Heard finally by consent of the learned<\/p>\n<p>    counsel of the learned counsel for the parties.\n<\/p>\n<p id=\"p_2\">    2.        This petition raises an interesting question about<\/p>\n<p>    rights and duties of representatives democratically elected<\/p>\n<p>    to local self-governing body.\n<\/p>\n<p id=\"p_3\">    3.        The petitioners as well as respondent No.2 are<\/p>\n<p>    elected members of Gram Panchayat, Mahadulla.                    One<\/p>\n<p>    Smt. Nirmala Bonde had been elected as Sarpanch.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                               ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 3<\/span><\/p>\n<p id=\"p_4\">    According to the petitioners, since Smt. Nirmala Bonde was<\/p>\n<p>    not acting in the interest of Gram Panchayat and people at<\/p>\n<p>    large, they moved a motion of no confidence on 5-8-2006,<\/p>\n<p>    which was passed by majority. The Collector had unseated<\/p>\n<p>    Smt. Nirmala Bonde as a result of no confidence motion<\/p>\n<p>    being passed. Thereafter elections for the post of Sarpanch<\/p>\n<p>    and Up-Sarpanch were held and the petitioner Nos.2 and 7<\/p>\n<p>    claimed to have been elected as Sarpanch and Up-Sarpanch<\/p>\n<p>    respectively. Smt. Nirmala Bonde&#8217;s appeal before the<\/p>\n<p>    Commissioner was, however, pending.             It seems that<\/p>\n<p>    respondent No.2 Ratnadeep Rangari was also shown as<\/p>\n<p>    Ex Sarpanch of Gram Panchayat, though it is not clear from<\/p>\n<p>    the petition as to how and when said Ratnadeep Rangari<\/p>\n<p>    became Sarpanch.\n<\/p>\n<p id=\"p_5\">    4.       On 26-10-2006, Smt. Nirmala Bonde made a<\/p>\n<p>    complaint to the Chief Executive Officer about misconduct<\/p>\n<p>    by the petitioners in discharge of their duties, abuse of their<\/p>\n<p>    powers and obstruction in the work of Gram Panchayat.\n<\/p>\n<p id=\"p_6\">    The Chief Executive Officer seems to have issued show<\/p>\n<p>    cause notices in pursuance of the complaint received from<\/p>\n<p>    Smt. Nirmala Bonde.     All the petitioners replied to these<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                   4<\/span><\/p>\n<p>    show cause notices in December, 2006. These replies are<\/p>\n<p>    similar worded. The petitioners also wrote on 10-2-2008 to<\/p>\n<p>    the Deputy Chief Executive Officer, since it seems that the<\/p>\n<p>    Chief Executive Officer had entrusted the enquiry to the<\/p>\n<p>    Deputy Chief Executive Officer, reiterating that they had not<\/p>\n<p>    misconducted themselves and that the complaint should be<\/p>\n<p>    filed.\n<\/p>\n<p id=\"p_7\">    5.<\/p>\n<p>               After a hearing on 24-3-2008, the Chief Executive<\/p>\n<p>    Officer submitted a report, which is at Annexure III, holding<\/p>\n<p>    that     the   petitioners   were    liable   for   action        under<\/p>\n<p>    Section 39(1) of the Bombay Village Panchayats Act, 1958.\n<\/p>\n<p id=\"p_8\">    In pursuance to this report of the Chief Executive Officer,<\/p>\n<p>    the Divisional Commissioner, Nagpur Division, Nagpur, by<\/p>\n<p>    his order dated 23-4-2009, unseated the petitioners from<\/p>\n<p>    the post of members of Gram Panchayat. The petitioners<\/p>\n<p>    preferred an appeal before the Government, which was<\/p>\n<p>    decided by the Hon&#8217;ble Minister of State for Rural<\/p>\n<p>    Development, by his order dated 24-7-2009, whereby he<\/p>\n<p>    dismissed the said appeal.            Aggrieved thereby, the<\/p>\n<p>    petitioners are before this Court.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_5\">                                5<\/span><\/p>\n<p id=\"p_9\">    6.       The misconduct, which the petitioners are alleged<\/p>\n<p>    to have committed and in respect of which a complaint was<\/p>\n<p>    made by Smt. Bonde, appears to be causing obstruction in<\/p>\n<p>    the work of Gram Panchayat by opposing all the resolutions<\/p>\n<p>    brought in the meetings of Gram Panchayat.           The Chief<\/p>\n<p>    Executive Officer observed in his enquiry report that the<\/p>\n<p>    petitioners had recorded their opposition to the resolutions<\/p>\n<p>    pertaining to confirmation of minutes of previous meeting,<\/p>\n<p>    approval to income and expenditure of previous month, and<\/p>\n<p>    even reading of Government circulars. They also opposed<\/p>\n<p>    the resolutions about levy and recovery of taxes, and the<\/p>\n<p>    resolutions pertaining to execution of works under National<\/p>\n<p>    Rural Employment Scheme, works sanctioned by the 12th<\/p>\n<p>    Finance Commission, works like cleaning of drains, lighting,<\/p>\n<p>    water supply, etc.<\/p>\n<p>    6A.      The petitioners do not dispute that they had<\/p>\n<p>    opposed these resolutions, but they stated in the replies<\/p>\n<p>    filed before the Chief Executive Officer and the Deputy<\/p>\n<p>    Chief Executive Officer that the then Sarpanch, who was in<\/p>\n<p>    a minority, was not conducting the affairs of Gram<\/p>\n<p>    Panchayat by taking all the members in confidence. They<\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                             ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_7\">                               6<\/span><\/p>\n<p>    stated that the Sarpanch did not read the proceedings of<\/p>\n<p>    the previous meeting and indulged in making alterations in<\/p>\n<p>    the minutes.   