No.10542\/2010, an application for<br \/>\nurgent hearing.\n<\/p>\n<p id=\"p_1\">     Since   case   diary   is   available,    application   is<br \/>\nallowed.\n<\/p>\n<p id=\"p_2\">     Heard both the parties.\n<\/p>\n<p id=\"p_3\">     Case diary of Crime No.6 of 2010 registered at<br \/>\nPolice Station Bijadehi, District Betul for offence<br \/>\npunishable under Sections 376, 506 read with <a href=\"\/doc\/37788\/\" id=\"a_1\">Section<br \/>\n34<\/a> of I.P.C is perused.\n<\/p>\n<p id=\"p_4\">     Applicants are in custody since 30.3.2010.<br \/>\n     Learned counsel for the applicants submits that<br \/>\nthe prosecutrix was above 16 years of age.                   No<br \/>\nexternal or internal injury was found on the body of<br \/>\nthe prosecutrix. The incident took place on 11.2.2010<br \/>\nwhereas FIR was lodged on 17.2.2010.             It is alleged<br \/>\nthat applicant Ram Prakash has committed offence<br \/>\nunder <a href=\"\/doc\/1279834\/\" id=\"a_1\">Section 376<\/a> of I.P.C whereas the applicant<br \/>\nSarvan simply held her at that time.          The prosecutrix<br \/>\nhas alleged a concocted story and looking to the<br \/>\ncircumstances, case seems to be of consent and,<br \/>\ntherefore, no offence under <a href=\"\/doc\/1279834\/\" id=\"a_2\">Section 376<\/a> of I.P.C. is<br \/>\n        made out.        The applicants are young youths of 22<br \/>\n       years   of     age    and     they    have     no     criminal     past.<br \/>\n       Therefore, they pray for bail.\n<\/p>\n<p id=\"p_5\">            Learned         Public   Prosecutor       opposes       the    bail<br \/>\n       application.\n<\/p>\n<p id=\"p_6\">            After     perusing       the    case     diary    and    hearing<br \/>\n       aforesaid arguments, without expressing any view on<br \/>\n       the merits of the case, I am of the opinion that this is<br \/>\n       a fit case in which bail may be granted to                          the<br \/>\n       applicants     no.1     and    2     namely    Sarvan      and     Ram<br \/>\n       Prakash.\n<\/p>\n<p id=\"p_7\">            Therefore, application of the applicants Sarvan<br \/>\n       and Ram Prakash under <a href=\"\/doc\/1290514\/\" id=\"a_3\">Section 439<\/a> Cr.P.C. is hereby<br \/>\n       allowed.     They be released on bail on furnishing of a<br \/>\n       bond in sum of Rs.40,000\/- (Rupees forty thousand)<br \/>\n       each with one surety bond of the like sum to the<br \/>\n       satisfaction    of     CJM    Betul    to     appear     before     the<br \/>\n       committal Court and trial Court on the dates given by<br \/>\n       the concerned Court.\n<\/p>\n<p id=\"p_8\">            Certified copy if applied.\n<\/p>\n<p id=\"p_9\">                                                   (N.K.
