BARH, DISTRICT PATNA\n                                                                 -----PETITIONER\n                                   Versus\nTHE STATE OF BIHAR---------------------------------------------------OPP.PARTY\n                                 -----------\n<\/pre>\n<p id=\"p_1\">2.   23.02.2011           Heard learned counsel for the petitioner and learned<\/p>\n<p>                        A.P.P. for the State.\n<\/p>\n<p id=\"p_1\">                              The petitioner being Junior Engineer is apprehending<\/p>\n<p>                        his arrest in a police case registered under <a href=\"\/doc\/886598\/\" id=\"a_1\">Sections 365<\/a>,<\/p>\n<p>                        <a href=\"\/doc\/1559723\/\" id=\"a_1\">366A<\/a> and <a href=\"\/doc\/1279834\/\" id=\"a_2\">376<\/a>\/<a href=\"\/doc\/1897847\/\" id=\"a_3\">120B<\/a> of the Indian Penal Code.<\/p>\n<p id=\"p_2\">                              The accusation of taking the informant&#8217;s daughter<\/p>\n<p>                        was against Sarda Devi and her brothers Sadanand Risideo<\/p>\n<p>                        and Kalanand Risideo as well as Punia Devi. The name of<\/p>\n<p>                        the petitioner transpired during the course of investigation.<\/p>\n<p>                        The police after investigation submitted final form, as<\/p>\n<p>                        contained in Annexure-2, against the petitioner since the<\/p>\n<p>                        accusation was found false but subsequently cognizance<\/p>\n<p>                        has been taken against the petitioner.\n<\/p>\n<p id=\"p_3\">                              It is submitted by learned counsel for the petitioner<\/p>\n<p>                        that the petitioner is posted since 1999 in Lohardagga and<\/p>\n<p>                        he was not named in the FIR and till date petitioner has<\/p>\n<p>                        neither received any summons nor any warrant was<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          2<\/span><\/p>\n<p>        executed. Moreover the victim girl has not alleged<\/p>\n<p>        anything against this petitioner.\n<\/p>\n<p id=\"p_4\">              Considering the fact that the accusation was found<\/p>\n<p>        false by the police during investigation, let the petitioner<\/p>\n<p>        Shatrughan Choudhary, in the event of his arrest or<\/p>\n<p>        surrender in the court below, be released on bail on<\/p>\n<p>        furnishing bail bond of Rs.10,000\/- (Rupees ten thousand)<\/p>\n<p>        with two sureties of the like amount each to the satisfaction<\/p>\n<p>        of Chief Judicial Magistrate, Araria, in Raniganj (Baunsi)<\/p>\n<p>        P.S.case No. 245\/98, subject to the conditions as laid down<\/p>\n<p>        under <a href=\"\/doc\/1692057\/\" id=\"a_4\">Section 438(2)<\/a> of the Code of Criminal Procedure.<\/p>\n<p id=\"p_5\">              Learned court below will be at liberty to cancel the<\/p>\n<p>        bail bond of the petitioner in case he fails to appear during<\/p>\n<p>        trial on three consecutive dates.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">                                  (Dinesh Kumar Singh,J.)<\/p>\n<p>Spal\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Shatrughan Choudhary vs The State Of Bihar on 23 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