According to them, the Sarpanch used to<\/p>\n<p>    authorize the expenditure, which was not in accordance<\/p>\n<p>    with the Gram Panchayat budget.     They wondered as to<\/p>\n<p>    how they could sanction wrong expenditure or expenditure<\/p>\n<p>    involving corruption.   They stated that the Government<\/p>\n<p>    circulars were not read and, therefore, there was no<\/p>\n<p>    alternative but to record their opposition.    They claimed<\/p>\n<p>    that even they wanted that the taxes should be recovered &#8211;\n<\/p>\n<p id=\"p_10\">    but revised taxes should be demanded and recovered in<\/p>\n<p>    accordance with the new rules.    They claimed that they<\/p>\n<p>    wanted that the income of Gram Panchayat should<\/p>\n<p>    increased by levying taxes.      According to them, the<\/p>\n<p>    Sarpanch used to prepare proceedings in advance and<\/p>\n<p>    rather than taking up works, which were demanded by the<\/p>\n<p>    citizens, she used to proceed with the works of her<\/p>\n<p>    favourites.\n<\/p>\n<p id=\"p_11\">    6B.      The petitioners claimed that they were ready to<\/p>\n<p>    approve the works under the National Rural Employment<\/p>\n<p>    Scheme and 12th Finance Commission, if the works in which<\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                             ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_9\">                                 7<\/span><\/p>\n<p>    both the sides were interested were taken up. They alleged<\/p>\n<p>    that an attempt to draw bogus bills by inserting false names<\/p>\n<p>    of labourers for the works in the wards was noticed. They<\/p>\n<p>    wanted that after the drains were cleaned in their wards,<\/p>\n<p>    their signatures should have been obtained. They opposed<\/p>\n<p>    purchase of bleaching powder for water supply schemes,<\/p>\n<p>    because such purchase was sought to be made without<\/p>\n<p>    inviting quotations from various shopkeepers, but by<\/p>\n<p>    inviting quotation from only one shopkeeper and without<\/p>\n<p>    getting the material tested.      They stated that they had<\/p>\n<p>    recorded their opposition in order to avoid being party to<\/p>\n<p>    any corrupt practice. They have reiterated these claims in<\/p>\n<p>    the present petition.\n<\/p>\n<p id=\"p_12\">    7.       I   have   heard   the   learned   counsel        for     the<\/p>\n<p>    petitioners; the learned Government Pleader for respondent<\/p>\n<p>    Nos.1 and 5; the learned counsel for respondent No.2; and<\/p>\n<p>    the learned counsel for respondent No.4.\n<\/p>\n<p id=\"p_13\">    8.       The learned counsel for the petitioners submitted<\/p>\n<p>    that the Chief Executive Officer had to conduct the enquiry<\/p>\n<p>    himself and by delegating the same to the Deputy Chief<\/p>\n<p><span class=\"hidden_text\" id=\"span_10\">                                                ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_11\">                                 8<\/span><\/p>\n<p>    Executive officer, the enquiry and actions based upon it are<\/p>\n<p>    vitiated.\n<\/p>\n<p id=\"p_14\">    9.          <a href=\"\/doc\/233892\/\" id=\"a_1\">In Nimba Yadav Bhoi v. President, Standing<\/p>\n<p>    Committee, Zilla Parishad, Jalgaon and others<\/a>, reported at<\/p>\n<p>    2002(3) Mh.L.J. 466, on which the learned counsel for the<\/p>\n<p>    petitioner relied this Court was considering the provisions of<\/p>\n<p>    Section 39(1) of the Bombay Village Panchayats Act and<\/p>\n<p>    observed that the provisions were mandatory and hence<\/p>\n<p>    the Chief Executive Officer could not have delegated his<\/p>\n<p>    power to conduct an enquiry to the Deputy Chief Executive<\/p>\n<p>    Officer.\n<\/p>\n<p id=\"p_15\">    10.         The learned Government Pleader submitted that<\/p>\n<p>    the Chief Executive Officer could always use his machinery<\/p>\n<p>    for collecting material.    Therefore, the grievance about<\/p>\n<p>    collection of material by the Deputy Chief Executive Officer<\/p>\n<p>    on which the Chief Executive Officer only relied ought to be<\/p>\n<p>    rejected.     According to the petitioners, there was no<\/p>\n<p>    application of mind on the part of the Chief Executive<\/p>\n<p>    Officer.    Report, which is annexed at Annexure-III to the<\/p>\n<p>    petition,   shows   that   he   had   merely   recounted          the<\/p>\n<p><span class=\"hidden_text\" id=\"span_12\">                                               ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_13\">                                 9<\/span><\/p>\n<p>    allegations against the petitioners, and the fact that the<\/p>\n<p>    petitioners were served with show cause notices, and were<\/p>\n<p>    called upon to attend a personal hearing.          