Nos.1897, 1898\n                      and 1902 OF 2009\n            = = = = = = = = = = = = = = =\n       Dated this the 2nd day of December, 2009.\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     All these appeals are preferred against the awards of<\/p>\n<p>the Motor Accidents Claims Tribunal, Ernakulam in O.P.(MV)<\/p>\n<p>Nos.1091\/00, 720\/00 and 719\/00.       There were two other<\/p>\n<p>connected O.Ps. as 1088\/00 and 810\/00. The amount award<\/p>\n<p>in these cases are in O.P.(MV)720\/00 an amount of<\/p>\n<p>Rs.29,229\/- is awarded in O.P.(MV)1091\/00 Rs.9,546\/- is<\/p>\n<p>awarded and in O.P.(MV)719\/00 Rs.17,145\/- is awarded, in<\/p>\n<p>O.P.(MV)1088\/00 Rs.30,6297\/- is awarded and in O.P.(MV)<\/p>\n<p>810\/00 Rs.4,780\/- is awarded.       In all these cases the<\/p>\n<p>Tribunal gave a finding that these amounts have to be paid<\/p>\n<p>by the insurance company and it can be get it reimbursed<\/p>\n<p>from the first respondent who is the present appellant in this<\/p>\n<p>case for breach of policy conditions.    It is against that<\/p>\n<p>decision the owner who is the first respondent has come up<\/p>\n<p>in appeal.\n<\/p>\n<p id=\"p_1\">M.A.C.A. Nos.1897, 1898<br \/>\n and 1902 OF 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               -:2:-<\/span><\/p>\n<p id=\"p_2\">      2.   Heard the learned counsel for the appellant as well<\/p>\n<p>as the insurance company.        Admittedly the vehicle is a<\/p>\n<p>private vehicle which was carrying passengers beyond its<\/p>\n<p>loading capacity. I am informed that there are almost 7<\/p>\n<p>cases of sustainment of injuries. So at least there is seven<\/p>\n<p>number of persons who were travelling in the vehicle.<\/p>\n<p>Therefore the question that arises for determination is,<\/p>\n<p>firstly whether the policy covers the risk of a passenger in<\/p>\n<p>that vehicle. Secondly, in cases of overloading what will be<\/p>\n<p>the position.\n<\/p>\n<p id=\"p_3\">      3.   So far as the policy is concerned it is a<\/p>\n<p>comprehensive policy and the Tribunal has found that the<\/p>\n<p>policy covers. But it directs reimbursement only on account<\/p>\n<p>of the question of overloading. Time and again decisions are<\/p>\n<p>to the effect that mere overloading of a vehicle will not<\/p>\n<p>amount to fundamental breach of policy conditions so as to<\/p>\n<p>exonerate the insurance company from the liability. But a<\/p>\n<p>question may arise that when passengers are overloaded<\/p>\n<p>beyond the capacity prescribed in the policy what will be the<\/p>\n<p>M.A.C.A. Nos.1897, 1898<br \/>\n  and 1902 OF 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                -:3:-<\/span><\/p>\n<p>liability of the insurance company.     This matter has been<\/p>\n<p>precisely considered by the Hon&#8217;ble Supreme Court of India<\/p>\n<p>in the decision reported in 2007 (3) KLT 993 <a href=\"\/doc\/1633949\/\" id=\"a_1\">National<\/p>\n<p>Insurance Company v. Anjana Shyam<\/a>). It was a case<\/p>\n<p>where in a bus having a capacity of 42 passengers 90<\/p>\n<p>persons were loaded and the vehicle met with an accident<\/p>\n<p>resulting in death of so many persons and serious injuries to<\/p>\n<p>very many persons. 90 petitions were pending before the<\/p>\n<p>Tribunal. Then the Supreme Court held that when the policy<\/p>\n<p>covers the risk of only a definite number of persons it may<\/p>\n<p>not be correct to fasten the liability on the insurance<\/p>\n<p>company for more than that and therefore followed a<\/p>\n<p>practical procedure as follows.\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                  &#8220;The practical and proper course<\/p>\n<p>            would be to hold that the insurance<\/p>\n<p>            company, in such a case, would be bound<\/p>\n<p>            to cover the higher of the various awards<\/p>\n<p>            and will be compelled to deposit the higher<\/p>\n<p>            of the amounts of compensation awarded<\/p>\n<p>            to the extent of the number of passengers<\/p>\n<p>            covered    by    the     insurance  policy.