7.   V  secution, PW. 3\u00ab~Thyagaraj u<\/p>\n
elder brother>olf’ .deceased\u00bb.ii\ufb01ihashikala on being informed<\/p>\n
  the deceased, came to Adi<\/p>\n
VCh’u.nch.anagirivllospital in Bellur Cross and on seeing the<\/p>\n
  deadA’ooldyloi’.v’Vh_isa:’ sister, he lodged complaint as per Ex.P.3<\/p>\n
‘~___based on which case was registered and investigation was<\/p>\n
   In the complaint lodged at the earliest point of<\/p>\n
 as per EX.P.8, PW.3 alleged that prior to the marriage<\/p>\n
Vll”~._4during the negotiations, the accused demanded dowry of<\/p>\n
Rs} lakh in cash and gold ornaments for which they<\/p>\n
about the reason for her consuming poison. Therefore,
\nthe learned Sessions Judge was of the opinion
\nevidence of these witnesses who are closely re1_at._e.d’: .
\ndeceased with regard to the a_l1eg_ed   S”
\nacceptance of dowry prior to andw.gat,’_”‘
\nmarriage and subsequent demandof
\nthe fact of deceased having beeVn…u\u00a71’1g\u00bbif;jected.ltocruelty and

\nwitnesses.   Sessions Judge
\nrecorded  has failed to prove
\nthe guilt  In the light of these<\/p>\n
findings ,.recgordued._:loythe”-learned Sessions Judge, we have<\/p>\n
I-carefully.sci’*ut’inized the oral evidence of these witnesses<\/p>\n
and-. we fiiiri\ufb01nio error committed by the learned Sessions<\/p>\n
liillll\ufb01udge in di__sbe,li~eving the testimony of these witnesses and<\/p>\n
 ” aequitting the accused persons.<\/p>\n
it As noticed by the learned Sessions Judge, the<\/p>\n
it  of ?Ws.3 to 6, 9 and 12 who are close relatives of<\/p>\n
 deceased is not consistent and cogent. Their<\/p>\n

Admittedly, during investigation, the statements of<\/p>\n

 this regard.’ ~.l\u00a7Io doubt, PW.3, brother of the deceased in<\/p>\n
 ‘ftompllaint had disclosed these facts. However, his<\/p>\n
._evidence is not corroborated on material particulars by the<\/p>\n
“-other vidtnesses. T he strongest circumstance to disbelieve<\/p>\n
the evidence of these witnesses with regard to the demand<\/p>\n
and acceptance of dowry as also subjecting the deceased<\/p>\n
\ufb01e\/c”\n<\/p>\n

deceased when she was brought to the hospital. V” <\/p>\n

 it is his further say that since the relatives of<\/p>\n
  patient Wanted to take her to major hospital she was<\/p>\n
discharged. In the Cross~eXamination, it was elicited from<\/p>\n
  that patient herself gave the history and that the<\/p>\n
patient did not state as to Whether her husband had<\/p>\n

are of the opinion that the learned Sessions Judge hasnot<\/p>\n
committed any error in acquitting the accused pers’ori’s_ <\/p>\n
the charges levelled against them. The  *<\/p>\n

was a dowry death within Sectiori\u00abV_3i{.l_\u00a5l–;B <\/p>\n
evidence indicated that the accused  ‘any,l\\\u00a7\\ta$?3ua’betted ll<\/p>\n

\nreasons   thlelltludgment of acquittal