The learned<\/p>\n<p>    counsel for the petitioner stated that the Chief Executive<\/p>\n<p>    Officer heard the petitioners in person as also the Village<\/p>\n<p>    Development Officer and the Extension Officer of Panchayat<\/p>\n<p>    Samiti and then simply drew his conclusions without giving<\/p>\n<p>    any reasons. He then reported that since the petitioners<\/p>\n<p>    had abused their position and had failed to perform their<\/p>\n<p>    duties, they were liable for action under Section 39(1) of the<\/p>\n<p>    Bombay Village Panchayats Act.\n<\/p>\n<p id=\"p_16\">    11.        The learned counsel for the petitioners relied on a<\/p>\n<p>    judgment of this Court in Kum. Nirmala Tikana Giripo v.\n<\/p>\n<p id=\"p_17\">    State of Maharashtra and others, reported at 2009(1) All MR<\/p>\n<p id=\"p_18\">    91.   In that case, the Court was considering the order<\/p>\n<p>    passed by the Hon&#8217;ble Minister for Food and Civil Supplies in<\/p>\n<p>    respect of allotment of a ration shop. This Court referred to<\/p>\n<p>    a number of judgments of the Supreme Court in respect of<\/p>\n<p>    requirement of a speaking order and the necessity of giving<\/p>\n<p>    reasons.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_14\">                                               ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_15\">                                    10<\/span><\/p>\n<p id=\"p_19\">    12.        I have carefully considered these contentions.\n<\/p>\n<p id=\"p_20\">    The learned Government Pleader is right in submitting that<\/p>\n<p>    the Chief Executive Officer may have requisite material<\/p>\n<p>    collected by his subordinates. But it does not follow that his<\/p>\n<p>    report should not reflect any reasons for the conclusions<\/p>\n<p>    which he drew.     And, in my view, the report is woefully<\/p>\n<p>    deficient as far as reasons go. Such a report could not have<\/p>\n<p>    been   a    foundation   for    drastic   action    of     unseating<\/p>\n<p>    democratically elected members of the Panchayat.\n<\/p>\n<p id=\"p_21\">    13.        The learned counsel for the petitioners submitted<\/p>\n<p>    that the petitioners had applied before the Divisional<\/p>\n<p>    Commissioner, Nagpur Division, Nagpur, for copies of all the<\/p>\n<p>    relevant documents and the copy of the complaint of the<\/p>\n<p>    deposed Sarpanch. This application is at Annexure IV to the<\/p>\n<p>    petition. The petitioners had on 1st July, 2008 sought time<\/p>\n<p>    to file reply till they got copies of the documents. According<\/p>\n<p>    to the learned counsel for the petitioners, these documents<\/p>\n<p>    were not supplied to the petitioner and this fact was<\/p>\n<p>    specifically mentioned in the reply filed by the petitioners<\/p>\n<p>    before the Divisional Commissioner, which is at Annexure-V.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_16\">                                                  ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_17\">                                  11<\/span><\/p>\n<p id=\"p_22\">    14.      The learned counsel for the petitioners relied on a<\/p>\n<p>    decision in <a href=\"\/doc\/448824\/\" id=\"a_1\">Smt. Savitri Chandrakesh Pal v. State of<\/p>\n<p>    Maharashtra and others<\/a>, reported at 1009(4) All MR 200. In<\/p>\n<p>    that case, this Court held that in any quasi judicial<\/p>\n<p>    proceeding, non-supply of adverse material to the affected<\/p>\n<p>    person, but supply thereof to the authority taking decision<\/p>\n<p>    against him on that basis, constitutes violation of natural<\/p>\n<p>    justice. Therefore, according to the learned counsel for the<\/p>\n<p>    petitioners, in the absence of availability of documents to<\/p>\n<p>    the petitioners, the order of the Divisional Commissioner<\/p>\n<p>    was vitiated.\n<\/p>\n<p id=\"p_23\">    15.      The learned Government Pleader rightly repelled<\/p>\n<p>    these submissions by pointing out that the replies filed by<\/p>\n<p>    the   petitioners   before    the   Chief   Executive         Officer<\/p>\n<p>    themselves show that the petitioners had responded to the<\/p>\n<p>    allegations in the complaint clause-by-clause, which they<\/p>\n<p>    could not have done, had they not been in receipt of the<\/p>\n<p>    complaint. Therefore, the contention of the petitioners that<\/p>\n<p>    they had not received the copy of the complaint and that,<\/p>\n<p>    therefore, the orders passed against them were vitiated,<\/p>\n<p>    has no force.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_18\">                                                ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_19\">                                12<\/span><\/p>\n<p id=\"p_24\">    16.      This takes me to the question whether the<\/p>\n<p>    authorities were justified in holding that the petitioners<\/p>\n<p>    were guilty of conduct referred to in Section 39(1) of the Act<\/p>\n<p>    entailing their removal.    