Civil Appeals No.34\/2009 to<br \/>\n36\/2009 dated 03.09.2009, whereby, the said appeals were dismissed<br \/>\nand the order passed by the trial Court in application below Exhibits\n<\/p>\n<p>&#8211; 5, 15 &amp; 16 in R.C.S. No.7\/2009 dated 18.08.2009 came to<br \/>\nbe confirmed.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the petitioner, original plaintiff, had filed<br \/>\nR.C.S. No.7\/2009 against the respondents, original defendants, before<br \/>\nthe Court of learned Principal Sr. Civil Judge, Rajpipla. Along with<br \/>\nthe said suit, the petitioner had also filed application Exhibit-5<br \/>\nfor ad-interim injunction against the respondents. The respondents<br \/>\nappeared in the said suit and filed their written statement vide<br \/>\nExhibit-15. The respondents had also claimed counter claim in the<br \/>\nwritten statement Exhibit-15 and thereby, claimed counter ad-interim<br \/>\ninjunction against the petitioner. The respondents had also filed<br \/>\napplication Exhibit-16 praying for vacation of ex-parte ad-interim<br \/>\ninjunction granted in favour of the petitioner in application below<br \/>\nExhibit-5.\n<\/p>\n<p>3.\tThe<br \/>\ntrial Court heard all the three applications together and rejected<br \/>\nthe same by way of common order passed below application Exhibit-5<br \/>\ndated 18.08.2009. The petitioner challenged the common order by way<br \/>\nof filing Misc. Appeals before the lower appellate Court. The lower<br \/>\nappellate Court, after considering the evidence on record, rejected<br \/>\nthe appeals by way of common order dated 03.09.2009. The petitioner<br \/>\nhas challenged the impugned judgment and order passed in Misc.<br \/>\nAppeals No.34\/2009 &amp; 35\/2009 by way of filing the present<br \/>\npetitions.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Before the Court below, it was the case of the petitioner<br \/>\nthat the suit land was sold by one Nurmohammad to him for<br \/>\nRs.11,11,786\/- by way of an oral agreement to sell and that in<br \/>\nconnection with the same, the petitioner had paid Rs.11,000\/- to said<br \/>\nNurmohammad towards Bana<br \/>\npursuant to which the possession of suit land was handed over<br \/>\nto the petitioner. However, before the trial Court, said Nurmohammad<br \/>\nhad not supported the aforesaid story of the petitioner. In the<br \/>\nAffidavit filed by said Nurmohammad vide Exhibit-39, it has been<br \/>\ncategorically stated that he was not the Agent nor the Power of<br \/>\nAttorney holder of the defendants. He has denied that in respect of<br \/>\nthe suit property he had made any oral agreement to sell in favour of<br \/>\nthe petitioner and that he had accepted Rs.11,000\/- towards Bana and<br \/>\nhad handed over possession of the suit land to the petitioner. The<br \/>\npetitioner was not able to controvert the above by producing any<br \/>\ncogent oral or documentary evidence. The story put-forth by the<br \/>\npetitioner is not trustworthy in view of the fact that no one would<br \/>\nhand over possession of a property worth Rs.11,11,786\/- by accepting<br \/>\nonly Rs.11,000\/-. The trial Court has based its case mainly on the<br \/>\nAffidavit filed by said Nurmohammad vide Exhibit-39. Considering the<br \/>\nfacts of the case and the evidence on record, I am of the view that<br \/>\nthe Courts below have rightly not believed the case of the<br \/>\npetitioner.\n<\/p>\n<p>5.\tApart<br \/>\nfrom the above, in the Village Form No.8\/A, there is no mention of<br \/>\nthe name of the petitioner in the revenue records in respect of the<br \/>\nsuit land. Mere payment of revenue tax by the petitioner does not<br \/>\nmake him the owner of the suit land. In view of the above discussion,<br \/>\nI am of the view that both the Courts below were completely justified<br \/>\nin rejecting the case of the petitioner. I am in complete agreement<br \/>\nwith the concurrent findings recorded by both the Courts below and<br \/>\nhence, find no reasons to interfere in these petitions.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, the petitions are dismissed. Notice<br \/>\nis discharged. It is observed that if any application is preferred by<br \/>\nthe petitioner for early hearing of the suit, the trial Court<br \/>\nconcerned shall expedite the hearing and shall try to dispose of the<br \/>\nsame as expeditiously as possible.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
