Opp. Party.\n                                   -------\n<\/pre>\n<p id=\"p_1\">                    For the Petitioner :Dr. Amrandra Kumar, Adv.<br \/>\n                    For the State     : Mr. Udai Pratap Singh, APP\n<\/p>\n<p id=\"p_1\">                              &#8212;&#8212;-\n<\/p>\n<p id=\"p_2\">2.   09.09.2011               The accused- petitioner has preferred<\/p>\n<p>                  this revision application under <a href=\"\/doc\/1475229\/\" id=\"a_1\">Section 53<\/a> of<\/p>\n<p>                  the Juvenile Justice (Care and <a href=\"\/doc\/1973522\/\" id=\"a_1\">Protection of<\/p>\n<p>                  Children) Act<\/a>, 2000 against the judgment dated<\/p>\n<p>                  29th    July     2010       passed    by   learned        Sessions<\/p>\n<p>                  Judge, Begusarai in Cr. Appeal No.72 of 2010 by<\/p>\n<p>                  which     the    order       dated    12.4.2010      passed        by<\/p>\n<p>                  learned Juvenile Justice Board, Begusarai in<\/p>\n<p>                  Nawkothi        P. S. Case No. 90 of 2008 (G.R. No.<\/p>\n<p>                  3310 \/ 08) under <a href=\"\/doc\/1036212\/\" id=\"a_2\">Sections 25<\/a>(1-b)A, 26, 35 and<\/p>\n<p>                  27 of the <a href=\"\/doc\/1934415\/\" id=\"a_3\">Arms Act<\/a> has been confirmed and the<\/p>\n<p>                  appeal has been dismissed.\n<\/p>\n<pre id=\"pre_1\">                              The       main      contention          of     Learned\n\n                  counsel        for    the     petitioner       is        that     the\n\n                  petitioner       is     a    juvenile      declared        by     the\n\n<\/pre>\n<p id=\"p_3\">                  Juvenile Justice Board. He filed a petition for<\/p>\n<p>                  grant of bail which was rejected by the learned<\/p>\n<p>                  Juvenile        Justice       Board     vide    order           dated<\/p>\n<p>                  12.4.2010, whereafter he filed Cr. Appeal No.<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                     2<\/span><\/p>\n<p>72 of 2010 which has been dismissed by the<\/p>\n<p>learned Sessions Judge on the ground that the<\/p>\n<p>petitioner      was       arrested      at     the     spot      with<\/p>\n<p>firearms and ammunition to murder informant and<\/p>\n<p>witnesses of this case and he is involved in<\/p>\n<p>two   other    cases       of   murder       and    one   case    of<\/p>\n<p>extortion      and        attempt      to     murder.      Learned<\/p>\n<p>counsel       for       the     petitioner          has    further<\/p>\n<p>submitted      that       the   petitioner          has   been     in<\/p>\n<p>custody since 31.8.2008 and under the provision<\/p>\n<p>of Juvenile Justice Act maximum punishment for<\/p>\n<p>a juvenile is three years only. The petitioner<\/p>\n<p>has been in custody for more than three years<\/p>\n<p>in this case.\n<\/p>\n<p id=\"p_4\">            Learned        A.P.P.      for    the    State     could<\/p>\n<p>not controvert the contention of the petitioner<\/p>\n<p>while opposing the prayer.\n<\/p>\n<p id=\"p_5\">            Considering          the        detention     of      the<\/p>\n<p>petitioner in custody, the impugned order is<\/p>\n<p>set   aside.        The    above     named         petitioner      is<\/p>\n<p>directed to be released on bail                     on furnishing<\/p>\n<p>bail bond of Rs.10,000\/- (ten thousand only)<\/p>\n<p>with two sureties of the like amount each to<\/p>\n<p>the satisfaction of learned Juvenile Justice<\/p>\n<p>Board, Begusarai in connection with Nawkothi P.<\/p>\n<p>S. Case No. 90 of 2008 (G. R. No. 3310\/08) with<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           3<\/span><\/p>\n<p>          following conditions;-\n<\/p>\n<p id=\"p_6\">                   (i)    One of the bailors must be the<\/p>\n<p>          father of the petitioner.\n<\/p>\n<p id=\"p_7\">                   (ii)   The    father     of   the    petitioner<\/p>\n<p>          will take care of the petitioner and he will<\/p>\n<p>          produce the petitioner in the Court if and when<\/p>\n<p>          required. In case of absence on two consecutive<\/p>\n<p>          dates, his bail bonds would be liable to be<\/p>\n<p>          cancelled.\n<\/p>\n<p id=\"p_8\">                   (iii) The petitioner will not indulge<\/p>\n<p>          himself in similar or in any other offence.<\/p>\n<p id=\"p_9\">                   (iv)   In    case   of   violation     of   the<\/p>\n<p>          terms and conditions of bail, the bail bond of<\/p>\n<p>          the petitioner will be liable to be cancelled<\/p>\n<p>          by the learned Juvenile Justice Board and he<\/p>\n<p>          will be liable to be taken into custody.<\/p>\n<pre id=\"pre_2\">                   In     the     result,        this    revision\n\n          application is allowed.\n\n\nKanchan                        (Amaresh Kumar Lal, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Prince Kumar @ Pinish Mahto @ &#8230; vs The State Of Bihar on 9 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