Section 39(1) may be usefully<\/p>\n<p>    reproduced as under :\n<\/p>\n<blockquote id=\"blockquote_1\"><p>             &#8220;39. Removal from office :- (1) The Commissioner<br \/>\n             may,&#8211;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             (i)<\/p>\n<p>                  remove from office any member or any<br \/>\n             Sarpanch or Upa-Sarpanch who has been guilty of<\/p>\n<p>             misconduct in the discharge of his duties, or of<br \/>\n             any disgraceful conduct, or of neglect of or<br \/>\n             incapacity to perform his duty , or is persistently<br \/>\n             remiss in the discharge thereof. A Sarpanch or<\/p>\n<p>             Upa-Sarpanch so removed may at the discretion of<br \/>\n             the Commissioner also be removed from the<\/p>\n<p>             Panchayat; or<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_2\"><p>             (ii) remove from office the member, Sarpanch or<br \/>\n             as the case may be, Upa-Sarpanch if not less than<\/p>\n<p>             twenty per cent, of the total number of voters in<br \/>\n             the village who have paid all dues of the<br \/>\n             Panchayat regarding taxes on buildings and lands<br \/>\n             and water charges, make a complaint that the<br \/>\n             annual accounts and the report of the expenditure<\/p>\n<p>             incurred by the panchayat on the development<br \/>\n             activities are not placed before the Gram Sabha;<br \/>\n             and the information thereof is not displayed on the<br \/>\n             notice board as required by sub-section (1) or (1-<br \/>\n             A) of section 8:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                       Provided that, no such person shall be<br \/>\n             removed from office unless, in case of clause (i),<br \/>\n             the Chief Executive Officer or in case of clause (ii),<br \/>\n             the Deputy Chief Executive officer as directed by<\/p>\n<p><span class=\"hidden_text\" id=\"span_20\">                                               ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_21\">                                 13<\/span><\/p>\n<p>             the Chief Executive Officer; under the orders of<br \/>\n             the Commissioner, holds an inquiry after giving<\/p>\n<p>             due notice to the panchayat and the person<br \/>\n             concerned; and the person concerned has been<\/p>\n<p>             given a reasonable opportunity of being heard and<br \/>\n             thereafter the Chief Executive Officer or, as the<br \/>\n             case may be, the Deputy Chief Executive Officer<br \/>\n             concerned through the Chief Executive officer,<br \/>\n             submits his report to the Commissioner. The<\/p>\n<p>             inquiry officer shall submit his report within a<br \/>\n             period of one month:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                      Provided further that, the Commissioner<\/p>\n<p>             shall, after giving the person concerned a<br \/>\n             reasonable opportunity of being heard, take a<\/p>\n<p>             decision on the report submitted by the Chief<br \/>\n             Executive Officer or, as the case may be, the<br \/>\n             Deputy Chief Executive Officer, within a period of<br \/>\n             one month from the date of receipt thereof.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_25\">    17.      It may be seen that a member has to be guilty of<\/p>\n<p>    misconduct in the discharge of his duties, or of any<\/p>\n<p>    disgraceful conduct, or of neglect of or incapacity to<\/p>\n<p>    perform his duty, or is persistently remiss in the discharge<\/p>\n<p>    of duties. &#8216;Misconduct&#8217; has not been defined in the Act. It is<\/p>\n<p>    not alleged that the petitioners had indulged in any<\/p>\n<p>    disgraceful conduct.      They are not suffering from any<\/p>\n<p>    infirmity in discharge of their duties. It may be seen from<\/p>\n<p>    the   report   of   the   Chief   Executive     Officer       to     the<\/p>\n<p>    Commissioner that the petitioners are alleged to have<\/p>\n<p>    misused their offices and failed to discharge their duties.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_22\">                                                  ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_23\">                                  14<\/span><\/p>\n<p id=\"p_26\">    Therefore, it is not necessary to examine whether the<\/p>\n<p>    conduct    attributed   to   the   petitioners    amounts           to<\/p>\n<p>    misconduct.    The impugned orders do not indicate any<\/p>\n<p>    misuse of office by the petitioners.     The enquiry by this<\/p>\n<p>    Court would have to be restricted to the question as to<\/p>\n<p>    whether the petitioners&#8217; conduct amounted to neglect in<\/p>\n<p>    performing their duties or whether they are persistently<\/p>\n<p>    remiss in discharge of their duties.\n<\/p>\n<p id=\"p_27\">    18.       