GIRI, J.\n               - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                       W.P.(C)No<\/a>. 32180 OF 2008\n               - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n              Dated this the 12th day of November, 2008\n\n                                   JUDGMENT\n<\/pre>\n<p id=\"p_1\">      A vehicle purchased by the petitioner was financed by the<\/p>\n<p>Pathanamthitta Branch of the 1st respondent. It seems that there is<\/p>\n<p>default in repayment of the loan amount.                     Though the petitioner<\/p>\n<p>submits that he is ready and willing to pay the balance amount as per<\/p>\n<p>the agreement, the respondents have not accepted the same. It<\/p>\n<p>seems that the 2nd respondent is also a party to the agreement.<\/p>\n<p>Petitioner submits that there is an arbitration clause in the<\/p>\n<p>agreement.     This would entitle him to seek an arbitration of the<\/p>\n<p>dispute between him and respondents 1 and 2 as per the process of<\/p>\n<p>Arbitration and <a href=\"\/doc\/1306164\/\" id=\"a_1\">Conciliation Act<\/a>. The Writ Petition is filed in the wake<\/p>\n<p>of   the petitioner&#8217;s contention that, Ext.P3, filed before the 1st<\/p>\n<p>respondent for a certified copy of the agreement, which according to<\/p>\n<p>the petitioner contain the arbitration clause, is not yet responded to.<\/p>\n<p id=\"p_1\">      2. Counsel for the respondents submits that Ext.P3 as such<\/p>\n<p>has not been received in the office of the Manager of the 1st<\/p>\n<p>respondent in Thiruvananthapuram. If the petitioner makes a fresh<\/p>\n<p>request, the same shall be responded to with a copy of the<\/p>\n<p>W.P.(C)No. 32180 OF 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              -:2:-<\/span><\/p>\n<p>agreement.
