(Oral)\n<\/pre>\n<p id=\"p_1\">             This is a revision petition by complainant Sat Paul Kagra.<br \/>\n             The petitioner filed complaint against respondents C.K.Bali and<br \/>\nHarbhajan Singh Sub Inspector of Police, under <a href=\"\/doc\/1897847\/\" id=\"a_1\">sections 120-B<\/a>, <a href=\"\/doc\/534484\/\" id=\"a_1\">182<\/a>, <a href=\"\/doc\/386021\/\" id=\"a_2\">201<\/a>,<br \/>\n<a href=\"\/doc\/589866\/\" id=\"a_3\">343<\/a>, <a href=\"\/doc\/839778\/\" id=\"a_4\">380<\/a> and <a href=\"\/doc\/222396\/\" id=\"a_5\">427<\/a> IPC. The petitioner alleged that he is tenant in property<br \/>\nowned by one Prem Lata who failed to get it vacated despite filing of many<br \/>\nejectment petitions.     She then agreed to sell the said property to the<br \/>\npetitioner who thereafter filed suit for specific performance.   Respondent<br \/>\nNo. 1 has obtained power of attorney from Prem Lata. Some ventilators are<br \/>\nstated to have been removed by the respondent no.1 on 21.9.2007 from the<br \/>\nsaid premises. Respondent No. 2 is said to have connived with respondent<br \/>\nNo. 1 and refused to record the statement of the wife of the petitioner and<br \/>\nalso refused to record statement of the Carpenter and rather recorded some<br \/>\nfalse report at the instance of respondent no. 1.\n<\/p>\n<p id=\"p_1\">             After recording of preliminary evidence, learned Chief Judicial<br \/>\nMagistrate, Jalandhar vide impugned order dated 17.4.2009 ordered<br \/>\nsummoning of respondent No. 1 for offences under <a href=\"\/doc\/222396\/\" id=\"a_6\">sections 427<\/a> and <a href=\"\/doc\/1599401\/\" id=\"a_7\">341<\/a><br \/>\nIPC and refused to summon respondent no. 2 for want of sanction under<br \/>\n<a href=\"\/doc\/12704\/\" id=\"a_8\">section 197<\/a> Cr.P.C.       Feeling aggrieved, the complainant has filed this<br \/>\nrevision petition for summoning respondent no. 2 as accused and for<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Revision No. 1626 of 2009                             -2-<\/span><\/p>\n<p>summoning of respondent no. 1 for some additional offence as well.\n<\/p>\n<p id=\"p_2\">                 I have heard the learned counsel for the petitioner and perused<br \/>\nthe case file.\n<\/p>\n<p id=\"p_3\">                 Learned counsel for the petitioner contended that respondent<br \/>\nno. 2 is not an officer who is removable from his office by or with the<br \/>\nsanction of the Government and therefore, <a href=\"\/doc\/12704\/\" id=\"a_9\">section 197<\/a> Cr.P.C. is not<br \/>\napplicable. The contention cannot be accepted because <a href=\"\/doc\/12704\/\" id=\"a_10\">section 197<\/a> Cr.P.C.<br \/>\nhas been made applicable by State Government to all police officials by<br \/>\nexercising power under <a href=\"\/doc\/1865075\/\" id=\"a_11\">section 197(3)<\/a> Cr.P.C.              Consequently, sanction<br \/>\nunder <a href=\"\/doc\/12704\/\" id=\"a_12\">section 197<\/a> Cr.P.C. is required for prosecuting respondent no. 2.\n<\/p>\n<p id=\"p_4\">                 Learned counsel for the petitioner also contended that the acts<br \/>\nof respondent no. 2 do not pertain to his official duty.             The contention<br \/>\ncannot be accepted.         It is alleged in the complaint that respondent no. 1<br \/>\nmanaged to lodge false reports in connivance with respondent no. 2.<br \/>\nRecording of any report by respondent no. 2 at the instance of respondent<br \/>\nno. 1 could be only in exercise of official duty by respondent no. 2. It is<br \/>\nalso alleged that respondent no. 2 refused to perform his official duty by not<br \/>\nrecording the statements of petitioner&#8217;s wife and Carpenter and by not<br \/>\ngetting the spot photographed.          This act or omission of respondent no. 2<br \/>\nalso relates to official discharge of duty as per version of the petitioner<br \/>\nhimself.    Consequently, there is no infirmity in the impugned order of the<br \/>\nlearned Magistrate refusing to summon respondent no. 2 for want of<br \/>\nsanction under <a href=\"\/doc\/12704\/\" id=\"a_13\">section 197<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_5\">                 As regards, respondent no. 1 it has been submitted by learned<br \/>\ncounsel for the petitioner that offence under <a href=\"\/doc\/839778\/\" id=\"a_14\">section 380<\/a> IPC is also made<br \/>\nout against respondent no. 1 as he removed ventilators from the premises in<br \/>\nquestion.    However, it is no where alleged in the complaint Annexure P\/4<br \/>\nby the petitioner that the said ventilators had been got installed by<br \/>\npetitioner-complainant and the same have been stolen by respondent no. 1.\n<\/p>\n<p id=\"p_6\">                 In view of the aforesaid, there is no merit in the instant revision<br \/>\npetition which is accordingly dismissed.<\/p>\n<pre id=\"pre_1\">\n\n                                                            ( L.N.