Before going into the facts of the case at hand, it<\/p>\n<p>    may be useful to refer to two judgments cited at bar, in<\/p>\n<p>    order to examine the facts with reference to the principles<\/p>\n<p>    emerging from these judgments, though delivered in the<\/p>\n<p>    context of the provisions of the Maharashtra Municipal<\/p>\n<p>    Councils, Nagar Panchayats and Industrial Townships Act,<\/p>\n<p><span class=\"hidden_text\" id=\"span_24\">    1965<\/span><\/p>\n<p id=\"p_28\">    19.       In Sureshkumar s\/<a href=\"\/doc\/209059\/\" id=\"a_2\">o Kanhaiyalal Jethlia v. State of<\/p>\n<p>    Maharashtra and others<\/a>, reported at 2001(1) Mh.L.J. 901,<\/p>\n<p>    this Court held in relation to         Section 55-A of the<\/p>\n<p>    Maharashtra Municipal Councils, Nagar Panchayats and<\/p>\n<p>    Industrial Townships Act, 1965 that an omission to do what<\/p>\n<p><span class=\"hidden_text\" id=\"span_25\">                                               ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_26\">                                  15<\/span><\/p>\n<p>    is required by a person to do may constitute a misconduct<\/p>\n<p>    even though a person has not acted wilfully or maliciously.\n<\/p>\n<p id=\"p_29\">    The failure to do a thing itself may not be a misconduct, but<\/p>\n<p>    if the failure is deliberate or motivated, it may amount to<\/p>\n<p>    misconduct. It was further observed that what matters is<\/p>\n<p>    the seriousness of the acts of misconduct and not mere<\/p>\n<p>    persistent or repeated defaults.\n<\/p>\n<p id=\"p_30\">    20.<\/p>\n<p>               <a href=\"\/doc\/1587942\/\" id=\"a_3\">In Baburao Vishwvanath Mathpati v. State of<\/p>\n<p>    Maharashtra and others<\/a>, reported at 1996(1) Mh.L.J. 366, a<\/p>\n<p>    Division Bench of this Court was considering the word<\/p>\n<p>    &#8216;neglect&#8217; appearing in Section 55-A of the Maharashtra<\/p>\n<p>    Municipal Councils Act, 1965 in relation to the power of the<\/p>\n<p>    Government to remove the President of the Municipal<\/p>\n<p>    Council.    After considering a number of judgments on<\/p>\n<p>    statutory interpretation, the Bench concluded in para 50 as<\/p>\n<p>    under :\n<\/p>\n<blockquote id=\"blockquote_5\"><p>               &#8220;50.     We may observe that a confusion may<\/p>\n<p>               arise   by   reading   the   words    &#8216;neglect&#8217;        and<\/p>\n<p>               &#8216;negligence&#8217;. The word &#8216;neglect&#8217; appears to have<\/p>\n<p>               a different connotation than the word &#8216;negligence&#8217;.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_27\">                                                ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_28\">                              16<\/span><\/p>\n<p id=\"p_31\">     The word &#8216;neglect&#8217; as earlier said means &#8216;gross<\/p>\n<p>     neglect&#8217;, wilful, intentional, culpable or flagrant<\/p>\n<p>     disregard of duties.          It is mentioned earlier that<\/p>\n<p>     the    President    of       Municipal      Council        can      be<\/p>\n<p>     dislodged by resorting to the power conferred on<\/p>\n<p>     the councillors by moving no-confidence motion<\/p>\n<p>     under section 55 of the Act for no grounds or<\/p>\n<p>     reasons are required to be stated.                    The object<\/p>\n<p>     behind this is that there should not be any stigma<\/p>\n<p>     on the President so removed.                    We have also<\/p>\n<p>     referred to section 313 of the Act where the power<\/p>\n<p>     is    conferred    on        the    State   Government             for<\/p>\n<p>     supersession       of        the    municipal        council        by<\/p>\n<p>     appointing an administrator.                 There the word<\/p>\n<p>     &#8220;misconduct&#8221; has been interpreted to mean<\/p>\n<p>     &#8220;gross misconduct&#8221;.            Section 55A of the Act no<\/p>\n<p>     doubt confers power on the State Government to<\/p>\n<p>     remove the President on account of &#8220;misconduct,<\/p>\n<p>     neglect of duties, incapacity to perform duties and<\/p>\n<p>     disgraceful conduct.&#8221;              This provision sufficiently<\/p>\n<p>     entails civil consequences and attaches stigma to<\/p>\n<p>     the President and therefore, in order to remove a<\/p>\n<p><span class=\"hidden_text\" id=\"span_29\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_30\">                        17<\/span><\/p>\n<p>     president on these grounds the order must be<\/p>\n<p>     founded on strong grounds. Therefore, the word<\/p>\n<p>     &#8220;neglect&#8221; must be understood from the gravity of<\/p>\n<p>     the charges and therefore, the word &#8220;neglect&#8221; as<\/p>\n<p>     used in the section means &#8220;gross neglect&#8221; which<\/p>\n<p>     may   be      synonymous   to   the   word        &#8220;wilful,<\/p>\n<p>     intentional or culpable as the case may be&#8221;.\n<\/p>\n<p id=\"p_32\">     There should be flagrant disregard of duties so as<\/p>\n<p>     to call for removal of the President under section<\/p>\n<p>     55A of the Act.    