<\/p>\n<\/blockquote>\n<p id=\"p_4\">M.A.C.A. Nos.1897, 1898<br \/>\n and 1902 OF 2009<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                              -:4:-<\/span><\/p>\n<p>         Illustratively, we may put it like this. In<\/p>\n<p>         the case on hand, 42 passengers were the<\/p>\n<p>         permitted passengers and they are the<\/p>\n<p>         ones who have been insured by the<\/p>\n<p>         insurance company.        90 persons have<\/p>\n<p>         either died or got injured in the accident.<\/p>\n<p>         Awards have been passed for varied sums.<\/p>\n<p>         The Tribunal should take into account, the<\/p>\n<p>         higher of the 42 awards made, add them<\/p>\n<p>         up and direct the insurance company to<\/p>\n<p>         deposit that lump sum. Thus, the liability<\/p>\n<p>         of the insurance company would be to pay<\/p>\n<p>         the compensation awarded to 42 out of the<\/p>\n<p>         90 passengers.     It is to ensure that the<\/p>\n<p>         maximum      benefit   is  derived by   the<\/p>\n<p>         insurance taken for the passengers of the<\/p>\n<p>         vehicle, that we hold that the 42 awards to<\/p>\n<p>         be satisfied by the insurance company<\/p>\n<p>         would be the 42 awards in the descending<\/p>\n<p>         order starting from the highest of the<\/p>\n<p>         awards. In other words, the higher of the<\/p>\n<p>         42 awards will be taken into account and it<\/p>\n<p>         would be the sum total of those higher 42<\/p>\n<p>         awards that would be the amount that the<\/p>\n<p>         insurance company would be liable to<\/p>\n<p>M.A.C.A. Nos.1897, 1898<br \/>\n and 1902 OF 2009<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                -:5:-<\/span><\/p>\n<p>           deposit.     It will be for the Tribunal<\/p>\n<p>           thereafter to direct distribution of the<\/p>\n<p>           money so deposited by the insurance<\/p>\n<p>           company      proportionately   to   all  the<\/p>\n<p>           claimants, here all the 90, and leave all the<\/p>\n<p>           claimants to recover the balance from the<\/p>\n<p>           owner of the vehicle. In such cases, it will<\/p>\n<p>           be necessary for the Tribunal, even at the<\/p>\n<p>           initial stage, to make appropriate orders to<\/p>\n<p>           ensure that the amount could be recovered<\/p>\n<p>           from the owner by ordering attachment or<\/p>\n<p>           by passing other restrictive orders against<\/p>\n<p>           the owner so as to ensure the satisfaction<\/p>\n<p>           in full of the awards that may be passed<\/p>\n<p>           ultimately.&#8221;\n<\/p>\n<p id=\"p_5\">     4.    So the crux of the decision is that the highest of<\/p>\n<p>the permissible awards which means suppose there are<\/p>\n<p>seven persons and the loading capacity is only 5 then highest<\/p>\n<p>of the five awards should be taken out and added and the<\/p>\n<p>entire cases arising out of that accident also has to be taken<\/p>\n<p>and in proportion of these five award amounts, amount has<\/p>\n<p>to be distributed among the claimants liable to be paid by<\/p>\n<p>M.A.C.A. Nos.1897, 1898<br \/>\n  and 1902 OF 2009<br \/>\n<span class=\"hidden_text\" id=\"span_4\">                               -:6:-<\/span><\/p>\n<p>the insurance company.       For the balance amounts the<\/p>\n<p>claimants have to resort to and the Court has to award that<\/p>\n<p>particular amount to be given by the owner of the vehicle.<\/p>\n<p>So applying the dictum laid down in this decision the<\/p>\n<p>compensation and the liability apportionment etc. has to be<\/p>\n<p>worked out and therefore, for the said purpose, I remand the<\/p>\n<p>case back to the Tribunal with a specific direction to fix the<\/p>\n<p>liability of the insurance company in proportion to the<\/p>\n<p>highest number of awards as well the balance liability on the<\/p>\n<p>owner which accrues after the satisfaction of the highest<\/p>\n<p>number of awards. This can be done after hearing both the<\/p>\n<p>sides. Parties are directed to appear before the Tribunal on<\/p>\n<p>7.1.2010.\n<\/p>\n<p id=\"p_6\">       MACAs. are disposed of accordingly.<\/p>\n<p id=\"p_7\">                           M.N.
