Justice V.RAMKUMAR\n\n Dated :18\/03\/2010\n\n O R D E R\n                  *Crl.R.P.*RAMKUMAR,*J.2009*\n                   * * *V. * * * * * * * * * *\n                         *\n\n          Dated,*this the 18th day of March 2010\n                   * * * * *No.*3147*of* * * * *\n                            * * * * *\n\n\n                             ORDER\n<\/pre>\n<p id=\"p_1\">     The revision petitioner who was the complainant in a<\/p>\n<p>private complaint against 4 accused persons namely<\/p>\n<p>Nusaifa Beevi, Salahudeen, Amina Beevi, Ishack @ Razak<\/p>\n<p>alleging offences punishable under Sections 494, 497 read<\/p>\n<p>with Sec. 34 <a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>. challenges the order dated 12-6-2008<\/p>\n<p>passed by the J.f.C.M.I , Punalur dismissing the complaint<\/p>\n<p>under Sec. 203 after recording the sworn statement of the<\/p>\n<p>revision petitioner and two other witnesses and CWs 2and<\/p>\n<p id=\"p_1\">3.  According to the        revision petitioner, the marriage<\/p>\n<p>between himself and Nusaifa Beevi is still subsisting and<\/p>\n<p>while so she married Salahudeen on 31-1-2000.                 The<\/p>\n<p>learned Magistrate took cognizance           of the offence by<\/p>\n<p>proceeding under Chapter 15 of <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. and took the sworn<\/p>\n<p>statement of the revision petitioner and               two other<\/p>\n<p>witnesses. Thereafter, the complaint has been dismissed<\/p>\n<p>under Sec. 203 <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>. by passing the following order:-<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;This private complaint against 4 accused persons<br \/>\n            is alleged commission of offences under Sec. 494,<br \/>\n            497 read with Sec. 34 <a href=\"\/doc\/1569253\/\" id=\"a_3\">I.P.C<\/a>C.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                  Complainant and two witnesses examined as<br \/>\n            CW1 to 3. No document produced.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                  On a consideration of the statement recorded<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P. No. 3147 of 2007              -:2:-<\/span><\/p>\n<p>                  under <a href=\"\/doc\/444619\/\" id=\"a_4\">Section 200<\/a> Cr.P.C. of the complainant and<br \/>\n                  witness, I am of the opinion that there is        no<br \/>\n                  sufficient ground       for proceeding against the<br \/>\n                  accused. None of the ingredients of offence under<br \/>\n                  Secs. 494, 497 read with Sec. 34 <a href=\"\/doc\/1569253\/\" id=\"a_5\">I.P.C<\/a>. prima facie<br \/>\n                  established for the reason stated above. i found that<br \/>\n                  complainant is devoid of merit and dismissed under<br \/>\n                  Sec. 203 <a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_2\">The order does not indicate as to why the Magistrate is of<\/p>\n<p>the opinion that there is                    no sufficient ground for<\/p>\n<p>proceeding against the accused.                    He should have given<\/p>\n<p>reasons in support of the dismissal of the complaint. Since<\/p>\n<p>the complaint was dismissed before issuing process to the<\/p>\n<p>four accused persons no notice need go to the accused<\/p>\n<p>persons in this Revision. The impugned order which does<\/p>\n<p>not give reasons in support of the dismissal of the complaint<\/p>\n<p>cannot be sustained,               and      is,     accordingly set aside.<\/p>\n<p>C.M.P. 2393 of 2007 will stand restored to the file of the<\/p>\n<p>J.F.C.M.