Therefore, applying the &#8216;golden<\/p>\n<p>     rule&#8217; of construction of statute which has been<\/p>\n<p>     recognised by the Apex Court, we have no<\/p>\n<p>     hesitation to come to the conclusion that the word<\/p>\n<p>     &#8216;neglect&#8217; has a connotation as &#8216;gross&#8217;, &#8216;wilful&#8217; or<\/p>\n<p>     &#8216;intentional&#8217; neglect. Here we are concerned with<\/p>\n<p>     either gross neglect or gross statutory neglect on<\/p>\n<p>     the part of the petitioner. We, therefore, proceed<\/p>\n<p>     to consider the other contention of the learned<\/p>\n<p>     counsel in regard to the procedure to be followed<\/p>\n<p>     when power under section 55A of the Act is to be<\/p>\n<p>     exercised.&#8221;\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_31\">                                      ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_32\">                                 18<\/span><\/p>\n<p id=\"p_33\">    21.      The duties of the members of Gram Panchayat<\/p>\n<p>    have also not been defined in the Act. The learned counsel<\/p>\n<p>    for the petitioners submitted that if the business of Gram<\/p>\n<p>    Panchayat was to be conducted by putting requisite<\/p>\n<p>    resolutions to vote at a Gram Panchayat meeting, it would<\/p>\n<p>    follow that the members would have a right to vote either<\/p>\n<p>    way.   He submitted that as of now the members do not<\/p>\n<p>    have a duty to vote at all and a member could even abstain<\/p>\n<p>    from voting.\n<\/p>\n<p id=\"p_34\">    22.      The learned counsel for the petitioners submitted<\/p>\n<p>    that in <a href=\"\/doc\/1867182\/\" id=\"a_4\">Lily Thomas (Ms.) Advocate v. Speaker, Lok Sabha<\/p>\n<p>    and others<\/a>, reported at (1993) 4 SCC 234, the Supreme<\/p>\n<p>    Court was considering abstention from voting by the<\/p>\n<p>    members of a political party in motion of impeachment<\/p>\n<p>    against a Judge of the Supreme Court. The Court held in<\/p>\n<p>    para 2 of the judgment as under :\n<\/p>\n<blockquote id=\"blockquote_6\"><p>             &#8220;2. &#8230; Right to vote means right to exercise the<\/p>\n<p>             right in favour of or against the motion or<\/p>\n<p>             resolution.   Such a right implies right to remain<\/p>\n<p>             neutral as well.        &#8216;Neutral&#8217; means, &#8216;indifferent,<\/p>\n<p><span class=\"hidden_text\" id=\"span_33\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_34\">                                    19<\/span><\/p>\n<p>             unbiased, impartial, not engaged on either side&#8217;.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>             Conceptually it is not aligning with either view.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>             But what happens where a person entitled to vote<\/p>\n<p>             on a resolution participates in discussion but<\/p>\n<p>             abstains from voting. It is neither neutrality not<\/p>\n<p>             expression of opinion one way or the other. Yet it<\/p>\n<p>             is legitimate and valid. In removal of an elected<\/p>\n<p>             representative by vote of no confidence neutrality,<\/p>\n<p>             partial   or<br \/>\n                         ig  complete,      is    not      unknown.               A<\/p>\n<p>             construction as suggested by the petitioner would<\/p>\n<p>             lead to uncertainty as, if non-exercise of right by a<\/p>\n<p>             member,        even   though        present,      amounts           to<\/p>\n<p>             support, it shall frustrate the entire removal<\/p>\n<p>             process based on exercise of the right.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_35\">    23.      The right to vote either for or against the<\/p>\n<p>    resolution can be exercised by the member even in respect<\/p>\n<p>    of a formal resolution and it is his free will which would<\/p>\n<p>    determine on which side he would vote.                          Therefore,<\/p>\n<p>    according to the learned counsel for the petitioner, if a<\/p>\n<p>    resolution is required to be considered at a meeting, it<\/p>\n<p>    implies that the members at the meeting would have a right<\/p>\n<p><span class=\"hidden_text\" id=\"span_35\">                                                        ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_36\">                                20<\/span><\/p>\n<p>    to vote either for or against the resolution and, therefore,<\/p>\n<p>    without going into the question as to what was the nature<\/p>\n<p>    of the resolutions tabled, the petitioners&#8217; right to vote<\/p>\n<p>    against such resolutions had to be recognized.                    He<\/p>\n<p>    submitted that this was apart from the fact that the<\/p>\n<p>    petitioners had a good justification for voting against the<\/p>\n<p>    resolutions, which they had putforth in their replies to the<\/p>\n<p>    Chief Executive Officer. He submitted that it would not be<\/p>\n<p>    open to the Chief Executive Officer, or for that matter to<\/p>\n<p>    any authority, to examine whether the justification offered<\/p>\n<p>    by the petitioners was proper or not, since it would be a<\/p>\n<p>    matter of perception of the petitioners. If the petitioners<\/p>\n<p>    perceive a situation in a particular fashion and vote<\/p>\n<p>    accordingly, even if their perception may be wrong, their<\/p>\n<p>    right to vote the way they did cannot be questioned.