Agarwal,J.\n<\/p>\n<p id=\"p_1\">   Heard learned counsel for the appellant, learned AGA and perused the<br \/>\nimpugned judgment and trial court&#8217;s record.\n<\/p>\n<p id=\"p_2\">   It is argued by learned counsel for the appellant that this case is of<br \/>\ncircumstantial evidence and the circumstances are not sufficient to link the<br \/>\nappellant with the offence. The only evidence disclosed by Smt. Nazrin<br \/>\n(P.W.-4) wife of the deceased Malwa and Noor Jahan (P.W.-7), daughter of<br \/>\nthe deceased to the Investigating Officer after six months from the date of<br \/>\nincident is that the appellant and the deceased had gone together and<br \/>\nthereafter the dead-body was found after two days on 26.2.1999. There is no<br \/>\nother evidence, recovery etc. to link the appellant with the crime.<br \/>\n  Learned AGA opposed the prayer for bail and contended that the appellant<br \/>\nwanted to marry with Noor Jahan.\n<\/p>\n<p id=\"p_3\">  Having considered the submissions made by learned counsel for the parties<br \/>\nand without expressing any opinion on the merits of the case, we find it to be<br \/>\na fit case for bail.\n<\/p>\n<p id=\"p_4\">   Let the appellant Aas Mohammad, convicted and sentenced by the Addl.<br \/>\nSessions Judge, Court No. 5, Ghaziabad in S.T. No. 1182 of 2000 arising out<br \/>\nof Case Crime No. 68 of 1999, under <a href=\"\/doc\/695990\/\" id=\"a_1\">Sections 364<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_1\">148<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_2\">302<\/a>, <a href=\"\/doc\/999134\/\" id=\"a_3\">149<\/a> and <a href=\"\/doc\/386021\/\" id=\"a_4\">201<\/a><br \/>\nIPC, P.S.
