     in     the<\/p>\n
surprise inspection of the Collector of the<\/p>\n
district, the order of punishment could not<\/p>\n
be interfered only on account of the charge<\/p>\n
being not found to have been proved by the<\/p>\n
Enquiry Officer.\n<\/p>\n
            In   the   considered       opinion    of     this<\/p>\n
Court, neither the appellate authority nor<\/p>\n
the counsel can be permitted to make out a
\n                     3<\/span><\/p>\n
third case, inasmuch as, in any disciplinary<\/p>\n
enquiry, the procedure laid down has to be<\/p>\n
followed. Such procedure ofcourse does not<\/p>\n
contemplate             that       the         report        of     Enquiry<\/p>\n
Officer would be binding on the disciplinary<\/p>\n
authority         but,       at     the        same     time,       if     the<\/p>\n
Enquiry        Officer         had       fully        exonerated           the<\/p>\n
petitioner              by     recording              the         following<\/p>\n
conclusive finding:-\n<\/p>\n

and the same was sought to be differed by the<\/p>\n
Collector of the district, the disciplinary<\/p>\n
authority,          he       had     to     issue        a     show-cause<\/p>\n
notice        disclosing             the        reasons           for      his<\/p>\n
difference of opinion and only thereafter, he<\/p>\n
could      have      proceeded            to    pass      an      order        of<\/p>\n
punishment after considering the show-cause<\/p>\n
reply filed by the petitioner. The law in<\/p>\n
this regard stands settled in the judgment of<\/p>\n
the Apex Court in the case of Punjab National<\/p>\n
Bank & Ors. Vs. Kunj Behari Misra reported in<\/p>\n
1998(7)SCC 84.\n<\/p>\n
             Admittedly                   the               disciplinary\n                  4<\/span>\n\n\n\n\nauthority      had     never       issued any show            cause\n\n<\/pre>\n
notice to the petitioner before passing the<\/p>\n
impugned order of punishment as is apparent<\/p>\n
from     the     materials         on   record.        Thus    the<\/p>\n
impugned order of punishment is in violation<\/p>\n
of principles of natural justice as also in<\/p>\n
teeth of law laid down by the Apex Court in<\/p>\n
the case of Kunj Bihari Mishra (supra). Since<\/p>\n
this vital aspect going to the root of the<\/p>\n
matter     has        also    been      considered       by     the<\/p>\n
appellate authority, who has curiously gone<\/p>\n
into the merit of the charge, the appellate<\/p>\n
order can also not be sustained in law.<\/p>\n
           Accordingly,            both       the    order      of<\/p>\n
punishment dated 17.11.2003 and the appellate<\/p>\n
order dated 20.10.2006 are hereby quashed.<\/p>\n
Since the petitioner has already retired from<\/p>\n
service, there would be no occasion for this<\/p>\n
Court     to     remit       the     matter     back     to    the<\/p>\n
disciplinary          authority       for     proceeding      from<\/p>\n
the    stage     of    service of         show-cause      notice<\/p>\n
after      submission              enquiry       report         and<\/p>\n
accordingly, this Court would also direct the<\/p>\n
District Programme Officer, Purnia to make<\/p>\n
payment    of     full       salary     for    the   period      of
\n                      5<\/span><\/p>\n
      suspension of the petitioner as also refund<\/p>\n
      the   amount       of   one     increment    which     the<\/p>\n
      petitioner     had      been    deprived    by   way   of<\/p>\n
      undergoing the consequence of the impugned<\/p>\n
      order of punishment.\n<\/p>\n
               With             the          aforementioned<\/p>\n
      observations, this application is allowed.<\/p>\n