\n<\/p>\n<p id=\"p_36\">    Therefore, according to him, it is not necessary to go into<\/p>\n<p>    the question as to whether the petitioners had opposed the<\/p>\n<p>    resolutions for implementation of the National Rural<\/p>\n<p>    Employment Scheme or the scheme started under the 12th<\/p>\n<p>    Finance Commission. All the same, according to him, since<\/p>\n<p>    the petitioners had putforth specific objections to various<\/p>\n<p>    resolutions, including those pertaining to recovery of taxes,<\/p>\n<p><span class=\"hidden_text\" id=\"span_37\">                                              ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_38\">                                 21<\/span><\/p>\n<p>    it was incumbent upon the Chief Executive Officer to<\/p>\n<p>    examine whether the objections of the petitioners deserved<\/p>\n<p>    to be looked into.     He submitted that total absence of<\/p>\n<p>    reference to the replies filed by the petitioners in the report<\/p>\n<p>    of the Chief Executive Officer itself speaks volumes and<\/p>\n<p>    indicates total non-application of mind.\n<\/p>\n<p id=\"p_37\">    24.      The learned counsel for respondent No.4 &#8211; Chief<\/p>\n<p>    Executive Officer submitted that there was no lacuna in the<\/p>\n<p>    procedure followed by the Chief Executive Officer, who had<\/p>\n<p>    given a hearing to the petitioners.     He submitted that it<\/p>\n<p>    would be improper to assail the order of respondent No.4 on<\/p>\n<p>    the ground that it does not refer to or deal with the replies<\/p>\n<p>    filed by the petitioners to show cause notices issued by<\/p>\n<p>    respondent No.4.     He submitted that on petitioner&#8217;s own<\/p>\n<p>    admission they had opposed all the resolutions consistently,<\/p>\n<p>    principally because the Sarpanch happened to be in<\/p>\n<p>    minority and had already suffered a no confidence motion.\n<\/p>\n<p id=\"p_38\">    He submitted that in the scheme of things, where the<\/p>\n<p>    Sarpanch, who had been removed, had a right to have<\/p>\n<p>    recourse to remedies available in law, and had done so, it<\/p>\n<p>    was incumbent on the part of the petitioners, as responsible<\/p>\n<p><span class=\"hidden_text\" id=\"span_39\">                                                ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_40\">                                 22<\/span><\/p>\n<p>    representatives of the people, to ensure that the work of<\/p>\n<p>    local self-governing body did not come to a standstill. He<\/p>\n<p>    submitted that the petitioners should have avoided a<\/p>\n<p>    stalemate and should have allowed the Gram Panchayat to<\/p>\n<p>    function. Therefore, according to him, the behaviour of the<\/p>\n<p>    petitioners was irresponsible and, therefore, they were<\/p>\n<p>    rightly held to be remiss in their duties as members of the<\/p>\n<p>    Panchayat.\n<\/p>\n<p id=\"p_39\">    25.      The learned counsel for respondent No.4 pointed<\/p>\n<p>    out that under Section 45 of the Bombay Village Panchayats<\/p>\n<p>    Act, the Gram Panchayat has control over subjects<\/p>\n<p>    enumerated in the village list appended as Schedule 1 to<\/p>\n<p>    the Act. Item 73-A in the said list refers to the provisions of<\/p>\n<p>    employment to local needy persons seeking manual work<\/p>\n<p>    under any scheme of employment guarantee undertaken or<\/p>\n<p>    adopted or transferred to the Panchayat.                Therefore,<\/p>\n<p>    according to the learned counsel for respondent No.4,<\/p>\n<p>    failure of the petitioners to approve works under the<\/p>\n<p>    National Rural Employment Scheme resulted in failure of<\/p>\n<p>    the Panchayat to deal with a subject in the village list. He<\/p>\n<p>    also made available for my perusal the relevant circulars<\/p>\n<p><span class=\"hidden_text\" id=\"span_41\">                                                ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_42\">                                 23<\/span><\/p>\n<p>    issued by the Government in respect of the works to be<\/p>\n<p>    conducted by the Gram Panchayat under the schemes<\/p>\n<p>    sanctioned by the 12th Finance Commission. The sum and<\/p>\n<p>    substance of his arguments is that rather than waiting for a<\/p>\n<p>    decision by the Competent Authority on proceedings<\/p>\n<p>    initiated by the Sarpanch, who had been voted out, the<\/p>\n<p>    petitioners indulged in obstruction simply because they<\/p>\n<p>    happened to be in majority. He criticized politicization of<\/p>\n<p>    the development works and, therefore, termed the conduct<\/p>\n<p>    of the petitioners as remiss.\n<\/p>\n<p id=\"p_40\">    26.      