No.227 of 2003\n                     -------------------------------------\n            Dated this the 12th day of February, 2009\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">R.BASANT, J.\n<\/p>\n<p id=\"p_1\">     Claimant before the Tribunal is the appellant before us.<\/p>\n<p>Through his guardian, the minor\/claimant aged 7 years, claimed<\/p>\n<p>an amount of Rs.2.34 lakhs as compensation for personal injuries<\/p>\n<p>suffered in a motor accident. The Tribunal awarded an amount<\/p>\n<p>of Rs.61,800\/- under various heads and the claimant is aggrieved<\/p>\n<p>by the quantum of compensation awarded.\n<\/p>\n<p id=\"p_2\">     2.   The minor child had suffered fracture of the frontal<\/p>\n<p>bone and dislocation of the hip joint. He was in the hospital for a<\/p>\n<p>period of 25 days. Procedures under general anaesthesia had to<\/p>\n<p>be undergone and the child was put on skin traction.           The<\/p>\n<p>claimant child allegedly suffered disability as a result of the<\/p>\n<p>accident and the same was confirmed by the doctor.             The<\/p>\n<p>percentage of physical disability was assessed by the doctor at<\/p>\n<p>12% for the limb. The Tribunal reckoned the disability at 7% for<\/p>\n<p>the whole body. The doctor who issued the disability certificate<\/p>\n<p>was examined before court also as PW4. The child had suffered<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">M.A.C.A. No.227 of 2003           2<\/span><\/p>\n<p>retardation in his educational progress, he having been<\/p>\n<p>compelled to remain at home and having lost one year in his<\/p>\n<p>educational career.       A certificate to that effect has been<\/p>\n<p>produced also.\n<\/p>\n<p id=\"p_3\">      3.   The Tribunal taking into account all the relevant<\/p>\n<p>circumstances, came to the conclusion that the claimant child is<\/p>\n<p>entitled for an amount of Rs.61,800\/- along with interest @ 9%<\/p>\n<p>and cost.\n<\/p>\n<p id=\"p_4\">      4.   Called upon to explain the specific challenge against<\/p>\n<p>the quantum awarded by the Tribunal, the learned counsel for<\/p>\n<p>the appellant first of all contends that the Tribunal was not being<\/p>\n<p>reasonable and realistic in not awarding any amount of<\/p>\n<p>compensation for the loss of one year in the educational career<\/p>\n<p>of the child.   We are in ready agreement with the learned<\/p>\n<p>counsel for the appellant. Such loss is borne out by the<\/p>\n<p>certificate issued by the school authorities marked as Ext.A15.<\/p>\n<p>We are satisfied that an amount of Rs.12,000\/- can safely be<\/p>\n<p>awarded as compensation under this head.\n<\/p>\n<p id=\"p_5\">      5.   Considering the nature of injuries including fracture<\/p>\n<p>of the frontal bone and dislocation of the right hip as also the<\/p>\n<p>period of inpatient treatment and the outpatient treatment which<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">M.A.C.A. No.227 of 2003          3<\/span><\/p>\n<p>followed and the nature of the procedures undergone at the<\/p>\n<p>hospital including reduction under general anaesthesia, we are<\/p>\n<p>satisfied that the amount of compensation awarded under the<\/p>\n<p>head of pain and suffering at Rs.12,000\/- is not adequate. We<\/p>\n<p>agree with the learned counsel for the appellant that further<\/p>\n<p>amounts deserve to be awarded under that head.            We are<\/p>\n<p>satisfied that a total amount of Rs.15,000\/-, ie. Rs.3,000\/- more,<\/p>\n<p>can safely be awarded under that head.\n<\/p>\n<p id=\"p_6\">       6.  The learned counsel then contends that the amount of<\/p>\n<p>Rs.10,000\/- awarded under the head of loss of amenities is too<\/p>\n<p>inadequate and meager.        The counsel points out that the<\/p>\n<p>claimant is a 7 year old child and the quality of enjoyment of life<\/p>\n<p>as a child and also in later years would be affected considerably<\/p>\n<p>by the disability of 12% suffered on the right limb even though<\/p>\n<p>the total body disability is reckoned by the Tribunal only at 7%.<\/p>\n<p>In any view of the matter, the amount awarded as compensation<\/p>\n<p id=\"p_7\">&#8211; ie., Rs.10,000\/- awarded under the head of loss of amenities is<\/p>\n<p>not reasonable, argues the counsel.       We find merit in that<\/p>\n<p>contention.    We are satisfied that award of an amount of<\/p>\n<p>Rs.15,000\/- under the head loss of amenities &#8211; ie. Rs.5,000\/- more<\/p>\n<p>would be reasonable.\n<\/p>\n<p id=\"p_8\"><span class=\"hidden_text\" id=\"span_2\">M.A.C.A. No.227 of 2003         4<\/span><\/p>\n<p id=\"p_9\">      7.  We are not satisfied that any further amount deserves<\/p>\n<p>to be awarded under any other particular head. The Tribunal<\/p>\n<p>had taken notional income at Rs.1,500\/- per mensem and had<\/p>\n<p>taken the multiplier at 15, which is the maximum admissible<\/p>\n<p>under the second schedule to the Act. We are further satisfied<\/p>\n<p>that the amount of Rs.20,000\/- awarded as compensation for<\/p>\n<p>medical expenses incurred, expenses for bystanders and extra<\/p>\n<p>nourishment etc. though only bills covering an amount of<\/p>\n<p>Rs.15,000\/- were produced before the Tribunal is also absolutely<\/p>\n<p>justified.\n<\/p>\n<p id=\"p_10\">      8.  The above discussions lead us to the conclusion that<\/p>\n<p>the appellant is entitled to a further amount of Rs.20,000\/-<\/p>\n<p>(Rupees Twenty thousand only) as shown above in addition to<\/p>\n<p>the amounts already awarded by the Tribunal along with interest<\/p>\n<p>on the total amount and cost as already awarded.<\/p>\n<p id=\"p_11\">      9.
