The petition is<br \/>\npressed mainly on the ground that  the FIR  is for offences under the<br \/>\nMines and <a href=\"\/doc\/25127\/\" id=\"a_1\">Minerals Act<\/a> and no cognizance of  FIR therefore  can be<br \/>\ntaken and only upon a complaint before the Magistrate cognizance  of<br \/>\nsuch offence can be taken.  However, the issue was considered at<br \/>\nlength by this Court in Criminal Misc. Application No.5230 of 2010<br \/>\nand connected matters decided on 3rd September 2010  in<br \/>\nwhich following conclusions have been arrived at :\n<\/p>\n<p id=\"p_2\">&#8220;1.\n<\/p>\n<p id=\"p_3\">\t<a href=\"\/doc\/83054370\/\" id=\"a_1\">Section 22<\/a> of  the Act does not prohibit registering an FIR by the<br \/>\n\tpolice on information being given  with respect to offences<br \/>\n\tpunishable under<br \/>\n\tthe said Act or the Rules made thereunder,<\/p>\n<p id=\"p_4\">\t2.\tIt<br \/>\n\tis, however, not open for the Magistrate to take cognizance   of the<br \/>\n\toffence punishable under the Act or the Rules made thereunder on a<br \/>\n\tmere chargesheet filed by the police.  It would, however, be open<br \/>\n\tfor the  officer authorized  by the State or the Central Government<br \/>\n\tin this behalf to file a complaint in writing  before the Magistrate<br \/>\n\t relying upon the investigation carried out by the police  and the<br \/>\n\tcompliant may also include  the papers of police investigation.\n<\/p>\n<p id=\"p_5\">3.\tWith<br \/>\n\trespect to offences punishable under<a href=\"\/doc\/1569253\/\" id=\"a_2\"> the Indian Penal Code<\/a>, no such<br \/>\n\tbar as indicated in<br \/>\n\tpara (2) would apply.&#8221;\n<\/p>\n<p id=\"p_6\">\tIn<br \/>\nview of the above conclusions, the contention that the FIR is not<br \/>\nmaintainable is turned down.  However, steps subsequent to filing of<br \/>\nFIR as clarified and detailed in the above  order shall be followed<br \/>\nby the Investigating Agency.\n<\/p>\n<p id=\"p_7\">\tWith<br \/>\nthe above  observations, the petition is disposed.  Rule is<br \/>\ndischarged.