The learned Government Pleader for respondent<\/p>\n<p>    Nos.1 and 5 also submitted that if the petitioners had a<\/p>\n<p>    grievance about any particular item of work, they could<\/p>\n<p>    have raised the same, but simply opposing every resolution<\/p>\n<p>    made no sense and, therefore, on proved facts, according<\/p>\n<p>    to him, the orders passed by the Divisional Commissioner<\/p>\n<p>    as also the Hon&#8217;ble Minister of State for Rural Development<\/p>\n<p>    cannot be assailed.\n<\/p>\n<p id=\"p_41\">    27.      I have carefully considered these contentions.\n<\/p>\n<p id=\"p_42\">    While there can be no doubt that democratically elected<\/p>\n<p><span class=\"hidden_text\" id=\"span_43\">                                              ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_44\">                                 24<\/span><\/p>\n<p>    representatives must behave with responsibility and should<\/p>\n<p>    ensure that the functioning of the local self-governing<\/p>\n<p>    bodies are not stalled for political reasons, instances, when<\/p>\n<p>    it became impossible for the Legislature of the State to<\/p>\n<p>    function because of political impasse, are far too many in<\/p>\n<p>    the sixty years of the existence of this Republic. Therefore,<\/p>\n<p>    it would be difficult to uphold the contention that majority of<\/p>\n<p>    elected representatives do not have the right to bring to a<\/p>\n<p>    halt the working of an elected body, should such body be<\/p>\n<p>    headed by a person in whom they have lost confidence.\n<\/p>\n<p id=\"p_43\">    Moral exhortations cannot take the place of a legal duty and<\/p>\n<p>    hence the right of the petitioners to use their vote for<\/p>\n<p>    obstructing the work of the Panchayat would have to be<\/p>\n<p>    recognised as a right flowing from and being a part of the<\/p>\n<p>    democratic process. Therefore, it would be unnecessary to<\/p>\n<p>    go into the question as to what were the resolutions which<\/p>\n<p>    the   petitioners   were   opposing.     Rather     it    may       be<\/p>\n<p>    impermissible, not only for this Court, but for any authority,<\/p>\n<p>    to examine as to whether any member of the elected body<\/p>\n<p>    had a justification for voting in a particular fashion. It would<\/p>\n<p>    be for the electorate to question the actions of their elected<\/p>\n<p>    representatives as and when the concerned body would go<\/p>\n<p><span class=\"hidden_text\" id=\"span_45\">                                                ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_46\">                               25<\/span><\/p>\n<p>    to polls again.    A political problem would have to be<\/p>\n<p>    resolved only by the political means and recourse to legal<\/p>\n<p>    procedure might not be permissible.\n<\/p>\n<p id=\"p_44\">    28.      It is not that the administration did not have any<\/p>\n<p>    other options open in the matter.     If they came to the<\/p>\n<p>    conclusion that the work of Gram Panchayat had come to a<\/p>\n<p>    standstill, powers under Section 145 of the Bombay Village<\/p>\n<p>    Panchayat Act could have been invoked and the Panchayat<\/p>\n<p>    could have been dissolved.     Rather than looking into the<\/p>\n<p>    grievance of the petitioners in the replies, which they had<\/p>\n<p>    sent, the Chief Executive Officer seems to have gone by the<\/p>\n<p>    complaint of the Sarpanch, who had been unseated, that<\/p>\n<p>    the petitioners opposed all the resolutions and seems to<\/p>\n<p>    have concluded that the petitioners were not entitled to<\/p>\n<p>    oppose the resolutions, which hits at the root of the<\/p>\n<p>    democratic process and the rights of democratically elected<\/p>\n<p>    representatives.   In this view of the matter, it was not<\/p>\n<p>    competent for the Divisional Commissioner to accept the<\/p>\n<p>    report of the Chief Executive Officer and to remove the<\/p>\n<p>    petitioners from the offices of members of Gram Panchayat<\/p>\n<p>    or for the Hon&#8217;ble Minister of State to uphold such an order<\/p>\n<p><span class=\"hidden_text\" id=\"span_47\">                                              ::: Downloaded on &#8211; 09\/06\/2013 15:49:13 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_48\">                                26<\/span><\/p>\n<p>    passed by the Divisional Commissioner.\n<\/p>\n<p id=\"p_45\">    29.      The petition is, therefore, allowed and the order<\/p>\n<p>    dated 24-7-2009 passed by Hon&#8217;ble Minister of State and<\/p>\n<p>    that   dated   23-4-2009        passed   by      the       Divisional<\/p>\n<p>    Commissioner, Nagpur Division, Nagpur, are quashed and<\/p>\n<p>    set aside.\n<\/p>\n<pre id=\"pre_1\">                       ig                    JUDGE.\n                     \n    Pdl.\n      \n   \n\n\n\n\n\n\n<span class=\"hidden_text\" id=\"span_49\">                                                  ::: Downloaded on - 09\/06\/2013 15:49:13 :::<\/span>\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Bombay High Court Shri Shrikant Chahakar vs The State Of Maharashtra on 8 April, 2010 Bench: R.
